SUBJECT: ADOPT A RESOLUTION EXTENDING THE TERM LIMITS AND
DESIGNATING THE CHAIR AND VICE CHAIR OF THE NORTH 40
ADVISORY COMMITTEE FOR THE COMPLETION OF THE NORTH 40
SPECIFIC PLAN.
RECOMMENDATION:
Adopt a resolution to extend the term limit and designate the Chair and Vice Chair of the North 40
Advisory Committee for the completion of the North 40 Specific Plan.
BACKGROUND:
On March 7, 2011, the Town Council adopted Resolution 2011 -010, which established the North 40
Advisory Committee as an advisory board to the Planning Commission and Town Council
(Attachment 1). Pursuant to the resolution, the Committee will sunset once the specific plan is
adopted or two and a half years from the adoption of the resolution (mid- Septernber 2013), unless
Town Council extends the time limit. Further, the Chair of the General Plan Committee previously
served as Chair of the North 40 Advisory Committee.
DISCUSSION:
The North 40 Advisory Committee is currently reviewing the first draft of the North 40 Specific
Plan. It is anticipated that the Draft Plan will be scheduled for public hearings later this year or early
next year. Depending on the direction provided at these hearings, it is recommended that the
Committee should sunset once the specific plan is adopted or by December 31, 2014, which is
consistent with the other contract dates for this project.

Since the January 2012 joint Town Council and Planning Commission review of progress on the
North 40 Specific Plan, the ranking Council Member on the General Plan Committee has served as
Chair of the North 40 Advisory Cormmittee. "Ranking" Council Member is determined by election
as Mayor, Vice Mayor, or longest serving member of Council.
FISCAL IMPACT
None
CONCLUSION:
Staff recommends that the Council adopt the resolution (Attachment 1) to extend the term limit and
designate the Chair and Vice Chair of the North 40 Advisory Committee for the North 40 Specific
Plan update, to reflect current schedules and practices.

RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
ESTABLISHING A NORTH 40 SPECIFIC PLAN ADVISORY COMMITTEE AS
AN ADVISORY BODY TO THE PLANNING COMMISSION
AND TOWN COUNCIL
WHEREAS, the North 40 Specific Plan was drafted in 1999 but was not adopted
pending adoption of the General Plan and further discussion on the goals and objectives
for the plan; and
WHEREAS, the majority landowner is now interested in developing a significant
portion of the North 40 area; and
WHEREAS, the Town has entered into a contract with RRM Design Group for
consulting services for the update and completion of the North 40 Specific Plan; and
WHEREAS, on February 7, 2011, the Town Council of the Town of Los Gatos
authorized the Town Manager to execute a contract for consulting services for the update
and completion of the specific plan; and
WHEREAS, Council determined that the former General Plan Update Advisory
Committee, which is comprised of the General Plan Committee and up to six community
members, should serve as an advisory committee to Town staff on the development of the
specific plan; and
WHEREAS, available community members from the former General Plan
Update Advisory Committee and members of the General Plan Committee will be
combined to form an advisory committee; and
RESOLVED, the Town Council of the Town of Los Gatos establishes the North
40 Specific Plan Advisory Committee, which shall be advisory to the Planning
Commission and Town Council and shall operate in the manner hereinafter prescribed;
Appointment
The North 40 Specific Plan Advisory Committee shall consist of rune members of
the General Plan Commnittee as established by Council resolution and up to six
community members from the former General Plan Update Advisory Committee.
Former GPAC members who are currently serving on another Town Committee or
Commission are not eligible.
The North 40 Specific Plan Advisory Committee shall sunset once the specific
plan is adopted or two and a half years from this date, unless extended by the Town
Council.
ATTACHMENT i
2. Committee Role
The Committee shall serve as an advisory body that provides community input on
product tasks associated with the update and completion of the North 40 Specific Plan.
The role of the N40 Advisory Committee is to:
Work with staff and the consultant to review and refine the Specific Plan at key
milestones
Participate in community workshops
Disseminate reports to Commissions and Council
Review the Draft Specific Plan and make recommendations to the Planning
Commission and Town Council
3. Meetings
The Chair of the General Plan Committee shall serve as Chair of the N40 Specific
Plan Update Advisory Committee. Staff and Consultant will determine the meeting
schedule. Advisory Committee members are expected to attend three to four milestone
meetings, and are encouraged to attend and participate in community workshops. It is
understood that on occasion an Advisory Committee member may not be able to attend a
meeting. In that event it is recommended that the member contact staff for an overview of
what occurred.
The Advisory Committee, working with staff and the specific plan consultant,
will work to develop a consensus on issues where possible. Formal votes on issues will
not be taken.
4. Conflict of Interest
Upon appointment to the Advisory Committee, members are required to file
Conflict of Interest forms with the Town Clerk for Disclosure Categories 2, 3, and 4 as
listed in Town Code Sec. 2.30.615,
5. ' Powers of Town Council and Planning Commission
Nothing in this resolution shall be construed as restricting or curtailing any of the
powers of the Town Council or Planning Commission, or as a delegation to the North 40
Specific Plan Advisory Committee of any of the authority or discretionary powers vest
and imposed by law in such bodies.

RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
EXTENDING THE TERM LIMITS OF
THE NORTH 40 SPECIFIC PLAN ADVISORY COMMITTEE
FOR THE UPDATE AND COMPLETION OF THE NORTH 40 SPECIFIC PLAN
WHEREAS, on March 7, 2011 the Town Council established the North 40 Advisory
Committee which is advisory to the Planning Commission and Town Council; and
WHEREAS, on March 7, 2011 the Town Council defined the operational role and
sunset date of the Advisory Committee as prescribed by Resolution 2011 -010; and
NOW, THEREFORE, BE IT RESOLVED THAT, the Town Council extends the
term of the Advisory Committee to sunset once the specific plan is adopted or by December
31, 2014, whichever comes first, unless further extended by the Town Council.
AND BE IT FURTHER RESOLVED THAT, the Mayor, Vice Mayor or other
most senior Councilmember appointed to the General Plan Committee shall, in order, serve
as the Chair and Vice Chair of the North 40 Advisory Committee.
