ORDINANCE NO. 1716 <br />AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING <br />THE ZONING ORDINANCE RELATING TO SECONDARY DWELLING UNITS <br />THE TOWN COUNCIL ORDAINS: <br />SECTION I. <br />SECTION 2.00.397 is amended to read: <br />SEC. 2.00.397: PRIMARY DWELLING UNIT <br />A primary dwelling unit is a single family dwelling unit located on a lot <br />with no other dwellings on the lot except for secondary dwelling units. <br />SECTION II. <br />SECTION 3.50.050(1) of the Zoning Ordinance is amended to read: <br />SEC. 3.50.050: <br />DURATION OF NONCONFORMING USE STATUS <br />(1) The following uses are allowed to continue interminably: <br />(a) Nonconforming residential uses (except nonconforming secondary <br />dwelling units pursuant to Section 3.98 of this ordinance). <br />(b) Schools. <br />(c) Church uses. <br />(d) Nonresidential uses in the downtown which would otherwise be <br />nonconforming due to zone changes and ordinance amendments which <br />occurred after July 1, 1982. <br />SECTION III. <br />SECTION 3.95.010 of the Zoning Ordinance is amended to read: <br />S EC. 3.95.010: INTENT <br />Chapters 3.95, 3.96, 3.97 and 3.98 are adopted to fulfill the <br />requirements of the Housing Element for regulating secondary dwelling units. <br />
