REMARKS:

Town Council meeting. Agenda item five pertained to the North 40 Specific Plan and the
identified areas of consensus (page six) which might serve as a starting point for the Council's
discussion on April 14, 2015.
In addition, Attachment 63 contains a peer review evaluation by TJKM of Fehr & Peers MXD
analysis (Attachment 60). TJKM concurs with the methodology and conclusions of the Fehr &
Peers analysis.

The Council continued its discussion of the matter and identified the following areas of
consensus:
• Agree that there should be a Specific Plan;
• Acknowledge that the Vision Statement is appropriate — tabling for now the
possible addition of language regarding meeting the State housing requirements
in bullet #3;
• Agree that the Vision Statement is sufficiently general to include not only the
needs of the north side of Town, but other places in Los Gatos as well;
• Designate 20 units per acre zoning to be on a limited number of acres to meet
the Regional Housing Needs Allocation (RHNA) provisions;
• Distribute the residential uses equitably across the specific plan area;
• Provide a set aside for senior housing in terms of numbers of units, a
percentage, or number of acres;
• Determine how many acres Council should be looking at as designated for this
20 dwelling units per acre — not just for senior but for affordable housing;
• Agree for now that the Plan should include a maximum of 364 housing units;
• Agree for now that the Plan should include a maximum of 400,000 square feet of
commercial space;
• Acknowledge that section 2.6.7 is too general and the Plan needs some form of
definition or limitation beyond the current language;
• Include some type of chart or table that can be used with the language in section
2.6.7;
• Reduce the allowable total amount of small commercial spaces, 0 to 1,500
square feet and 1,501 to 3,000 square feet, to 2'/z percent each;
• Do not add a Conditional Use Permit (CUP) requirement for individual tenant
sizes over 50,000 square feet;
• Agree with allowing office and hotel uses with limitations for office in some
fashion.
The Council provided the following direction to staff:
• Request the Town Attorney to return with information on fair housing
requirements for senior housing regulations and how the units may be
designated;
• Provide information on potential impacts on the RHNA of designating senior
units;
• Provide suggested edits to section 2.6.7 which include language regarding mix
and size limitations for commercial spaces, and provide a proposed chart with
the changes;
• Provide a chart or language indicative of Council direction regarding hotel and
office uses as discussed by Council.

Subject: Peer Review of a North 40 Specific Plan Memorandum
Dear Jessy:
TJKM has completed a peer review of the March 3, 2015 memorandum entitled "North 40 TIA
Freeway Impact Elimination from MXD Trip Generation" prepared by Fehr and Peers (F &P). This
memorandum is a follow up to earlier F &P documents dealing with reduced trip rates for the
North 40 Specific Plan. F &P proposed reducing the trip rates found in their earlier traffic studies to
more appropriately account for the traffic characteristics of mixed -use developments. It was noted
that mixed -use developments have features that reduce auto trips compared to single use
developments:
• Complementary land uses
• Diverse land uses
• Walkable urban design and well- connected streets
These features are quantified in two national studies, the National Cooperative Highway Research
Program Report 264 and the EPA MXD model. F &P has developed a model based on the two
studies, called MXD +, which has been shown to have greater accuracy than the two national
studies. In using that model, the trip rates for North 40 Alternates A and B are reduced by 7
percent and 4 percent in the a.m. peak hour, respectively, and 23 percent in the p.m. peak hour
Pleasanton for both alternates compared with the DEIR traffic studies. In TJKM's earlier peer review of these
4305 Hacienda Drive findings, we concurred with this approach.

Two options are presented to achieve less than significant freeway impacts for Project Alternative
A:
• Remove all 62,500 square feet of general office and reduce medical office space to 35,000
square feet, or
• Remove all 62,500 square feet of medical office and reduce general office space to 40,000
square feet.
In either case, the earlier proposed retail, hotel and residential development for Project
Alternative A can be retained.

Council Members,
I agree with Ed's comments. The overriding concern from our standpoint is the N 40's impact to the
downtown. Restaurant uses will be a major draw to the N 40 and there needs to be a defined limit to
the number of these uses. What is also very concerning is the "Market Hall" concept which may be
classified as a large space (e.g. 30,000 sq. ft.) but then broken up into small spaces in the interior with
numerous food uses and retail outlets. It needs to be clarified that the larger spaces cannot be "broken
up" into smaller spaces to circumvent the limitations set forth in the chart.
Just to echo Ed below, it has been our understanding through this process that the retail component
should mirror a neighborhood shopping center (e.g. Vasona Station, King's Shopping Center) to serve
that end of town. We all know that Grosvenor wants a large regional center with the latest and greatest
stores /restaurants /anchor tenants but the end result if this occurs is the dismantling of the downtown
that has been the focal point of the council for the last 30+ years.
Finally, there needs to be an even playing field between downtown and the N 40 as it relates to
formula. To the extent there are no restrictions on formula in the N 40 district, it will become a
shopping mall that will attract customers away from the downtown area. To the extent the N 40 is
located at the N end of town, those traveling to Los Gatos on 17 will most certainly exit on Lark for the
"new" attraction with ample parking (and no parking restrictions) instead of heading into the "old"
downtown with limited parking.

Hello Council Members,
I want to share my thoughts before the big April 14 meeting on the North 40. 1 really
hope the council rejects the chart as proposed by the planning department. It allows
140,000 square ft of retail under 10,000 ft and 100,000 ft between 5001- 10,000. This
in no way represents a neighborhood center, and clearly contradicts the wishes of the
advisory committee. The 100,000 ft size ( 5001 - 10,000 ft) can be filled with 20 stores
of 5000 ft which would be a huge draw. Let's cut that number in half. Also there is no
limit on restaurants. There absolutely needs to be a limit. I could see Grovenor filling
the spaces with a significant number restaurants. The 5000 to 10,000 size is ideal for
corporate restaurants and there are many looking for a home. How many restaurants
are needed to serve the neighborhood? Five?
This total of 140,000 ft under 10,000 with a large number of restaurants will be a giant
draw away from the downtown. The chart is intended to protect the downtown, and is a
good idea, but right now as it stands I think it will kill the downtown. In reality though,
no one knows for sure what will happen if this plan is approved. So simply put, does it
really make sense to gamble with the future of the downtown?
