SUBJECT: PPW JOB NO. 12 -01 — PAGEANT GROUNDS PHASE 3 IMPROVEMENTS -
RENOVATIONS 411- 831 -1201
AUTHORIZE THE TOWN MANAGER TO EXECUTE A CERTIFICATE OF
ACCEPTANCE AND NOTICE OF COMPLETION ACCEPTING THE WORK
OF BEARDEN CONSTRUCTION COMPANY, INC. DBA CB CONCRETE
CONSTRUCTION, INC. AND AUTHORIZE RECORDING BY THE CLERK
ADMINISTRATOR.
RECOMMENDATION:
Authorize the Town Manager to execute a Certificate of Acceptance and Notice of Completion
accepting the work of Bearden Construction Co., Inc. dba CB Concrete Construction, Inc. and
authorize recording by the Clerk Administrator.
BACKGROUND:
The Town's adopted FY 2012/13- 2016/17 Capital Improvement Program (CIP) Budget
designates funding for improving the condition of Town parks and facilities. This project is
consistent with the Town's goals to improve the quality of public infrastructure in Los Gatos.
The new Los Gatos Library project included the construction of access improvements to the
adjacent Pageant Grounds as the first step in renovating this historic site. The construction
improvements included removal of a large enclosure housing the Civic Center cooling tower,
construction of an ADA compliant pathway providing access to both levels of Pageant Grounds,
installation of historic mosaics, historical lighting fixtures, and landscaping adjacent to the new
library and entrance to the Pageant Grounds.
The current project provided for the renovation of Pageant Grounds, including new landscaping,
hardscape, a new irrigation system, as well as new seating and picnic areas with fully accessible
tables and benches that will accommodate all residents in the community.
The grand re- opening of Pageant Groun vas successfully held on Saturday, April 20, 2013.

DISCUSSION:
On July 19, 2012, during the Town Council summer recess, the Town Manager awarded the
contract to CB Concrete Construction, Inc. to perform the Phase 3 Improvements at Pageant
Grounds.
The construction of the improvements to the Pageant Grounds has been successfully completed
by Bearden Construction Co., Inc. dba CB Concrete Construction, Inc. and is being
recommended for acceptance by the Parks and Public Works Department.
Ten percent of the faithful performance bond will remain in effect for a period of two years to
guarantee any needed repair and /or replacement caused by defective materials and workmanship.
The execution and recordation of the Certificate of Acceptance is now required to finalize the
Town's acceptance of the project.
CONCLUSION:
Staff recommends that the Town Council authorize the Town Manager to execute a Certificate of
Acceptance and Notice of Completion accepting the work of Bearden Construction Co., Inc. dba
CB Concrete Construction, Inc. and authorize recording by the Cleric Administrator.
ENVIRONMENTAL ASSESSMENT:
This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice
of Exemption will not be filed.
FISCAL IMPACT:
This project was completed within the Council approved budget, as demonstrated in the fiscal
table below.
