THROUGH JUNE 30, 2014 TO PROVIDE SERVICES FOR UNDERGROUND UTILITY LOCATING REQUESTS RECOMMENDATION: Authorize the Town Manager to execute an amendment to the agreement between the Town of Los Gatos and Siemens Industry, Inc. through June 30, 2014 to provide services for underground utility locating requests. BACKGROUND: As an owner /operator of underground utilities (street lights, and traffic signal facilities), the Town of Los Gatos is obligated by law to locate and identify these facilities whenever there is plamied construction activity in the vicinity. The Town of Los Gatos does not have adequate in- house staffing resources to provide this service and has contracted in the past few years with various electrical contractors as well as with City of Campbell for performing this service. The City of Campbell is the agency which has most recently been performing underground utility services for the Town at a cost of $75 per Underground Service Alert (USA) request. The Town has been informed by the City of Campbell that due to their internal staffing allocations and demands, they will no longer be able to perform this service at the cost of $75. FOR UNDERGROUND UTILITY SERVICES DISCUSSION: Since the $75 fee is a part of the Town's fee structure and is collected from applicants for encroachment permits, it is important to keep the cost at $75. Town staff and the City of Campbell staff met to discuss the options. Ultimately, the Town moved forward to investigate other resources to perform the utility locate services at the $75 per request cost. Staff discussed the subject of utility locate services with Siemens Industry Inc. This firm has been performing street light and traffic signal maintenance service for the Town for years and is familiar with this part of the Town's infrastructure system. Siemens Industry, Inc. has agreed to provide the underground utility service for the Town at the current rate of $75 per request. Town Staff have been satisfied with the work and service done by Siemens Industry, Inc. on maintenance of Town street lights and traffic signals and can affirm that this has been a successful working relationship and good service to the community. CONCLUSION: The current agreement between the Town and Siemens Industry Inc. for street light and traffic signal maintenance extends to June 30, 2014. Staff recommends that the Town Council authorize the Town Manager to execute an amendment to this agreement with Siemens Industry Inc. to include underground utility locating services through June 30, 2014. ENVIRONMENTAL ASSESSMENT: This project is defined under CEQA, and is categorically exempt under section 15301. FISCAL IMPACT: The Town's fee schedule covers the actual cost of providing underground utility locating services as part of the encroaclunent permit process. This fee is paid for by applicants who obtain an encroachment permit. There are no additional costs to the Town.
