REPORT DATE: August 2, 2013 TO: MAYOR AND TOWN COUNCIL FROM: GREG LARSON, TOWN MANAGER SUBJECT: 2012 GENERAL PLAN ANNUAL PROGRESS REPORT RECOMMENDATION: Accept 2012 General Plan Annual Progress Report and authorize transmittal to the State. BACKGROUND: Government Code Section 65400 mandates that non - charter cities and all 58 counties submit an annual report on the status of their General Plan and any progress in its implementation to their legislative bodies. Annual Progress Reports (APRs) provide local legislative bodies with information regarding the implementation of the General Plan for the communities they represent. APRs must be presented to the local legislative body for its review and acceptance, usually as a consent or discussion item on a regular meeting agenda. After review and acceptance, a copy of the APR is required to be filed with the Governor's Office of Planning and Research (OPR) and the Housing and Community Development Department (HCD). There is no standardized form or format for the preparation of the General Plan APR. The APR is also_not required to incorporate all of the General Plan elements and was not intended to be an elaborate and time consuming endeavor to prepare. The APR prepared by staff meets the basic statutory requirements of State law and highlights key aspects of the Town's General Plan implementation durilig the calendar year of 2012 (Attachment 1). It is a type of activity that is Categorically Exempt, Class 6 (Information Collection) based on Section 15306 of the CEQA Guidelines. CONCLUSION: Staff recommends that the Council accept the 2012 General Plan Annual Progress Report and authorize transmittal to the State. Baily Community Development Director ATTACHMENT 1 INTRODUCTION The Town Council adopted the Town of Los Gatos 2020 General Plan on September 20, 2010 after an extensive two -year community process to update and build upon the strong foundational framework established by the Town's 2000 General Plan. On March 5, 2012, the Town subsequently adopted its updated Housing Element which is a required sub - element to the General Plan, The State Housing and Community Development Department certified the Housing Element on September 20, 2012. A list of significant Planning Projects approved by the Town in the 2012 Planning Period is attached to this report as Exhibit A. The following development projects were approved by the Town during 2012: • Swanson Ford Site Redevelopment Demolition of former auto dealership and construction of 25 residential units with 3 Below Market Rate Units and approximately 30,000 s.f. of commercial retail space. Approved August 8, 2012 • Riviera Terrace Apartment Expansion Renovation of a 24 unit apartment building with a 50 unit expansion, including 25 Below Market Rate Units authorized under State Density Bonus Law Approved by October 24, 2012 • Placer Oaks Road Subdivision 10 -unit single family subdivision with a Below Market Rate Unit. Approved July 11, 2012 • 14251 Winchester Boulevard Demolition of an existing office building and construction of a new medical office building with approximately 13,800 square feet. Approved May 23, 2012 The following General Plan related implementation action items were completed during 2012: ® Adoption of Town Code Amendments to incorporate the State Density Bonus Law Approved by Town Council on June 18, 2012 g Adoption of a Sustainability Plan to serve as the Town's Greenhouse Gas 9GHG) Emissions Reduction Plan and satisfy 2020 General Plan Action EV -13.1. Approved by Town Council on October IS, 2012. ON -GOING GENERAL PLAN IMPLEMENTATION PROJECTS IN 2012 Affordable HousingLOverla Zoning with Site Development Standards and Guidelines Overlay zoning program to facilitate potential affordable housing developments Preparation began in January 2012 and tentatively scheduled for Town Council review by December 2013. Zoning Ordinance Amendments to Implement Housing Element Specific Zoning Ordinance Amendments required to implement Housing Element Action Items related to Emergency Shelter Zoning, Transitional Housing, Definitions, By -Right Multifamily Uses, and Reasonable Accommodation. Initiated and tentatively scheduled for Town Council review by December 2013. HOUSING ELEMENT ANNUAL PROGRESS The Town filed an Annual Housing Element Progress report for 2012 with the State Housing Community Development (HCD) Department in April 2013. The Housing Element Annual Progress Report was filed electronically via the official HCD website and with hard copies to both HCD and the Governor's Office of Planning and Research (OPR). Copies of the report are attached as Exhibit B.
