ORDINANCE NO. 1323 <br />URGENCY ZONING ORDINANCE OF THE TOWN <br />OF LOS GATOS RESTRICTING THE <br />CONSTRUCTION AND LIGHTING OF TENNIS <br />COURTS <br />THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN: <br />SECTION 1. <br />Purpose. <br />The Zoning Ordinance of the Town does not now regulate the <br />location of tennis courts except in required front yards. Nor <br />does the Zoning Ordinance regulate the lighting of tennis courts. <br />As results of these facts tennis courts can be constructed in side <br />yards of corner lots where their fences can obstruct the view from <br />vehicles approaching intersections, and tennis court lighting can <br />be installed in locations that will annoy the occupants of neighboring <br />property. These matters are under study by the Planning Commission, <br />and ought to be subjected to interim regulation. <br />SECTION 2. <br />Tennis courts shall not be constructed in a required side yard <br />bordering a street. <br />SECTION 3. <br />Lighting for tennis courts shall not be installed without a <br />Conditional Use Permit. <br />SECTION 4. <br />This ordinance is an urgency ordinance and is for the protection <br />of the public safety, health and welfare. This ordinance takes <br />effect immediately and, in accordance with Government Code section <br />-1- <br />
