ORDINANCE OF THE TOWN OF LOS GATOS
AMENDING THE TOWN CODE TO ADD AN
UNDERGROUND UTILITY TAX
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN, AS
FOLLOWS:
SECTION 1.
Section 15 ®76 of the Code of the Town of Los Gatos is amended
to read:
SEC. 15 -76 TAX RATES
The taxes imposed by this Article are:
(a) Capital Improvement Tax:
1. $.10 for each square foot of floor area of
building.
2. $.10 for each square foot of building addition
or alterations which increases the floor area
of an existing building.
(b) Underground Utility Tax:
1. $.30 for each square foot of building.
2. $.30 for each square foot of building addition
or alteration which increases the floor area of
an existing building.
SECTION 2.
Section 15 ®82 of the Code of the Town of Los Gatos is amended
to read:

SEC. 15 -82 USE OF REVENUES
Revenues derived from levy of the tax under the provisions
of this Article shall be used in the following manner:
(a) The tax collected pursuant to Section 15 -76(a) shall be
used only for acquiring land or constructing, renovating,
remodeling, furnishing or refurnishing capital improvements
or to pay the cost of enforcing this Article.
(b) The tax collected pursuant to Section 15 -76(b) shall be
used only for the conversion of existing overhead utility
lines to underground.
SECTION 3.
Section 32 -26(f) is added to the Code of the Town of Los Gatos
to read:
(f) Existing poles, overhead wires and associated overhead
structures required to be moved to accommodate street
improvements-
THIS ORDINANCE SHALL TAKE EFFECT and shall be in force thirty (30)
days after the date of its adoption. The Town Clerk of the Town of
Los Gatos shall cause this ordinance to be published once within
fifteen (15) days after its adoption, in the Los Gatos Times- Saratoga
Observer, a newspaper of general circulation, published and circulated
in the Town of Los Gatos.
The above and foregoing ordinance was duly and regularly introduced
at a regular meeting of the Town Council of the Town of Los
