ADOPT AN ORDINANCE RESCINDING ORDINANCES 1247, 1366, AND 1955 AND AMENDING THE ZONING ORDINANCE EFFECTING A ZONE CHANGE FROM CM:PD TO CM:PD AT 90 - 160 ALBRIGHT WAY AND 14600 WINCHESTER BOULEVARD. RECOMMENDATION 1. Adopt the revised Resolution certifying the environmental impact report for the project (Attachment 3); and 2. Adopt an ordinance rescinding ordinances 1247, 1366, and 1955 and amending the zoning ordinance effecting a zone change from CM:PD to CM:PD at 90 - 160 Albright way and 14600 Winchester Boulevard (Attachment 1). BACKGROUND On May 20, 2013, the Town Council held a public hearing on this item. However, the public input portion for this item was not completed and the agenda item was continued to June 3, 2013. On June 3, 2013, the Council completed the public input, considered and voted to introduce an ordinance rescinding Ordinances 1247, 1366, and 1955 and amending the Zoning Ordinance effectuating a zone change from CM:PD to CM:PD for the property located at 90 -160 Albright Way and 14600 Winchester Boulevard. Baily, Director of Community Development A Reviewed by: Assistant Town N:\DEVITC REPORTS OlNuncNAlbrighr2nd Reading.doc Attorney- Finance PAGE MAYOR AND TOWN COUNCIL SUBJECT: 90 -160 Albright Way and 14600 Winchester Boulevard June 17. 2013 The Council introduced the ordinance with the following modifications: • Buildings 1 and 4 would be limited to 50 feet maximum all inclusive of screening, mechanical and other accoutrements; • No freeway visible signage; • The garage would be limited to 35 feet maximum all inclusive of solar panels, with underground parking possible with subsequent review; • The square footage for the entire office project would be limited to 485,000 square feet; • There would be a requirement to provide "keep clear" or equivalent markings and signage at the intersection of Charter Oaks and Lark; • Accept applicant's offer for a community benefit of $1.00 per square foot of constructed office space; and • Direction to require consulting architect review and approval of Architecture and Site modifications resulting from the changes to buildings 1 and 4. DISCUSSION Adoption of the revised ordinance and CEQA resolution is required to finalize that decision.
