CONSIDER A REQUEST TO APPROVE CONDITIONAL USE PERMIT U -12- 004. PLANNING COMMISSION RECOMMENDATION: The Planning Commission recommended that the Town Council: 1. Make the required findings (Attachment 1) and approve Conditional Use Permit U -12 -004 with modifications as recommended by the Planning Commission (motion required); and 2. Adopt a Resolution of approval with recommended conditions for a Conditional Use Permit (CUP) to operate a wine bar (Spain) on property zoned C -1 (Attachment 2) (motion required). ALTERNATIVES: Instead of the aforementioned actions, the Council may: ® Approve the application subject to modified or additional conditions of approval (motion required); or ® Continue the project to a date certain with specific direction (motion required); or ® Remand the project to the Planning Commission with specific direction (Attachment 3) (motion required); or ® Deny the application (Attachment 4) (motion required). Santa Cruz Avenue/U -12 -004 July 24, 2012 BACKGROUND: The proposed project will occupy a portion of a tenant space in the Los Gatos Shopping Center previously occupied by a personal service business, 2 Fabulous Salon. The amended Alcoholic Beverage Policy (ABP) was adopted by the Town Council in September 2001. The purpose of the ABP is to provide parameters for alcoholic beverage service and direction through a General Policy and a Specific Policy. The Town is in the process of modifying the ABP. Staff analyzed the proposed CUP against the existing ABP. DISCUSSION: A. Project Summary The applicant is requesting to operate a 990 square foot, 20 -seat wine bar (Spain). The wine bar would be open from 3:00 p.m. to 10:00 p.m. on Monday, 3:00 p.m. to 11:00 p.m. Tuesday and Wednesday, and 3:00 p.m. to 12:00 a.m. Thursday through Saturday. As recommended by the Planning Commission, the wine bar would also be open on Sundays from 3:00 p.m. to 10:00 p.m. Although the applicant does not currently plan to operate on Sundays, the Planning Commission recommended the hours of operation include Sunday to allow the use the opportunity to operate on Sundays in the fature without the need to retum for a CUP modification. Alcoholic beverage service would cease one hour prior to closure. The ABP requires specific findings for alcohol service after 10:00 pm. The establishment would serve wine, beer, and tapas. Alcoholic beverage service would be allowed only when food service is available. Although this requirement is the same placed on other wine establishments, it differs from the requirement for restaurants that permits alcoholic beverage service only when accompanied by meal service. The use would be subject to any new requirements in the Town's Alcoholic Beverage Policy. B. Planning Commission On May 23, 2012, the Planning Commission considered the subject application (see Attachment 8 for a thorough description of the project). See Attachment 7 for the Commission's full discussion. The Planning Commission recommended approval of the CUP. The Planning Commission recommendation includes modified conditions as follows (deletions stricken, additions underlined): HOURS OF OPERATION: Maximum hours of operation are Sunday and Monday 3:00 p.m. to 10:00 p.m.; Tuesday and Wednesday 3:00 p.m. to 11:00 p.m.; and Thursday through Saturday 3 :00 p.m. to 12:00 a.m. 4 =1 MAYOR AND TOWN COUNCIL SUBJECT: 424 N. Santa Cruz Avenue/U -12 -004 July 24, 2012 HOURS OF ALCOHOLIC BEVERAGE SERVICE: The service of alcoholic beverages shall not be permitted after 9:00 p.m., Sunday and Monday; after 10:00 p.m., Tuesday and Wednesday; or after 11:00 p.m., Thursday through Saturday. Staff erroneously included a delivery condition not applicable to the subject application. Therefore, the following condition was removed from the recommended conditions of approval. PUBLIC COMMENTS: The Town received 26 public comments (Attachment 6) which were all in support of the proposed project. CONCLUSION: The project would allow a new wine establishment in a vacant commercial space. The Alcoholic Beverage Policy gives the hearing body discretion to approve alcoholic beverage service when the proposal will not negatively impact residential neighbors, alcohol related incidents will not occur, and when the application will provide a positive impact to the commercial area. The Planning Commission believes this application meets the aforementioned parameters and recommends approval of the application subject to the modified conditions discussed above. ENVIRONMENTAL ASSESSMENT: The project is Categorically Exempt according to Section 15301 of CEQA as adopted by the Town, which exempts permitting an existing facility involving negligible use beyond the existing use. APPROVAL: This application shall be completed in accordance with all of the conditions of approval listed below and in substantial compliance with the plans noted as received on March 23, 2012. Any changes or modifications made to the approved plans shall be approved by the Director of Community Development, the Development Review Committee, the Planning Commission, or the Town Council depending on the scope of the changes. 2. EXPIRATION OF APPROVAL: The Conditional Use Permit application will expire two years from the date of approval unless it is used before expiration. Section 29.20.335 defines what constitutes the use of an approval granted under the Zoning Ordinance. 3. ALCOHOLIC BEVERAGE POLICY: The applicant shall be subject to comply with any new requirements in the Town's Alcoholic Beverage Policy within six (6) months from the date of the change in policy. 13. CERTIFICATE OF USE AND OCCUPANCY: A Certificate of Use and Occupancy from the Los Gatos Community Development Department must be obtained prior to commencement of use. 15. BUSINESS LICENSE: A business license from the Town of Los Gatos Finance Department must be obtained prior to the commencement of any new or change of use. 16. TOWN INDEMNITY: Applicants are notified that Town Code Section 1.10.115 requires that any applicant who receives a permit or entitlement from the Town shall defend, indemnify, and hold harmless the Town and its officials in any action brought by a third party to overturn, set aside, or void the permit or entitlement. This requirement is a condition of approval of all such permits and entitlements whether or not expressly set forth in the approval, and may be secured to the satisfaction of the Town Attorney. Building Division 17. PERMITS REQUIRED: A Building Permit shall be required for the any alterations to the existing commercial building. Separate permits are required for electrical, mechanical, and plumbing work as necessary. 18. CONDITIONS OF APPROVAL: The Conditions of Approval must be blue -lined in full on the cover sheet of the construction plans. A Compliance Memorandum shall be prepared and submitted with the building permit application detailing how the Conditions of Approval will be addressed. 19. SIZE OF PLANS: Four sets of construction plans, maximum size 24" x 36 ". 20. TITLE 24 ACCESSIBILITY — COMMERICAL: For any proposed tenant improvements, on -site parking and general path of travel shall comply with the latest California Title 24 Accessibility Standards. Work shall include, but not be limited to, accessibility to building entrances from parking facilities and sidewalks. The building shall be upgraded to comply the latest California Title 24 Accessibility Standards. Necessary work shall be first investigated by the design Architect and then confirmed by Town staff. 21. APPROVALS REQUIRED: The project requires the following departments and agencies approval before issuing a building permit: a. TRAFFIC IMPACT MITIGATION FEE (COMMERCIAL): The developer shall pay a fee proportional to the project's share of transportation improvement needed to serve cumulative development within the Town of Los Gatos. The fee amount will be based upon the Town Council resolution in effect at the time the building permit application is made. The fee shall be paid before the building permit is issued. The traffic impact mitigation fee for this project, using the current fee schedule and the preliminary plans is $6,199.39. The final fee shall be calculated from the final plans using the rate schedule in effect at the time of the building permit application, using a trip generation rate based on high quality restaurant use. TO THE SATISFACTION OF THE SANTA CLARA COUNTY FIRE DEPARTMENT: 23. FIRE SPRINKLER SYSTEMS: Fire Department records indicate that the building is equipped with a fire sprinkler system. Any interior remodeling may require modification to this system. A State of California licensed (C -16) Fire Protection Contractor shall submit plans, calculations, a completed permit application an appropriate fees to the fire department for review and approval prior to beginning their work. TO THE SATISFACTION OF THE CHIEF OF POLICE: 24. UNIFORMED SECURITY: Uniformed privately provided security guards may be required in or around the premises by the Chief of Police if alcohol related problems recur that are not resolved by the licensed owner. 25. CONSULTATION AND TRAINING: At the discretion of the Chief of Police, periodic meetings will be conducted with representatives from the Police Department for on -going employee training on alcoholic beverage service to the general public. 26. TRAINING MANUAL: The restaurant operator shall use an employee training manual that addresses alcoholic beverage service consistent with the standards of the California Restaurant Association. 27. DESIGNATED DRIVER PROGRAM: The restaurant operator shall actively promote a designated driver program such as complimentary non - alcoholic beverages for designated drivers. 28. TOWN INDEMNITY: Applicants are notified that Town Code Section 1.10.115 requires that any applicant who receives a permit or entitlement from the Town shall defend, indemnify, and hold harmless the Town and its officials in any action brought by a third party to overturn, set aside, or void the permit or entitlement. This requirement is a condition of approval of all such permits and entitlements whether or not expressly set forth in the approval, and may be secured to the satisfaction of the Town Attorney. Building Division 17. PERMITS REQUIRED: A Building Permit shall be required for the any alterations to the existing commercial building. Separate permits are required for electrical, mechanical, and plumbing work as necessary. 18. CONDITIONS OF APPROVAL: The Conditions of Approval must be blue -lined in full on the cover sheet of the construction plans. A Compliance Memorandum shall be prepared and submitted with the building permit application detailing how the Conditions of Approval will be addressed. 19. SIZE OF PLANS: Four sets of construction plans, maximum size 24" x 36 ". 20. TITLE 24 ACCESSIBILITY — COMMERICAL: For any proposed tenant improvements, on -site parking and general path of travel shall comply with the latest California Title 24 Accessibility Standards. Work shall include, but not be limited to, accessibility to building entrances from parking facilities and sidewalks. The building shall be upgraded to comply the latest California Title 24 Accessibility Standards. Necessary work shall be first investigated by the design Architect and then confirmed by Town staff. 21. The amended Alcoholic Beverage Policy (ABP) was adopted by the Town Council in September 2001. The purpose of the ABP is to provide parameters for alcoholic beverage service and direction through a General Policy and a Specific Policy. Staff analyzed the proposed Conditional Use Permit (CUP) against the ABP. PROJECT DESCRIPTION: A. Conditional Use Permit The applicant is requesting approval to operate a wine bar. The applicant provided a business description (Exhibit 4), letter of justification (Exhibit 5), and development plans (Exhibit 6) describing the proposal. The service of food and alcoholic beverages requires a Conditional Use Permit. The Planning Commission shall make a recommendation to the Town Council, who will be the final deciding body pursuant to the ABP. Planning Commission Staff Report - Page 3 424 N. Santa Cruz Avenue, approximately 320 feet north of Los Gatos - Saratoga Road (Exhibit 1). The property is surrounded by commercial uses to the north, west, and south. To the east is a Town parking lot. 'Single family residential uses are located beyond the Town parking lot. C. Zoning Compliance The zoning designation allows food and beverage service subject to the approval of a Conditional Use Permit. ANALYSIS: Q LO Project Summary The applicant is requesting to operate a 990 square foot, 20 -seat wine bar. The wine bat would be open from 3 :00 p.m. to 10 :00 p.m. on Monday, 3:00 p.m. to 11 :00 p.m. Tuesday and Wednesday, and 3:00 p.m. to 12:00 a.m. Thursday through Saturday. Alcoholic beverage service will cease one hour prior to closure. The ABP requires specific findings for alcohol service after 10 :00 pm. The establishment would serve wine, beer, and tapas. The applicant provided a business description (Exhibit 4), letter of justification (Exhibit 5), and development plans (Exhibit 6) The letter of justification explains the proposal as a tapeo, "a centuries -old ritual that ... is as much (often more) about food and social interaction as it is about libations" (Exhibit 5). The proposed business will offer wine by- the - glass, beer on tap, and small plate food items known as tapas. The applicant included a sample menu in Exhibit 5. The applicant explains that the proposal would not operate as a traditional bar because the establishment: Would not serve or sell any hard liquor or mixed drinks, Would not be open past 12 :00 a.m., and, Alcohol beverage service would be accompanied with food service. Alcoholic Beverage Polite Purpose The requirements contained in the ABP are intended to protect nearby residential neighborhoods, while maintaining `the viability of our commercial centers.' The policy provides assurance that hours of operation will be regulated for a variety of reasons, Planning Commission Staff Report - Page 4 424 N, Santa Cr1iz AvenuelU -12 -004 May 23, 2012 including proximity to residential neighborhoods and concentration of alcoholic beverage serving establishments within one area, The site is located in an established shopping center that fronts on N. Santa Cruz Avenue. To the rear of the building is a Town public parking lot, On the opposite side of the parking lot is a residential neighborhood. The applicants are sensitive to the proximity of residential uses in that they have operated a similar business in the same shopping center, Enoteca La Storia at 416 N. Santa Cruz, without complaints from the nearby residences. The alcoholic beverage service will cease one hour prior to closing and they will close no later than 12,00 a.m. Additionally, the applicants have experience operating a similar business, Enoteca La Storia, without incident. General Policy The ABP'S General Policy contains eight requirements. Requirements 2 and 3 are not applicable to the subject application because there will be no entertainment. Requirement 8 is not applicable to the subject application because there will be no outdoor seating. Requirement No, 1 states `the Town shall continue to strongly discourage new applications for stand -alone bars or restaurants with separate bars.' Neither the ABP nor the Town Code provides a wine bar deiiiiitinn. The proposal does not fall into the definition of a bar in that the establishment would not serve or sell any hard liquor or mixed drinks, would not be open past 12:00 a.m., and, would offer a menu of food selections when alcohol beverage service is available. Requireiment No. 4 does not permit alcoholic beverage service after 11 :00 p.m. Sunday through Thursday, except for holidays and evenings before holidays, or after 1:00 a.m. Friday, Saturday, holidays, and evening, s before holidays. The applicant is proposing to end food and beverage service at 11:00 p.m, or earlier, depending an the day of the week. Requirement No. 5 states an establishment serving alcoholic beverages is subject to five provisions related to alcohol service. The provisions are included as conditions of approval Requirement No. 6 requires the deciding body to make specific findings to approve an application to serve alcoholic beverages after 10 :00 p,m. The applicant is proposing to serve alcoholic beverages after 10 :00 p.m. on Thursday, Friday, and Saturday. Requirement No. 7 defines a meal as `a combination of food items selected from menu.' The applicants provided a sample food service menu (Exhibit 5) and would offer food service when alcohol beverage service is available. Planning Commission Staff Report - Page 5 424 N. Santa Cruz Avenue/U -12 -004 May 23, 2012 Specific Policy The Specific Policy has two requirements that address alcoholic beverage service at restaurants. The first states "alcoholic beverages may only be served with meals," The business will provide food service from a menu. The second requirement states that "meal service shall be available until closing." The business will offer food and beverage service that will cease an hour before closing -- Monday at 9.00 pm, Tuesday and Wednesday at 10:00 pm, Thursday, Friday and Saturday at 11 :00 pm. While food is not proposed to be served during the final hour of operations, neither will alcoholic beverages. The intent of the Policy is to ensure that food will be served in conjunction with alcoholic beverages. In this case, neither food nor alcoholic beverages will be served during the final hour of operations; however, patrons will be allowed to finish their food and beverages. Staff believes that the proposal is consistent with the intent of the policy similar to other approved food and beverage establishments such as Enoteca La Storia and Rootstock Wine Bar. C. Parking The proposed use requires one parking space for every three seats for a total of seven parking spaces. Prior to a substantial remodel at the Los Gatos Shopping Center, a number of uses were deemed non - conforming because they did not meet the parking requirement. In 1996, the Town approved Ordinance 1996 -153 that would allow the non - conforming uses to purchase parking spaces in the North Side parking lot in order to come into compliance in terms of parking. The use would be allowed a maximum of nine seats if the applicant did not purchase any parking spaces. The applicants are willing to pay into the North Side parking lot for four parking spaces. As conditioned, the use would meet the parking requirement for 20 seats. D. Traffic The project would result in a net increase of 13.3 ADT (average daily trips) and a net increase of 2.9 PM peak trips. The project requires traffic impact fees which are required as a condition of approval. E. Conditional Use Permit Findings In order to grant approval of a Conditional Use Permit, the deciding body must make the following findings: (1) The proposed uses of the property are essential or desirable to the public convenience or welfare; and (2) The proposed uses will not impair the integrity and character of the zone; and Planning Commission Staff Report - Page b 424 N. Santa Cruz Avenue/U -12 -004 May 23, 2012 (3) The proposed uses would not be detrimental to public health, safety or general welfare; and (4) The `proposed uses of the property are in harmony with the various elements or objectives of the General Plan and the purposes of the Town Code. In regards to finding one, the use will provide food and beverage service to the community as well as bring- visitors, shoppers, and residents io a less - frequented area of North Santa Cruz Avenue. It, regards to the second* f nding, the use will not impair the integrity. of the zone since the use will be ;n a commercial zone. In regards to finding three, the use will not be detrimental to public health safety or general welfare because the use will be subject to provisions -of the Alcoholic Beverage Policy''and conditions placed on the, permit will mitigate- potential impacts. In regards to the final finding, the proposed use meets the objectives of the General Plan and Town Code as discussed within this report. F. General Plan The goals and policies of the 2020 General Plan listed below are applicable to this project. • Policy LU -2.1 — Minimize vehicle miles traveled for goods and services by allowing and encouraging stores that provide these goods within walking distance of neighborhoods in Los Gatos. • Policy LU -9.2 -- Maintain a variety of commercial uses, including a strong Downtown commercial area combined with Los Gatos Boulevard and strong neighborhood commercial centers to meet the shopping needs of residents and preserve the small - town atmosphere. • Policy LU -9.6 — Encourage development that maintains and expands resident - oriented services and /or creates employment opportunities for local residents consistent with overall land use policies of the Town. • Policy TRA -3.1— All development proposals shall be reviewed to identify and mitigate project traffic impacts pursuant to the Town's traffic impact policy. G. Environmental Review The project is Categorically Exempt according to Section 15301 of CEQA as adopted by the Town, which exempts permitting an existing facility involving negligible use beyond the existing use. ` No significant effect on the environment will occur since the project uses an existing structure with no increase in floor area. H. Redevelopment Plan for the Central Los Gatos Redevelopment Project Area The Redevelopment Plan contains a Redevelopment Land Use Map that designates proposed land uses to be permitted in the Central Los Gatos Redevelopment Project Area. Planning Commission Staff Report - Page 7 424 N. Santa Cruz Avenue/U -12 -004 May 23, 2012 The subject property is designated commercial and, per the Redevelopment Plan, shall be used for the general commercial uses set forth and described in the Town's General Plan. The proposed use falls under general commercial uses. PUBLIC COMMENTS: At this time, the Town has not received any public comment. SUMMARY AND RECOMMENDATION: A. Summary Staff recommends conditions of approval consistent with the applicant's proposed use regarding the number seats and operating hours. As conditioned, the site has adequate parking to accommodate the existing and proposed uses. The use would close by 12 :00 a.m. and would make food service available when alcoholic beverage service is available. Additionally, the applicants have experience operating a similar business in the same shopping center without incident. The discretionary privilege of alcohol service may be acceptable pursuant to the application proposal and associated conditions, B. Recommendation The Alcoholic Beverage Policy gives the hearing body discretion to approve alcoholic beverage service when the proposal will not negatively impact residential neighbors, alcohol related incidents will not occur, and when the application will provide a positive impact to the commercial area. Based on the evidence submitted by the applicants, staff believes this application fits such a case. If the Planning Commission finds merit with the proposed project, it should: 1. Find that the proposed project is categorically exempt, pursuant to Section 15301 of the California Environmental Quality Act as adopted by the Town (Exhibit 2); and 2. In Spain, one does not go out in search of more drinks (although beer and wine often accompany the eating). Rather, the "tapeo," or centuries -old ritual that continues unabated throughout Spain, is as much (often more) about food and social interaction as it is about libations. Every day at lunchtime and in the early evening after work, the tapas bars of Spain are full of people, young and old, who are gathered together, mostly standing, to have a nibble or a whole meal and to converse with friends or colleagues about the days events. Traditionally, tapas were a prelude to a main meal eaten later in the evening, similar to appetizers. Today, however, they are as likely to constitute the meal itself. The little dishes may seem small, but when several are consumed together, they can be very satisfying. Tapas can be almost anything, from a slice of air -cured jamon (ham) to elaborately prepared dishes involving seafood and meat. In other words, the tradition has more to do with HOW the food is served than with what is actually on the plate. Tapas might be Spain's greatest culinary legacy to the world. More and more of today's diners prefer to compose their meal from a selection of small plates versus just having one dish. The tapas tradition encourages camaraderie and social interaction. Tapas also underscores the European custom of always having food with drink. In Spain (and Italy) it is almost impossible to order an alcoholic beverage without some form of food (and lively conversation) accompanying it. EXHIOr 5 . Notion of Authenticity Because we are both of Italian, ancestry, Joe and I are very comfortable and familiar with the paradigm of an Italian wine bar. The concept we are proposing is very similar in form and function to our existing business. In other words, there is not much difference in the designing and operating of an Enoteca (Italian wine bar) and a Tapas Bar (Spanish wine bar). Yet, evert though we feel a certain kinship with the Spanish paradigm because of our common Latin roots, we understand that Spain, as.a different country from Italy, has its own unique customs, traditions and ingredients as a foundation of the culture. This being said, we intend to bring as much anthenticity to this project . as we did to. our Enoteca. Rather than simply reading books, scouring the Internet and visrtirig, other.existing sirriilar establishments to "get a feel" for the Spanish tradition and concepts, we have formed a strategic partnership with a local "expert" who was born, and raised in Spain, Jorge. Bianchi (see. attached Bio): Jorge currently resides in Los -Gatos and was born and raised in San Sebastian, Spain. He will utilize his personal: experience with and intimate knowledge of Spain, its culture as a whole, and his specific expertise with tapas bars (Spanish food and wine culture) to ensure that our establishment -is as. authentic to the 8paaush traditiori-as possible: biir.•- plan is that he will lead us on a.tour of his hometown of San Sebastian,, the culinary mecca df• Spain, where',some of the most acclaimed restaurants and tapas bars in the world are located. He is a professional chef who has experience working ,with some of the best restaurants in San Sebastian (Rekondo, Akelarre, Arzak, El Lagar, etc,). He is currently working in Copenhagen as a consultant to a group that is opening a tapas bar. We are currently in talks' with Agustin to come to Los Gatos and act as a consultant on our project. SPECIFIC ISSUES RELATED TO ALCOHOLIC BEVERAGE POLICY: d Our nearly two year track record without any negative incidents or impact demonstrates that, when well managed, a wine bar concept encourages responsible alcohol consumption and attendant behavior. ® Our experience has been that the wine bar concept, based on the European model, typically encourages guests to consume food in tandem with alcoholic beverage consumption. e The stated purpose of the policy is to avoid the potential to "jeopardize the public safety" which may "result in an increase of calls for police services." o As stated above, in almost 2 years of operating our wine bar, we have not had a SINGLE incident involving disruptive behavior, public drunkenness OR any incidents requiring security or local law enforcement intervention. o The policy "provides parameters for alcoholic beverage service, particularly addressing late night service when alcohol - related incidents are most likely to occur and when the disturbances to Town residents is least tolerable." Q The latest our food and beverage service will terminate on any given night will be j 11:00 PM (which will only be on Thursday, Friday and Saturday nights). Most ' nights it will terminate at 10:00 PM. We want to avoid staying open past midnight, which is when problematic disturbances tend to occur with higher frequency. i ® Our proposed use is not as a traditional "Bar." o The typical definition of a "Bar" is an establishment whose primary service /function is the service of alcoholic beverages, mainly hard liquor and mixed drinks, to be consumed ON- PREMISE, usually until late in the evening (closing at 2:00 AM) with little or no food offerings. ® We will not serve or sell any hard liquor or mixed drinks. ® We will not be open past 12:00 AM Any on- premise wine tasting selections will be accompanied by a menu of food selections.
