RECOMMENDATION: After opening and closing the public hearing, and asking the Clerk Administrator to read the title of the proposed ordinance, it is recommended the Town Council: 1. Accept the Planning Commission's findings and recommendations in the form of meeting minutes for the Zoning Code amendment (Attachment 3) (no motion required). 2. Make the required finding that the proposed Zoning Code amendments are consistent with the General Plan and its Elements. (Attachment 4) (motion required). 3. Town Council received comments on this matter from members of the public at meetings on February 4, 2013, and a continued meeting on February 11, 2013. At the time of the February 2013 Council meetings, the Los Gatos Town Code did not contain any regulations with respect to the sale of firearms, ammunition, and explosive devices, except to prohibit sales to minors. Therefore, at a Special Town Council meeting on February 11, 2013, Council approved staff recommendations to research, study, and return with information necessary to allow the Council to consider potential ordinances and policy changes which would: a. Designate land use zones which -may be appropriate for the retail sales of firearms and ammunition, including consideration of appropriate proximity limits from schools, parks, and selected establishment; b. Require a Conditional Use Permit (CUP) for the retail sale of firearms and ammunition; c. Restrict Home Occupation Permits for sale of firearms and ammunition; d. Establish a regulatory permitting process for dealers of firearms and ammunition; e. Require identification checks for the sale of ammunition; and/or f. Require the reporting of lost or stolen firearms. In addition, Council directed staff to prepare an urgency ordinance for consideration at the meeting of March 4, 2013, which would establish a temporary moratorium on the opening or expansion of any business engaged in the retail sale of firearms, ammunition, and /or explosive devices within the Town of Los Gatos to allow time to study and consider the land use issues related to firearms and ammunition sales, as described above. At the Town Council meeting on March 4, 2013, Town Council adopted an urgency ordinance establishing the temporary moratorium (Exhibit 1) and then extended that moratorium on April 15. 2013. The moratorium is still in effect until February 20, 2014, or until such time at the Town Council adopts any land use and zoning regulations. The Mayor appointed Council Members Marcia Jensen and Joe Pirzynski to an ad hoc subcommittee to work with staff on the language for an ordinance to establish a regulatory business permit process for firearms sellers in the Town of Los Gatos which was adopted by the Torn Council on August 5, 2013. In general, the adopted ordinance provides as follows: • Requires all firearms sellers to obtain a permit from the Town of Los Gatos; • Establishes minimum requirements and standards for obtaining such a permit, including verification of required state and federal licenses and certificates, a criminal history check of owners and employees, security measures, and verification of insurance; • Provides a public hearing process for the initial permit and annual renewals; • Establishes grounds for suspension or revocation of an existing permit. PAGE MAYOR AND TOWN COUNCIL SUBJECT: Firearm Regulation/A -13 -01 September 12, 2013 In addition, the Council ad hoc subcommittee was also directed to work with staff to develop zoning and land use regulations for firearms sellers. The Council ad hoc subcommittee is recommending the proposed zoning ordinance amendments for consideration and approval. DISCUSSION: A. Project Summary regarding Zoning Ordinance Amendments The intent of the proposed Zoning Ordinance amendments is to address the following items: 1. Designate the LM zoning district where retail sales of firearms and ammunition is permitted with approval of a CUP; 2. Establish regulations for a CUP for retail sales of firearms and ammunition including the findings; 3. Prohibit the sale of firearms and ammunition for Home Occupation Permits; 4. Incorporate existing Town policies regarding Home Occupation Permits and duties of the Planning Commission and Town Council. The Planning Commission staff report (August 28, 2013) includes a more detailed explanation of how the LM zoning district was selected for recommendation and the analysis of the CM zone (Attachment 1). See Attachment 5 for a thorough description of the proposed Zoning Ordinance amendments. In regards to existing uses, with the adoption of the proposed Zoning Ordinance amendments described in Attachment 5, any existing retail seller of firearms, ammunition, and/or destructive devices that were legally operating as of the effective date of this Ordinance would become a nonconforming use. As historically implemented for other uses added to the CUP table (i.e. establishments selling alcohol, new office buildings, formula retail, and personal service businesses), an existing nonconforming use would not be required to obtain a CUP unless the use was modified or expanded. In addition, pursuant to Section 29.10.195(a)(4) of the Zoning Ordinance, nonconforming nonresidential uses in the downtown area are permitted to continue in perpetuity if the use became nonconforming due to zone changes and ordinance amendments which occurred after July 1, 1982. Section 29.10.195(b) requires other uses to cease after a specific duration if they cannot come into conformance with the current zoning requirements. The Council ad hoc subcommittee considered the time limits contained in the existing Zoning Codes, and proposed three alternative options to be considered for adoption as part of the proposed land use ordinance. PAGE 4 MAYOR AND TOWN COUNCIL SUBJECT: Firearm Regulation/A -13 -01 September 12, 2013 Options: Compliance by existing firearms dealers 1. In perpetuity as currently required by Section 29.10.195(a)(4) of the Zoning Ordinance for downtown businesses which includes the site of the only existing firearms retailer, or 2. Any person lawfully engaging in the business of selling, leasing, or otherwise transferring any firearm or firearm ammunition on the effective date of the ordinance shall have a period of _ [days or years] after such effective date to comply with the provisions of this paragraph, or 3. 60 days as may be required by Section 29.10.195(b)(4) of the Zoning Ordinance for properties located outside of the downtown area. Options two and three would both require an amendment of the Zoning Ordinance. If Council determines an amortization period should be implemented, Section 29.10.195 of the Zoning Ordinance would require an amendment as follows: Sec. 29.10.195. - Termination of nonconforming use status. (a) Unless this division is amended to provide otherwise, the following nonconforming uses may continue interminably so long as they conform to the other requirements of this division: (1) Nonconforming residential uses (except nonconforming secondary dwelling units pursuant to section 29.10.320). (2) Schools. (3) Church uses. (4) Nonresidential uses in the downtown which would otherwise be nonconforming due to zone changes and ordinance amendments which occurred after July 1, 1982. (5) Residential care facilities for the elderly that existed as of January 1, 1988 and are nonconforming only as to parking. (6) Hotels /motels located in residential zones which were converted to multiple - family dwelling units prior to March 22, 1986, if a conditional use permit is obtained. (7) Commercial uses that are nonconforming as to parking if parking has been provided on -site by July 1, 1992, or twenty (20) years from the date the use became nonconforming, whichever is later. PAGES MAYOR AND TOWN COUNCIL SUBJECT: Firearm Regulation/A -13 -01 September 12, 2013 (b) The following nonconforming uses shall cease at the end of the following time periods: (1) A junkyard shall cease ninety (90) days from the date it becomes nonconforming. (2) Where there are improvements on land, but of a type for which no building permit would currently be required, the nonconforming use shall cease three (3) years from the date the use becomes nonconforming. (3) Where the land is improved with one (1) or more structures of a type for which a building permit would currently be required and the structure(s) are utilized in connection with the nonconforming use, nonconforming use shall cease twenty (20) years from March 23, 1966, or twenty (20) years from the date the use became nonconforming, whichever is later. (4) When a zoning amendment is adopted after 1981 that causes a use to be nonconforming solely by subjecting it to the requirement of obtaining a conditional use permit, all uses affected by the amendment shall apply for a use permit within sixty (60) days after the amendment becomes effective. Failure to make such application within that time shall make the subject use immediately unlawful (5) A business engaged in the retail sales firearms and/or destructive devices shall cease_ days (or years) from the date it becomes nonconforming. (c) If any period of authorized duration is held by a court to be too short and therefore unconstitutional or unlawful on its face or as applied, the period of duration shall be extended to such time as the court determines is lawful. B. Project Summary regarding Town Code amendment Section 18.70.015 Section 18.70.015 of the Town Code lists exceptions for when discharging a firearm is permitted. This section currently allows the discharging of firearms on private property which contains five or more acres. This section of the ordinance was likely written at time when the hillside areas were less populated and more rural. Due to the residential character change in the hillside areas, increase in public trails and some neighborhood concerns raised regarding this matter, staff is recommending that this portion of the section be repealed due to public safety concerns. The Council ad hoc subcommittee considered this matter and concurred with staffs recommendation. C. Project SummM regarding application fee When the Council considered the ordinance for the regulatory business permit process for firearms sellers for the on June 17, 2013, the staff report noted that if approved, staff would return to Council with a resolution to establish the fee to process the regulatory permit. The Town of Los Gatos' financial policies require that fees or charges for services be cost PAGE 6 MAYOR AND TOWN COUNCIL SUBJECT: Firearm Regulation/A -13 -01 September 12. 2013 recovery. Based on the anticipated staff time to process the proposed firearms dealer permit required by the ordinance, the initial permit fee should be established at $4,000. This fee level was based on a review of equivalent permits in Community Development and estimated time and costs for the Police Department, Town Manger's Office and the Town Attorney. Any fee approved would be added to the Town of Los Gatos Comprehensive Fee Schedule for FY 2013/14 effective on the date the Council adopts the resolution. Staff will continue to evaluate the process as any application for the permit is submitted and, will include a revised initial permit fee and an annual permit renewal fee in the Comprehensive Fee Schedule when it returns to Council in April 2014 for consideration. D. Planning Commission On August 28, 2013, the Planning Commission considered the proposed Zoning Ordinance amendments (item A above) and recommended adoption of the amendments as proposed by the Council ad hoc subcommittee. See Attachment 3 for the Commission's full discussion. Following are comments and issues raised during the public hearing process. Amortization • Make a distinction beNleen amortization for residential (home occupation) use and retail use. • Some Commissioners thought 60 days was too short for compliance and 20 years was too long. • Amortization period must be "reasonable" and balanced against investment in business. • nat if home occupation firearms use is annexed into Town, what is the amortization period for that use after annexation? Staff Note: Pursuant to current requirements, Section 29.10.195(3) of the Town Code, the amortization period is 20 years. Noticing TOWn should provide a mailed public notice to property owners in and surrounding the LAI zone to let them know that retail firearm sales may be allowed in that zoning district. Staff Note: Although State legislation only requires a newspaper display ad for zoning code amendments, at the recommendation of the Planning Commission, a mailed notice of this hearing was sent to all tenants and property owners within the LM zone and within 500 feet of the LM zone. 894 notices were mailed. Downtown /Central Business District • Ouestions whether existing firearms retailer (Templar) is located in the downtown. Staff Note: The Downtown area of Los Gatos has different zoning requirements in regards to parking and nonconforming uses than the rest of the Town. The Central PAGE MAYOR AND TOWN COUNCIL SUBJECT: Firearm Regulation/A -13 -01 September 12, 2013 Business District is located within the much larger Downtown area. Templar sports is located in the Downtown area, but not within the Central Business District as defined in the General Plan. See Attachment 8 for a map which outlines the boundaries of these two areas. Internet Sales • Questions if internet sales for firearms retailers should be regulated. Zoning • If a youth oriented business vacates its current location (or a school, church, etc) and the CUP expires after one year of non -use, then more parcels within the zoning district could be available for retail firearms sales. PUBLIC COMMENTS: Four public members spoke at the Planning Commission hearing, one of which also submitted written correspondence at the hearing (Attachment 2). Subsequent to the meeting the Town has received additional correspondence regarding this matter (Attachment 10). STAFF COMMENT: Subsequent to the Planning Commission hearing, staff met with the Council's ad hoc subcommittee to discuss some minor revisions to the Zoning Ordinance (Attachment 5). These revisions dealt with 1) eliminate requiring a CUP modification for any change in the State of California Certificate of Eligibility and 2) eliminate the term "youth oriented facilities ", and provide better clarification of these types of uses. The requirement that a change in a Certificate of Eligibility (CoE) required a CUP modification was eliminated since it was determined that a CoE is issued to an individual owner or employee of a firearms retailer and not issued to the business. As staff may be added or eliminated to a firearms retail seller, a CoE may be added or eliminated and isn't a change in use or operation of the business. The term "youth oriented facilities" was modified to include "a business which is primarily engaged in providing activities or instruction to persons under the age of 18." As noted at the Planning Commission hearing, if such a business were to vacate its current location and the CUP expires after I year of non -use, then more parcels within the zoning district could potentially be available for retail firearm sales. Additionally, if the proposed ordinance amendments are adopted, an inventory of existing businesses engaged in activities or instruction to persons under the age of 18 will be conducted by staff. If any similar new (youth) uses locate in the LM zone after the effective date of the PAGE MAYOR AND TOWN COUNCIL SUBJECT: Firearm Regulation/A -13 -01 September 12, 2013 ordinance, they will not trigger the 250 feet buffer zone from their location. This provision is being proposed to ensure that new uses are not introduced in the LM zone that have the potential effect of preventing a firearm retail seller to locate somewhere in the LM zone. The firearms business site selection map which was in the Planning Commission packet has been modified to more clearly identify parcel locations in the LM zone (Attachment 9). In addition, the Department of Motor Vehicles was added to the map as a sensitive use since it is a government building. This addition modified the 250 foot buffer radius which eliminated one parcel from being eligible to have a potential firearms business in the future. State Firearms Legislation Town staff is not recommending that Council address regulations regarding requiring identification checks for the sale of ammunition or- requiring reporting lost or stolen firearms at this time (these items are identified on Page 2 as (e) and (f) in the Background section). There are several bills regarding firearms regulations pending before the California State Legislature. The State Legislature is in session through September 12, 2013 and, the Governor has until October 13, 2013 to sign or veto bills passed during this Legislative Session. Until there is certainty on the State legislation, it is not recommended that Town adopt any new regulations that may later be determined to be in conflict or inconsistent with State law. CONCLUSION: Adoption of the proposed amendments would implement the recommendations made by the Council ad hoc subcommittee, would implement current policies and practices regarding home occupation permits, the duties of the Planning Commission and Town Council and would set a fee to review regulatory firearm permits. It is therefore recommended that Town Council 1. Approve the recommended amendments; 2. Consider and make a determination regarding the three options regarding amortization; and 3. Adopt a fee to review regulatory firearm permits. ENVIRONMENTAL ASSESSMENT: It has been determined that there is no possibility that this project will have a significant impact on the environment; therefore, the project is not subject to the California Environmental Quality Act (Section 15061 (b)(3)). FISCAL IMPACT: None for the Zoning /Town Code amendments. In regards to the regulatory business permit process for firearms sellers Town Council adopted on August 5, 2013, the Town's financial policies require that fees be maintained to provide for the recovery of costs associated with Town PAGE 9 MAYOR AND TOWN COUNCIL SUBJECT: Firearm Regulation/A -13 -01 September 12, 2013 services. The proposed new fee for the regulatory permit will represent the cost to process the permit. The fee will be reviewed during the budget process for the FY 2014/15 in Spring 2014. Planning Commission Staff Report - Page 3 Ordinance Amendment / A -13 -01 Au?ust 28, 2013 In addition, the Council ad hoc subcommittee was also directed to work with staff to develop zoning and land use regulations for firearms sellers. The Council ad hoc subcommittee is recommending the proposed ordinance amendments for the Planning Commission's and Town Council's consideration and approval. y PROJECT SUMMARY: The Town of Los Gatos proposes to amend sections of Chapter 29 (Zoning Regulations) of the Town Code as discussed below. The draft ordinance is attached as Exhibit 3. r ANALYSIS: The intent of the proposed amendments is to 1) designate a zoning district(s) where retail sales of firearms and ammunition is permitted with approval of a CUP; (2) establish regulations for a CUP for retail sales of firearms and ammunition; (3) prohibit the sale of firearms and ammunition for home occupation permits; and, (4) incorporate existing Town policies regarding home occupation permits and duties of the Planning Commission and Town Council. Please note that the new wording below appears in italicized bold type. There are no recommended strikethroughs. 1. Zoning District — Prior to the adoption of the moratorium, retail firearm sales were permitted in any zone that allowed retail sales, which were the C -1 (Neighborhood Commercial), C -2 (Central Business District), CH (Restricted Highway Commercial) and LM (Commercial - Industrial) zones. The Council ad hoc subcommittee reviewed each of these zones and the existing land uses that surrounded these zones. In addition. the Committee considered the CM (Controlled Manufacturing) zone which permits retail sales to the ultimate consumer of articles manufactured on the premises to the customer's order. The CM zone would have required an amendment to permit retail sales of firearms. Of the five zones reviewed, the Committee first determined that the LM and CM zones were the best zones to allow the use since each encompassed an industrial area which would have a minimal impact to residential neighborhoods. The Committee then analyzed LM and CM zoned parcels that were located outside of a 500 and 250 foot buffer radius of sensitive uses which included schools, educational facilities, public parks and trails, government buildings, religious institutions, existing youth- oriented facilities (i.e.: dance, karate). In addition, the Committee considered the locations of `safe route to schools." Because no parcels in the CM zone were outside either of the buffer radiuses, the Committee eliminated the CM zone as a possible location for retail firearms sales, and recommends that the use be permitted only in the LM zone with approval of a CUP. Therefore it is recommended that an X be placed under the LM zoning designation in the CUP Table under Commercial for item r listed below. Additional limitations on the location of specific uses are not uncommon in the Zoning Ordinance and, for example, are currently applicable to personal service businesses and office activities located in the C -2 zone. In the LM zone, no parcels were outside the 500 foot buffer radius as described above. Therefore the Committee recommends the 250 foot buffer radius. Attachrnent 4 provides a map to illustrate the recommended buffer area and what parcels are eligible to apply for a CUP for retail firearm sales. Based on the recommended language detailing the method used to measure distances from building walls of a potential retail space, additional retail spaces on other parcels not shown on the map may be available for retail firearms sales. Section 29.70.100. - Permitted uses. (a) Activities allowed in the LM or commercial- industrial zone are those service - oriented and light industrial uses which may be inappropriate in a general commercial zone and which are in the folloxaing categories: (1) Retailing. (2) Personal service businesses. (3) Service businesses necessary for the conduct of households or businesses. (4) Office activities approved on or before July 1, 1952; provided, that no change of use to office shall be permitted in the L \I zone. (5) Limited manufacturing. (6) Wholesaling and warehousing. (b) Examples of proper LM activities are plumbing, heating and electrical contracting, equipment repair, latmdr} and dry- cleaning plants, paint supplies, janitorial services, and to,,ving businesses. (c) Retail sales of firearms, ammunition and/or destructive devices are subject to the following: (1) Retail sales of firearms, ammunition and/or destructive devices may be allowed in the LM Zone with a conditional use permit subject to all of the restrictions and requirements set forth in this chapter and Sections 14.130.010 — 14.130.075 of the Tonvn Code. Hovever, retail sales of firearms, ammunition and/or destructive devices shall not be permitted within 250 feet of. a. Any premise occupied by a public or private daycare center, day care hone, nursery school, elementary junior high, middle or high school, or any other youth educational institution whether public or private. b. Any premise occupied by a government building, place of worship, public park or public trail. e. Any premise occupied by a youth- oriented facility not listed in section a above, existing prior to (insert effective date of ordinance). (2) All distances referred to in this section shall be measured between the closest points on the exterior property lines or area boundaries of the real property involved, except when the applicant proposes to occupy one unit of a multi -unit structure located on a single parcel, where distances shall be measured from the exterior boundaries of the unit so occupied 2. Definitions — The following definitions are recommended to be added to the Zoning Ordinance, which are consistent with the definitions adopted by the Town Council on August 5, 2013 in the new Ordinance establishing a regulatory business permitting process for retail firearms sellers as discussed above. Section 29.10.020. Definitions. Destructive Device means any explosive, incendiary, bomb, grenade or any similar device as more particularly defined in Title 18, United States Code, and the California Penal Code. -_e 6 August Firearm means atr device which is designed to be used as a weapon or nnm be converted or modified to be used as a weapon which expels a projectile through a barrel br the force of at explosion or other farm of combustion. A "firearm" includes any device defined in Title 18, United States Code, and relevant sections of the California Penal Code. Firearm Ammunition (o• Ammunition) means all ' cartridge v ctridge cases, primers, bullets, or propellant powder designed for use in any firearm, and a-V component thereof. Retail Sales of Firearms, Ammunition and /or Destructive Devices meats aq business engaged in the selling, leasing, or othernvise transferring any firearm, firearm component, ammunition and /or destructive device as defined in this chapter by means of traditional retail sales, individual or bulk transactions, internet transactions, or in any other manner indicative of trade. 3. Home Occupations — Prohibited Uses — Pursuant to Toisn Council direction, the sales of firearms, ammunition and /or destructive devices is proposed to be a prohibited horse occupation use. Currently the Torn has no valid home occupation permits for this type of use and therefore, the adoption of this amendment would not create an% nonconforming Home Occupation Permits. In addition; since prohibited home occupation uses are proposed to be added in the Zoning Ordinance. staff is recommending to incorporate additional prohibited uses (items 2 through 5 below), which are currently prohibited pursuant to a Planning Department Policy which became effective on September 23. 1996. The incorporation of this policy into the Zoning Ordinance Nvill provide consistence and clarity of the prohibited uses for staff and the general public. Section 29.10.09025 Home Occupations (f Prohibited uses. The follorcing etses are prohibited: (1) Retail sales offirearms, ammunition andlor destructive devices (2) Income fax preparers (3) Medical offices /uses (4) Real estate office/uses, excluding a use which is specifrcallp required to establish a mailing address to receive real estate information and no transactions occur on site. (5) Contractor /contracting services which have crews that meets on site prior to traveling to another job site, or which requires the storage of Planning Commission Staff Report - Page 7 Ordinance Amendment / A -13 -01 August 28, 2013 building materials or equipment on site, or which will park or store vehicles or construction equipment on site. 4. Findings —The Zoning Ordinance currently requires findings to deny CUP's for formula retail and personal service businesses, and new office buildings. The following findings are recommended to deny a CUP for new retail sales of firearms, ammunition and /or destructive devices. The standard findings to approve a CUP are still required to be made pursuant to the Zoning Ordinance. Section 29.20.190. Findings and decisions. (d) The deciding body, on the basis of the evidence submitted at the hearing, may deny a conditional use permit for new retail sales of firearms, ammunition and /or destructive devices if it finds any of the following: (1) The proposed use is not in harmony with specific provisions or objectives of the general plan and the purposes of this chapter; (2) The proposed use will detract from the existing balance and diversity of businesses in the industrial district in which the use is proposed to be located; and (3) The proposed use does not comply with the location requirements as contained in section 29.70.100. 5. Review of Conditional Use Permit —the following is recommended to be required when reviewing a new CUP or a modification to a CUP. Section 29.20.198. Review of application for a conditional use permit or modification to a conditional use permit for retail sales of firearms, ammunition andlor destructive devices. (a) When reviewing an application for a conditional use permit or modification to a conditional use permit for retail sales of firearms, ammunition anaUor destructive devices pursuant to section 29.20.185, the deciding body shall consider ill following factors in addition to those required in section 29.20.190 and section 29.70.100: (1) Any change in the type of Federal Firearms License type, any change in the State of California Certificate of Eligibility or any other required State license or permit, and change to the validity of the licenses held by the business granted a conditional use permit shall require an application for a modification of the conditional use permit, and shall be subject to all required findings set forth in section 29.20.190. A -13 -01 August 2S. 201= (2) For existing nonconforming businesses that do not have a conditional use permit, an-j- change in the type of Federal Firearms License type, any change in the State of California Certificate of Eligibili y or any other required State license or perntit, change to the validity of the licenses held by the business shall require all application for a conditional use permit, and shall be subject to all required findings set forth in section 29.20.190. (b) When reviewing all application for retail sales offtrearnns, allnt lilt ltiolt and /or destructive devices, the deciding body shall innpose the following conditions and operating standards: (1) No person: shall engage in the business of selling, leasing, transferring, advertising or offering or exposing for sale any firearms, ammunition, or destructive devices nwithout first obtaining a permit pursuant to the provisions of Sections 14.130.010 - 14.130.075 of the Town Code. For purposes of this chapter, engaging in the business of selling or transferring firearms, ammunition, and /or destructive devices includes the infrequent sale or transfer, offer, exposing far sale, or advertising of ftrearnns, ammunition, and /or destructive devices. (2) Within one year front occupancy the Town Council shall conduct annual reviews of the conditional use permit for compliance. (c) Notice of the hearing shall be subject to section 29.20.565 except that notices shall be mailed within five hundred (500) feet of the real properh• that is the subject of the hearing. (d) For the purposes of this chapter, amp change in the ttpe of Federal Firearms License tipe ol• State license of permits shall be considered an intensification of use. (e) The deciding body shall make written findings an the application based on substantial evidence in view of the whole record. (f) If State or Federal lav imposes more stringent requirements than those imposed pursuant to this section, then those State or Federal requirements shall apply. 6. Revocation or modification of a zoning approval — It is recommended that the Chief of Police may also request a public hearing for revocations or modifications of a zoning approval. Section 29.'_0.310. - Revocation or modification of a zoning approval. The Planning Commission on its own motion or on the recommendation of the Planning Director or the Chief of Police; may, and if requested by the Council shall; hold a hearing to consider modifying or revoking any zoning approx al that has been granted pursuant to this chapter or any prior ordinance. Notice of the hearing shall be given in the same manner as for the hearing of an application for Planning Commission Staff Report - Page 9 Ordinance Amendment / A -13 -01 August 28, 2013 zoning approval. Written notice of the hearing shall also be mailed to anv principals making use of, or relying upon, any such zoning approval not less than five (5) days prior to the date of the hearing. 7. Duties of the Planning Commission — It is recommended that the following verbiage be added since Town Council will be the deciding body for firearms sales. Furthermore, the addition of this verbiage will be consistent with the current policy of requiring Town Council approval for on -site alcohol consumption. Section 29.20.750. Planning Commission The Planning Commission: (8) Determines conditional use permit applications that are not assigned to the Development Review Committee or the Town Council. y 8. Duties of the Town Council— see above. Section 29.20.755 Town Council The Town Council: (2) Hears and determines Planning Commission recommendations for the adoption or amendment of the general plan or any specific plans and conditional use permits for establishments selling alcoholic beverages for on premises consumption and for retail sales of firearms, ammunition and/or destructive devices. SAF -10.2 Identify and mitigate law enforcement hazards during the project review and approval process. E\ISTPVG USES With the adoption of the proposed Zoning Ordinance amendments described above. any existing retail seller of firearms. ammunition; and /or destructive devices that was legally operating as of the effective date of this Ordinance, would become a nonconforming use. As historically implemented for other uses added to the CUP table (i.e. establishments selling alcohol, new office buildings. formula retail. and personal service businesses); an existing nonconforming use would not be required to obtain a CUP unless the use was modified or expanded. The Zoning Ordinance requires nonconforming uses that are annexed to the Town to come into compliance within 20 y ears. I n addition, pursuant to Section 29.10.195(a)(4) of the Zoning Ordinance, nonconforming nonresidential uses in the downtown area are permitted to continue in perpetuity if the use became nonconforming due to zone changes and ordinance amendments which occurred after July 1, 1932. Section 29.10.195(b) requires other uses to cease after a specific duration if they cannot come into conformance with the current zoning requirements. The Council ad hoc subcommittee considered the time limits contained in the existing Zoning Codes; and proposed three alternative options to be considered for adoption as part of the proposed land use ordinance. The determination as to which option will ultimately be adopted is a policy decision to be made by the Town Council. Options: Compliance by existing firearms dealers I. In perpetuity as currently permitted by Section 29.10.195(a)(4) of the Zoning- Ordinance for downtown businesses. or 2. Any person lawfully engaging in the business of selling_. leasing, or od:eryise transferring any firearm or fireann ammunition on the effective date of the ordinance shall have a period of _ days(years after such effective date to comply with the provisions of this paragraph. or 3. 60 days as required by Section 29.10.195(b)(4) of the Zonin g Ordinance for properties located outside of the downtown area. (2) Schools. (3) Church uses. (4) Nonresidential uses in the downtown which would otherwise be nonconforming due to zone changes and ordinance amendments which occurred after July 1, 1982. (5) Residential care facilities for the elderly that existed as of January 1, 1988 and are nonconforming only as to parking. (6) Hotels /motels located in residential zones which were converted to multiple - family dwelling units prior to March 22, 1986, if a conditional use permit is obtained. (7) Commercial uses that are nonconforming as to parking if parking has been provided on -site by July 1, 1992, or twenty (20) ~ears from the date the use became nonconforming, whichever is later. (b) The following nonconforming uses shall cease at the end of the following time periods: (1) A junkyard shall cease ninety (90) days from the date it becomes nonconforming. (2) Where there are improvements on land, but of a type for which no building permit would currently be required, the nonconforming use shall cease three (3) years from the date the use becomes nonconforming. (3) Where the land is improved with one (1) or more structures of a type for which a building permit would currently be required and the structure(s) are utilized in connection with the nonconforming use, nonconforming use shall cease twenty (20) years from March 23, 1966, or twenty (20) years from the date the use became nonconforming, whichever is later. WHEREAS, the sales of firearms and ammunition are not currently regulated under the Los Gatos Town Code nor does it contain adequate procedures for investigating and addressing the impacts of anew firearms businesses in the Town of Los Gatos, including the safety of the public at large and other health, safety, and welfare impacts. WHEREAS, the sale of firearms, ammunition and /or destructive devices has raised the following public health, safety and welfare concerns: school safety; parks, school routes, and residences in close proximity to such sales; potential negative influences of such sales on children; concerns and complaints about vandalism, protests, and threats related to the existirg retail firearms dealer in Los Gatos. WHEREAS, at the Town Council meetings on February 4, 2013 and February 11, 2013, Town Council received extensive public comments for approximately five hours on the issue of whether the Town of Los Gatos should consider adopting regulations concerning the business operations and sales of firearms, ammunition, and /or destructive devices. While the cominents were divided as to those who support firearms regulations and those that do not, at the conclusion of the February 11, 2013 meeting, Town Council directed Town staff to study the issues raised by the community during the Council meetings. WHEREAS, while the Town studies the issues requested by Town Council on February 11, 2013 concerning potential land use regulations of the sale of firearms, ammunition and destructive devices, considerable uncertainty exists as to whether future sales of firearms, ammunition, and/or destructive devices within the Town of Los Gatos will be subject to new land use regulations (zoning, conditional use permit, etc.) and ultimately be in conflict with the existing Town Code. Without an immediate moratorium, a new retail establislunent selling firearms could obtain a business license in the Town of Los Gatos within a matter of a few business days, similar to the process that occurred for Templar Sports. WHEREAS, other California cities adopted zoning ordinances and business regulations that govern the sales of firearms and ammunition. The State of California Legislature is currently considering new legislative bills this Session to fo ther regulate the sale of firearms and ammunition. The County of Santa Cruz adopted a moratorium on an urgency basis in January 2013 prohibiting new commercial sales of firearms and ammunition. =IBIT 1 NNIMMI AS, recent ever.:s throughout th-e Co_ n'y of Santa Clara and nearbv communities have generated additional fear of rardom usage of guns to commit violence on unsuspecting residents, minors and adults alike. WHEREAS, since Templar Spoils opened in December 2012, there have been three public protests, reports of vandalism, Lr_c eats directed at both those protesting against, and advocating for, the _ cf the store. RZH'.REAS, in the past five years the Los Gates /Monte Serene area has experienced an increase in gun - related homicide, and gum- assisted property theft, including an armed robbery of a Los Gatos business. WHEREAS, the Santa Clara County Suicide Prevention Oversight Committee has gathered data between 2009 and 2011, demonstrating that Los Gatos has the highest per capita suicide mate in Santa Clara County, and firearms are used in some of such deaths. Section 1. PURPOSE AND FINDI 7GS A. The above recitals are incorporated herein and each relied upon independently by the Town Council as findings for its adoptior_ of this urgency interim ordinance. B. The Town of Los Gatos Zor.ir_g Ordinance does not currently include regulation concerning the sale of firearms, ammunition o, destructive devices. C. The Town Council recently conducted approximately five hours of community discussions during Town Council meetings on February 4, 2013 and February 11, 2013 and received many concerned comments urging the Town Council to regulate the sale of firearms, ammunition, and /or destructive devices. D. Additional time is necessary for the Town to study the issues raised by the community anal To,vn Council concerning the sales of firearms, ammunition, and destructive devices. E. Adoption of the urgency interim ordinance imposing a temporary moratorium on establishment of commercial operations engaged in the sale of firearms, ammunition, and/or destructive devices is necessary to avoid the previously identified current and immediate threat to the public health, safety, and welfare. Section 2. INTERMI MORATORIUM IMPOSED For a period of forty -five (45) days, commencing on the date of the adoption of this urgency interim ordinance, or until such time as this urgency interim ordinance may expire subject to any extension of this urgency interim ordinance that the Town Council may adopt and approve pursuant to Government Code Section 65858, no zoning ordinance interpretation or amendment, or amendment to the General Plan, use permit, building permit, business license, or any other permit or entitlement for use shall be approved or issued for the approval, commencement, establishment or operation of, and no new person or entity shall operate, manage or conduct the commercial operations for sale of firearms, ammunition, and /or destructive devices upon any property in any zoning district within the Town of Los Gatos during the period this urgency interim ordinance is in effect. For the purpose of this period of the urgency interim ordinance, any existing person or entity currently issued and holding a valid Federal Firearms License and State Certificate of Eligibility for the sale of firearms and /or ammunition shall not be prohibited from continuing their current existing business operations. Section 3. URGENCY ORDINANCE; EFFECTIVE DATE AND DURATION Based on the findings set forth in the recitals and Section 1 herein, the recent community concerns, an immediate threat to the public health, safety, or welfare exists. This ordinarce is necessary to alleviate and address that threat until permanent land use regulations can be established. Therefore, this ordinance is adopted as an urgency ordinance pursuant to Govermnent Code Section 65858 and shall take effect immediately upon approval by a four -fifths vote of the Town Council. This ordinance shall be in full force and effect for a period of forty -five (45) days from and after the date of its adoption unless this period is extended by the Town Council in accordance with Governmer_t Code Section 65858. Ten (10) days prior to the expiration of this interim ordinance or any extension thereof, the Town Council shall issue a written report describing the measures that have been taken to study the relevant issues and to establish policies and regulations regarding commercial operations engaged in the sale of frrear, rs, ammunition, and/or destructive devices within the Town. Section 4. ENVIRONMENTAL ANALYSIS The ordinance is exempt from review under the California Envirorunental Quality Act (CEQA), pursuant to Sections 15060(c)(2), 15060(c)(3), and 15601(b)(3), because the proposal will not result in a direct or reasonably foreseeable indirect physical change in the environment, and only directs that a planning study be undertaken. The ordinance is categorically exempt from CEQA under Section 15308 of the State CEQA Guidelines. This ordinance is a regulatory action taken by the Town in accordance with Government Code Section 65858, to assure maintenance and protection of the enviromnent pending the completion of contemplated zoning ordinance revisions. Section 5. SEVER4BILITY If any section, subsection, phrase, or clause of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The Town Council hereby declares that it would have passed this ordinance and each section, subsection, phrase or clause thereof irrespective of the fact that any one or more sections, subsections, phrases, or clauses be declared unconstitutional. Section G. PUBLICATION This ordinance shall be published in accordance with to previsions of Government Code Sectior 36933. Section 7. Section 1-9. 10.020. Definitions. Destructive Device means any explosive, incendiay, bomb, grenade or any similar device as more particularly defined in Title 18, United States Code, and the California Penal Code. Firearm means any device which is designed to be used as a iveapon or may be converted or nnorlifned to be used as a weapon which expels a projectile through a barrel by the force of an explosion or other fornn of combustion. A "firearm" includes any device defined in Title 18, United States Code, and relevant sections of the California Penal Code. Firearm Ammunition (or Anununition) means any cartridge cases, primers, bullets, or propellant powder designed for use in vary firearm, and any component thereof. Retail Sales of Firearms, Ammunition and /or Destructive Devices nneans any business engaged in the selling, leasing, or otherwise transferring any firearm, firearm component, ammunition and /or destructive device as defined in this chapter by means of traditional retail sales, individual or bulk transaction, internet transactions, or in any other manner indicative of trade. Section 39.10.09025 Home Occupations ffl Prohibited uses. The following uses are prohibited. (1) Retail sales offrreanns, ammunition and /or destructive devices EXHIBIT A ( ?) Section 29 20.190. Findings and decisions. (d) The deciding body, on the basis of the evidence submitted at the hearing, nun• deny a conditional use permit for new retail sales offrrearnrs, ammunition an for destructive devices if it finds any of the,following: (1) The proposed use is not in harmo»_r with specific provisions or objectives of the general plan and the proposes of this chapter. �_f (2) The proposed use will detract front the existing balance and diversity; of businesses in the industrial district in which the use is proposed to be located; and (3) The proposed use does not comply with the location requirements as container) in section 29.70.100. Section 29.20.193. Review of application: for a conditional use permit or modification to a conditional use permit for retail sales of firearms, ammunition anlor destructive devices. (a) When reviewing an application for a conditional use permit or modfcation to a conditional use permit for retail sales of firearms, ammunition arztUor destructive devices pursuant to section 29?0.185, the deciding body shrill consider the following factors in addition to those required in section 29.20.190 and section 29.70.100: (1) Any change in the npe of Federal Firearms License O pe, any change in the State of California Cer•tifrcate of Eligibilitj� or ruzy other required State license or permit, and change to the validity of the licenses held by the business gaunter) a conditional use permit shall require an application for a modification of the conditional use permit, and shall be subject to all required findings set forth in section 29.20.190. (2) For existing nonconforming businesses that do not have a conditional use permit, any change in the t)pe of Federal Firearms License type, anv change in the State of California Certificate of Eligibility or any other required State license or permit, change to the validity of the licenses held by the business shall require an application for a 3 conditional use permit, and shall be subject to all required findings set forth in section 29.30.190. (b) iihen reviewing an application for retail sales of firearms, ammunition and/or destructive devices, the deciding borlr shall impose the following conditions and operating standards: (I) No person shall engage in the business of selling, leasing, transferring, advertising or offering or exposing for sale any firearms, ammunition, or destructive devices without first obtaining a permit pursuant to the provisions of Sections 14.130.010 - 14.130.075 of the Town Code. For proposes of this chapter, engaging in the business of selling or tratrsfet•rirng firearms, ammunition, and /a• destructive devices includes the infrequent sale or transfer, offer, exposing for sale, or advertising of firearms, ammunition, and /or destructive devices. (2) It ithin one year from occupancy the Town Council shall conduct annual reviews of the conditional use permit for compliance. (c) Notice of the !rearing shall be subject to section 39.20.565 except that notices shall be mailed within five hundred (500) feet of the real property that is the subject of the herring. (al) For the purposes of this chapter, anv change in the type of Federal Firearms License h pe or State license of permits shall be considered an intensification of use. (e) The deciding body shalt make written findings on the application based on substantial evidence in view of the whole record. (r If State or Federal lmv imposes more stringent requirements than those imposed pursuant to this section, then those State or Federal requirements shall apply. Section 29 20310. _ Revocation or modification of a zoning approval. The Planning Commission on its own motion or on the recommendation of the Planning Director or the Chief of Police, may, and if requested by the Council shall, hold a hearing to consider modifying or revoking any zoning approval that has been granted pursuant to this chapter or any prior ordinance. Notice of the hearing shall be given in the same manner as for the hearing of an application for zoning approval. Written notice of the hea ring sh all also be mailed to an v principals making use o£ or relying upon, any such zoning approval not less than five (5) days prior to the date of the hearing. Section 29.20.750. Planning Commission The Planning Commission: (S) Determines conditional use permit applications that are not assigned to the Development Review Committee or the Toivn Council. Section 29 20.755 Town Council The Town Council: (2) Hears and determines Planning Commission recommendations for the adoption or amendment of the general plan or any specific plans and conditional use permits for 5 establishments selling alcoholic beverages for on premises consumption cmd_jor retail sales of firearms, ammunition and /or destructive devices. Sec. _9.70.100. -Permitted uses. (a) Activities allowed in the LM or commercial - industrial zone are those service- oriented and light industrial rues i�hich may be inappropriate in a general commercial zone and which are in the folloNNing categories: (1) Retailing. (2) Personal service businesses. (3) Service businesses necessary for the conduct of households or businesses. (4) Office activities approved on or before July 1, 1932; provided, that no change of use to office shall be permitted in the L\i zone. (5) Limited manufacturing. (6) Wholesaling and warehousing. (b) Examples of proper LM activities are plumbing, heating and electrical contracting: equipment repair, laundry and dr%- cleaning plants; paint supplies: janitorial services, and towing businesses. Examples of activities Xvhich are not proper in the l-M zone are vehicle sales; large scale light industrial activity, professional or medical of -. e general business offices. (c) Retail sales offtrearms, ammunition anchor destructive devices are subject to the following: (1) Retail sales of firearms, anununition amb'or destructive devices may be allowed in the Ldf zone with a conditioned use permit subject to all of 0 the restrictions and requirements set forth in this chapter and Sections 14.130.010 — 14.130.075 of the Toren Code. However, retail sales of firearms, ammunition mud /or• destructive devices shall not be permitted within 250feet of: a. Any premise occupied by a public or private daycare center, day care home, nursery school, elementary junior high, middle or /ugh school, or any other youth educational institution whether public or private. b. Ant' premise occupied by a government building, place of worship, public park or public trail. c. Any premise occupied by a youth - oriented facilitP not listed in section a above, existing prior to (insert effective date of ordinance). J Re: Town Code Amendment A -13 -01. Retail Sales of Firearms. This document contains numerous assumptions, based on distorted and fraudulent information. It is a monument to political pandering and biased agendas. Prior to this proposed amendment (which will pass unanimously) the Town Council received and heard both written and oral arguments pointing out the fallacies of the "me too" legislation. That is, legislation which replicates existing state and federal law, as well as placing itself in conflict with many of those same laws. Going to Page 5 of the Ordinance Amendment we see a definition of "destructive device ". This definition references Title 18 United States Code and the California Penal Code. Replication, duplication, and unnecessary. Further, since 18 USC and the California Penal have different definitions of destructive device, which definition will be applied in Los Gatos? .Does anyone care? Also, since the Ordinance passed by the Town Council prohibits sales of destructive devices, why even address this matter repeatedly throughout the Amendment? Going to Page 6 of the Ordinance Amendment there is a definition of "firearm ". This definition conflicts with the definition of firearm in both California and Federal Law. Does anyone care? Page 8 of the Ordinance Amendment defines "engaging in the business of selling or transferring firearms... includes the infrequent sale or transfer .... of firearms, ammunition, and /or destructive devices." This definition is in direct conflict with California and Federal Law. It is vague and without legal effect. Examining Ordinance 2213 (Exhibit 1) [All on Page 11 we see assumptions without data. "...protecting the people from those who acquire guns lawfully._" ? ?? "Whereas the sale of firearms, ammunition....has raised the following public health, safety, and welfare concerns....concerns and complaints about vandalism, protests, and threats relating to the existing retail firearms dealer in Los Gatos." Blaming the victim for vandalism, protests, and threats? Unbecoming of any moral code. "While the comments were divided.." Untrue — approximately 60 -70 per cent of the comments were pro - Templar Sports. As to the emergency moratorium, "Without an immediate moratorium, a new retail establishment selling firearms could obtain a business license in the Town of Los Gatos with a matter of a few business days, similar to the process that occurred for Templar Sports." The author(s) of this statement intentionally ignored the months it took for Templar to establish its business. The months of obtaining federal licenses, and state licenses were ignored - deliberately, willfully, and maliciously. Page 2 of Ordinance 2213 is replete with biased statements. Paragraph after paragraph contains distortions, fraudulent statements, and false assumptions. The two accurate statements refer to the five hours of community discussions and the need for additional time for study of the issue. More wasted taxpayer monies. Exhibit 3 (Ordinance) has a simple declaratory statement. "It is the intent of the Town Council of the Town of Los Gatos to supplement State and Federal law and to not duplicate or contradict such law, and this ordinance shall be construed consistently with that intention." Obviously the author(s) of all the gathered documents didn't have the legal knowledge or the common sense thoughtfulness to address what has become a divisive issue with that statement in mind. SECTION II It is the intent of the Town Council of the Town of Los Gatos to supplement State and Federal law and to not duplicate or contradict such law, and this ordinance shall be construed consistently with that intention. If any section, subsection, sentence, clause, or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the other remaining portions of this ordinance. The Town Council hereby declares that it would have passed this ordinance and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsection, sentences, clauses, or phrases be declared unconstitutional. For pumoses of this chapter, engaging in the business of selling or transferring firearms, ammunition, and /or destructive devices includes the infrequent sale or transfer, offer, exposing for sale, or advertising of firearms, ammunition, and /or destructive devices. Within one year from occupancy the Town Council shall conduct annual reviews of the conditional use permit for compliance. Q Notice of the hearing shall be subject to section 29.20.565 except that notices shall be mailed within five hundred (500) feet of the real property that is the subject of the hearing. For the purposes of this chapter, any change in the type of Federal Firearms License type or State license of permits shall be considered an intensification of use. u The deciding body shall make written findings on the application based on substantial evidence in view of the whole record. (f ) If State or Federal law imposes more stringent requirements than those imposed pursuant to this section, then those State or Federal requirements shall apply. 11 Section 29.20.310. - Revocation or modification of a zoning approval. The Planning Commission on its own motion or on the recommendation of the Planning Director or the Chief of Police, may, and if requested by the Council shall, hold a hearing to consider modifying or revoking any zoning approval that has been granted pursuant to this chapter or any prior ordinance. Notice of the hearing shall be given in the same manner as for the hearing of an application for zoning approval. Written notice of the hearing shall also be mailed to any principals making use of, or relying upon, any such zoning approval not less than five (5) days prior to the date of the hearing. Section 29.20.750. Planning Commission The Planning Commission: (8) Determines conditional use permit applications that are not assigned to the Development Review Committee or the Town Council. Section 29.20.755 Town Council The Town Council: (2) Hears and determines Planning Commission recommendations for the adoption or amendment of the general plan or any specific plans and conditional use permits for establishments selling alcoholic beverages for on premises consumption and for retail sales of firearms, ammunition and/or destructive devices. 5 Sec. 29.70.100. - Permitted uses. (a) Activities allowed in the LM or commercial - industrial zone are those service- oriented and light industrial uses which may be inappropriate in a general commercial zone and which are in the following categories: (1) Retailing. (2) Personal service businesses. (3) Service businesses necessary for the conduct of households or businesses. (4) Office activities approved on or before July 1, 1982; provided, that no change of use to office shall be permitted in the LM zone. (5) Limited manufacturing. (6) Wholesaling and warehousing. (b) Examples of proper LM activities are plumbing, heating and electrical contracting, equipment repair, laundry and dry- cleaning plants, paint supplies, janitorial services, and towing businesses. Examples of activities which are not proper in the LM zone are vehicle sales, large scale light industrial activity, professional or medical offices and general business offices. (c) Retail sales of firearms ammunition and/or destructive devices are subject to the following: Retail sales of firearms, ammunition and/or destructive devices may be allowed in the LM zone with a conditional use permit subject to all of the restrictions and requirements set forth in this chapter and Sections 14.130.010 — 14.130.075 of the Town Code. However, retail sales of 0 firearms, ammunition and/or destructive devices shall not be permitted within 250 feet of: A. Any premise occupied by a public or private daycare center, day care home, nursery school, elementary, iunior high middle or high school or any other vouth educational institution whether public or private b. Further responses will be provided as possible in an Addendum and/or Desk Items. 1. Background a. Information on the type ofzoning for firearms sales in communities in our region. See attached chart (Exhibit A) b. Any legal considerations we should be aware of? A complete prohibition of firearm sales within any zoning district in the Town is not supported by prior court decisions. c. Why subcommittee focused on CM and LM zones as most appropriate. The Committee determined that the LM and CM zones were the most appropriate zones to allow the use since each encompassed an industrial area which would have the least impact to residential neighborhoods. The Committee also focused on these two zones since they do not encompass heavily used day to day neighborhood commercial areas. d. More explanation of why CM was eliminated. The reason noted by the Committee to eliminate this zone is the concern that the properties located within this zone were all located adjacent to or very near a government building, public park or trail. Although it was not part of the Committee's analysis, staff would have discouraged the CM zone due to a public safety concern in that the buildings in these zones tend to be in more secluded areas, set far back from the street and are only open during weekdays. Consequently, sites could be easier targets for after hour criminal activities if a firearm business occupied any of these spaces. 2. Sensitive uses a. What is the legal or standard land use definition of a sensitive use? The Town Code does not have a definition of a sensitive use. As discussed below, a use that primarily involves education or instruction of children and young adults would be considered by the Town as a sensitive use related to firearm sales and for service stations selling alcohol. Sensitive receptor or sensitive use is a term often used in environmental analysis under CEQA to refer to children or the elderly, hospitals, schools or eldercare facilities that may be impacted by a particular environmental condition such as noise, air quality, etc. ATTACHMENT I I b. What is the data or rationale for identifying these as sensitive uses— i.e. how are they at higher risk being within 250 feet as opposed to 100 or 300 or 500 feet, or any other distance away? There is a similarity between the sale of firearms and the sale of alcohol from service stations. In both cases, a significant concern is the potential effect of the use on children and young adults. In 1 996, in response to the concern about the location of service stations that sold beer and wine near schools, the Council adopted requirements that discourage this type of use from being located within 500 feet of schools, public parks, playgrounds, and youth oriented facilities pursuant to Section 29.20.197(a)(2) of the Town Code. Of the two zones the Council ad hoc subcommittee considered, neither of these zones had parcels which were located outside of the 500 foot radius. Therefore, the Committee reduced the distance until parcels were available outside of the radius which equated to 250 feet. c. Are there other California cities with zoning that identifies these sensitive uses and distances? See attached chart (Exhibit A) d. What is the state law about distance between firearms and schools? Both Federal and State law provide for a "Gun -Free School Zone." In California, no person may possess a firearm in a school zone (defined as on school grounds or within 1000 feet from grounds of a public or private school providing instruction for grades K -12) unless it is with written permission of the school district authority; within a residence or a place of business or on private property which is not part of the school grounds or when firearm is unloaded and in a locked container. There are also exceptions for law enforcement and persons exempt from prohibition against carrying concealed firearms. e. What is definition of "youth serving business " which seems vague and open to many interpretations? This term has been eliminated from the proposed amendments. See 2.a and 2.b above regarding sensitive uses. f What other zoning do we have in Los Gatos that identifies sensitive uses and sets distance limits? As noted above, the Town Code sets distance limits for service stations which sell beer and wine for off site consumption (Section 29.20.197 of the Town Code) and also for new personal service and office uses in the C -2 zone (Section 29.60.320(c) of the Town Code). 3. Amortization a. What have been the least and most amortization periods set in Los Gatos in the past? Most recently, when the Town has amended the Zoning Ordinance to require CUP's for a use, the deciding body has grandfathered in existing uses and made the requirement for a CUP to be effective from the date the ordinance was adopted. When the Town Code was amended in the late 1970's to require CUP's for many uses (i.e.: restaurants, bars, banks, service stations) a 20 year amortization was adopted. As permitted by Town Code, properties which are annexed to the Town must conform to Town requirements within 20 years, excluding junk yards, second units, and properties that have a use with no onsite structure, which have a shorter amortization period which ranges from 90 days to three years. Are there two parts to amortization —1) locating in an appropriately zoned parcel and 2) obtaining a CUP? Can the time for each of these be different? Amortization is typically applied to non - conforming uses after amending the zoning of a property or amending allowed uses in a zoning district. The purpose of an amortization period is to allow for a reasonable period of time for an owner to recoup the investment in a non - conforming property or use, or come in to compliance. c. What is the lease situation of Templar — length of lease and any automatic renewals? See attached master lease for building (Exhibit B). Town does not have a copy of the Templar lease. Businesses in Town are not required to provide a copy of any lease to the Town. 4. CUP a. Do we have other types of CUP findings that are similar to those proposed for 29.20.190? Similar findings are made for denying a formula retail or personal service business, Section 29.20. 190(b) of the Town Code and for the construction of new office buildings, Section 29.20.190(c) of the Town Code. b. Do we have other code language that allows Planning Commission on its own motion, without provocation, to hold a hearing of a zoning approval? There is no language in the Town Code that regulates what grounds are necessary to hold a hearing for revocation or modification of a zoning approval. There are required grounds however, to revoke or modify a zoning approval pursuant to Section 29.20.315 of the Town Code. c. What restrictions, if any, can the Town put on words and images used on the exterior of a retailer, or on interior if it is visible outside? Staff Note: Section 29.10.125 of the Town Code allows signs to show trade names or logos that are not the name of the entity on the premises but only when such trade name or logo is that of a product or service which is a major part of the sales or services conducted on the premises. In regards to restricting signs, the Town Code currently regulates that self - illuminated advertising for beer and wine signs for service stations are prohibited to be located on the buildings or windows. d. Can we prohibit the visible display of merchandise from outside the store? In regards to seeing merchandise inside the store, the Town could require that windows be tinted. This condition could be added to the recommended amendments to Town Code Section 29.20.198(b) which regulates conditions and operating standards. e. If any of these restrictions are possible, can we set them as a mandatory condition for any CUP application for firearms retail sales? It is possible to require conditions.
