"SISTERS COURT" TO THE TOWN'S OFFICIAL STREET NAME LIST TO
BE USED AT THE PROPOSED DEVELOPMENT.
RECOMMENDATION:
Adopt a resolution approving the Final Map for Tract No. 10275 - 100 Prospect Avenue
(Attachment 1), accepting the dedications, and authorizing the Town Manager to execute the
Subdivision Improvement Agreement for the construction of public improvements and approving
the request to add the name "Sisters Court" to the Town's official street name list to be used at
the proposed development.
BACKGROUND:
The Town Planning Commission recommended that the Town Council certify the Environmental
Impact Report EIR -13 -002 and approve subdivision application M -13 -003 on February 26, 2014,
and on March 24, 2014 the Town Council did so. The developer, Summerhill Prospect Avenue,
LLC, is now filing the Final Tract Map 10275 to subdivide and create 17 new parcels and
dedicate to the Town the required public right of way.
On October 4, 1982, Town Council adopted a resolution 1982 -175 adopting procedures and
providing the official list of names to be used when naming new streets in the Town (Attachment
2). At the time Town Council approved subdivision application M -13 -003, a name was not
identified for the new public street.

DISCUSSION:
Tract No. 10275 subdivides an existing 10.3 acre parcel into seventeen single family lots. The
developer has provided all necessary maps and drawings. The developer is required to provide
the required contracts, bonds, and liability insurance to guarantee the construction of all
improvements of Tract No. 10275. The developer has paid the appropriate fees to fully comply
with the previously imposed development conditions and Town ordinances.
The project includes requirements of the developer for dedication of property to the Town to:
1) provide a full street right of way width of 40 feet for the future court at 100 Prospect Avenue;
2) create a new cul -de -sac terminus at the end of Prospect Avenue; 3) provide a curvilinear right
of way on Prospect Avenue; and 4) clean-up of a remainder portion of land split by the existing
Prospect Avenue right of way. The total project right of way dedication is 0.50- acres.
The developer is also required to dedicate property to provide public utility easements.
Easement dedications are in varying widths and are all shown on the attached map (Attachment
3).
The developer has provided a letter of request for the new street name (Attachment 4). The letter
details the Sisters' contributions to the Town, the community, and the region as a whole. The
developer would like to honor the history of the property and its only tenants, the Sisters of the
Holy Names of Jesus and Mary, and has requested that the Town add "Sisters Court" to the
Town's official street naming list. The street that is proposed to be named "Sisters Court" will
be a new public street that will be constructed with the project.
Approval of this item will complete these dedications, authorize the Town Manager to execute a
Subdivision Improvement Agreement with the developer to construct the public improvements
as required by the project, and add "Sisters Court" to the Town official street naming list.
ENVIRONMENTAL ASSESSMENT:
This activity is a project as defined under the California Environmental Quality Act (CEQA).
Under CEQA, an Environmental Impact Report (EIR) was prepared by the Town analyzing the
environmental impacts of the project and providing mitigation measures. The Draft EIR is dated
October 2013 and the subsequent Final EIR is dated February 2014. The Town Council certified
the Environmental Impact Report EIR -13 -002 on March 24, 2014.

FISCAL IMPACT:
The developers, Summerhill Prospect Avenue, LLC, have paid fees associated with this portion
of the project totaling $51,884.60. Subsequent to map recordation, and prior to issuance of a
grading permit, the developer will pay additional fees for the grading plan check and inspection
and encroachment permits in the amount of $151,605.62. To date, the developer has paid
$84,715.38 of those fees. Additional fees will be paid to the Town for work associated with later
phases of the project.
The Town will incur undetermined ongoing maintenance costs for the street and other public
right of way improvements following acceptance of the project.

OF THE TOWN OF LOS GATOS
APPROVING FINAL MAP OF TRACT NO. 10275 —100 PROSPECT AVENUE
ACCEPTING THE DEDICATIONS, AND AUTHORIZING THE TOWN MANAGER TO
EXECUTE THE SUBDIVISION IMPROVEMENT AGREEMENT FOR THE
CONSTRUCTION OF PUBLIC IMPROVEMENTS AND APPROVING THE REQUEST
TO ADD THE NAME "SISTERS COURT" TO THE TOWN'S OFFICIAL STREET
NAME LIST TO BE USED AT THE PROPOSED DEVELOPMENT.
WHEREAS, on March 24, 2014, the Town Council of the Town of Los Gatos approved
the Tentative Map Application M -13 -003, with conditions; and
WHEREAS, those conditions required the Owner or Subdivider to do the following:
1. That prior to the delivery of said Map to the Owner of said subdivision, and prior to its
recordation, the Owner or Subdivider of said subdivision shall enter into and execute an
agreement between the Town of Los Gatos and the said Owner or Subdivider on that
certain proposed subdivision agreement ( "Agreement ") on file in the Office of the Town
Clerk, entitled, "Contract for the Improvement of Tract No. 10275 — 100 Prospect
Avenue ", wherein the Owner or Subdivider in consideration of the approval of said Map
by the Town and acceptance by the Town of the dedication of lands for public use therein
contained, shall agree to construct and complete, within the time specified in said
agreement, all street and other improvements required of Owner or Subdivider under the
provisions in Chapter 27 of the Code of the Town of Los Gatos, and such other street,
sewer, or other improvements designated or mentioned in the Agreement and/or and as
specified in the Plans and Specifications for Tract No. 10275 —100 Prospect Avenue.
2. That said Owner or Subdivider shall, before the release of said Final Map to Owner of
Record, and as a condition precedent to the recordation thereof, furnish to the Town and
file with the Town Clerk cash, or a good and sufficient bond in form to be approved by
the Town Attorney, securing the faithful performance by said Owner or Subdivider of all
work, and the construction of all improvements herein in the Agreement, and within the
time herein specified, the amount of cash or said bond to be Seven Hundred Eighty Nine
Thousand and 00 /100 Dollars ($789,000.00).

3. That said Owner or Subdivider shall, before the release of said Final Map to Owner of
Record, and as a condition precedent to the recordation thereof, furnish to the Town and
file with the Town Clerk cash, or a good and sufficient bond in form to be approved by
the Town Attorney, securing the faithful performance by said Owner or Subdivider of
setting and relocation of all monuments shown and noted on said Tract Map, and within
the time herein specified, the amount of cash or said bond to be Ten Thousand and
00 /100 Dollars ($10,000.00).
4. That said Owner or Subdivider shall, before the release of said Final Map to Owner of
Record, and as a condition precedent to the recordation thereof, famish to the Town and
file with the Town Clerk certificates or policies of public liability and property damage
insurance in form satisfactory to the Town Attorney, providing public liability insurance
in the amount of Five Hundred Thousand ($500,000.00) Dollars for each person, and One
Million ($1,000,000.00) Dollars for each accident or occurrence, and property damage
coverage of Two Hundred Thousand ($200,000.00) Dollars whereby the Town of Los
Gatos, and in their capacity as such, its Council members, officers, boards, commissions,
and its employees will be insured, indemnified, and held harmless from any and all
claims of any kind or nature arising or resulting from the construction of said
improvements or other work of subdividing within or outside the said subdivision, and/or
arising or resulting from or concerning the doing or failing to do so by said Owner or
Subdivider of all things required to be done in the Agreement between said Owner or
Subdivider and the Town of Los Gatos.
WHEREAS, on October 4, 1982, the Town Council of the Town of Los Gatos adopted a
resolution (No. 1982 -175) approving the list of historic names to be used for naming new streets;
and
WHEREAS, the developer requests to add "Sisters Court" to the Town official street
name list; and
WHEREAS, the street that is proposed to be named "Sisters Court" will be a new public
street that will be constructed with the project; and
WHEREAS, the Owner or Subdivider has complied with the conditions of Tentative
Map Application M -13 -003.
NOW, THEREFORE, BE IT RESOLVED as follows:
1. That the certain Final Map of Tract No. 10275 — 100 Prospect Avenue in the Town of
Los Gatos, dated December 2014, and prepared by Carlson, Barbee & Gibson, Inc.
for approval by the Town Engineer of the Town of Los Gatos, is hereby approved; the
Town Manager is hereby authorized to execute the Agreement with the subdivider
and all offers of land for public use therein made on said map are hereby accepted.
2. The Town Council hereby designates the name "Sisters Court" for the new public
street for Tract No. 10275.

RESOLVED, that the Town Council hereby adopts the following procedure and the
attached list as the official list of names to be used when naming new streets in
the Town.
PROCEDURE:
1. Whenever a new street is proposed as part of a subdivision, the
subdivider shall choose a name for each street in the subdivision from
the attached list prior to the Planning Commission hearing on the
tentative map.
2. The chosen names will be resubmitted to County Communications for a
final check and then will appear on the tentative and final maps.
3. If a proposed street name is rejected for any reason the subdivider
shall choose another.
4. The Town Clerk will note on a copy of this resolution which names have
been used on recorded maps.
ATTACHMENT
FURTHER RESOLVED, that this resolution and list of names svpercedes any
previous list adopted by the Town Council.

Honorable Mayor and Councilmembers,
This letter is to request that the Town approve the name, "Sisters Court" forth new public street within
the recently approved 17 lot residential development at 100 Prospect Avenue. The site is the former
home of the Sisters of the Holy Names of Jesus and Mary Covenant. The Sisters occupied the site for
over 50 years and were important members of the neighborhood and community.
The Sisters of the Holy Names of Jesus and Mary in California began in 1868 when six Sisters from the
foundation house in Quebec, Canada arrived by ship and train in Oakland, CA. The Sisters established
their first convent and school on the shores of Lake Merritt. They established many schools in Oakland
and San Francisco, including Holy Names College in 1926 and Holy Names High School in 1931 which
both still operate in Oakland. The Sisters ultimately moved the convent from Oakland to Fremont
during World War II, and then purchased the subject property in 1945. The Los Gatos Convent opened
in 1952. There are 1,000 Sisters of the Holy Names worldwide, with 169 Sisters residing in California.
Since the Sisters' arrival in Los Gatos more than 65 years ago, they have served and supported the
residents of Los Gatos and the region through their mission of education, social justice, contemplation,
and the arts. The Sisters have served as members, visitors, and residents of the Town through
education, retreats, celebrations, pastoral, and other activities at the convent and in the community.
The Sisters helped found St. Mary's School downtown Los Gatos in 1954 and have educated thousands
of children as both teachers and administrators. For nearly 30 years, the Sisters sponsored Casa Maria
Montessori School at the Los Gatos Convent, providing education for hundreds more children.
SummerHili Homes purchased the property from the Sisters in August of this year. We would like to
honor the rich history of the subject property and the great work of the Sisters of the Holy Names of
Jesus and Mary, by naming the one new public street in the project after them and call it "Sisters Court".
