COUNCIL RECESS
RECOMMENDATION:
Accept report of actions taken by Town Manager during the official Town Council legislative recess
from July 1, 2012 to August 5, 2012.
BACI {GROUND:
On July 1, 2002, the Town Council adopted a resolution authorizing the Town Manager to execute the
following duties during periods of official Town Council recess, in consultation with the Mayor:
1. Approval of plans and specifications for capital projects and authorization to advertise for bids.
2. Award of construction contracts and construction contract change orders in excess of the amount
included in the contingency.
3. Execution of agreements and amendments to agreements in excess of $50,000 that ordinarily
require Council approval.
DISCUSSION:
The Town Council tools an official legislative recess from July 1, 2012 to August 5, 2012. During this
recess, and pursuant to authority granted by the Town Council, the Town Manager executed the
following actions, in consultation with the Mayor:
1. Annual Renewal of Agreement for Services with the Los Gatos Chamber of Commerce to
Manager the Town's Information Center and Coordinate the Leadership Los Gatos Program
Authorize the Town Manager to execute an agreement for services with the Los Gatos Chamber of
Commerce in an amount not to exceed $50,000.

a. Authorize the Town Manager to execute a construction contract with Intermountain Slurry Seal
Inc. in an amount not to exceed $1,427,500.
b. Authorize staff to execute future change orders to the construction contract as necessary in an
amount not to exceed $150,000.
3. PPW Job No. 10 -1.9.= University Avenue Resurfacing Project (Shelburne Way to Vasona Dam
811 -0006 - . -
a. Authorize the Town Manager to execute a construction contract with Duran & Venables Inc.
in an amount not to exceed $594,120.25.
b. Authorize staff to execute future change orders to the construction contract as necessary in an
amount not to exceed $50,000.
4. PPW Job No. 12 -01 — Pageant Grounds Phase 3 Improvements — Renovations 411- 8.3.1_ -1201
a. Authorize the Town Manager to execute a construction contract with Bearden Construction Co.
Inc. dba CB Concrete Construction, Inc. in an amount not to exceed $296,325.
b. Authorize staff to execute future change orders to the construction contract as necessary in an
amount not to exceed $30,000.
5. PPW Job No. 12 -01A — Pageant Grounds Phase 3 Improvements — Retaining Wall 411-831-1201
a. Authorize the Town Manager to execute a construction contract with Casey Construction Inc. in
an amount not to exceed $119,880.
b. Authorize staff to execute future change orders to the construction contract as necessary in an
amount not to exceed $20,000.
6. PPW Job. No. 11 -25 — Contractual Custodial Services for Town Facilities
Authorize the Town Manager to execute a First Amendment to the Agreement between the
Town of Los Gatos and Sunnyvale Building Maintenance in an amount not to exceed $5,336
for a three -month period.
In consultation with the Mayor, the Town Manager determined that immediate action on the above items
was necessary in order to avoid critical scheduling delay.
CONCLUSION:
It is recommended that the Town Council accept this report of actions taken by the Town Manager
during the Council recess, as authorized by Town Council Resolution July 1, 2002.
ENVIRONMENTAL ASSESSMENT:
Is not a project defined under CEQA, and no further action is required.
FISCAL IMPACT:
There is no fiscal impact associated with this action.
