Ord 1606 - Amending the Zoning Ordinance Concerning Floor Area RatioORDINANCE NO. 1606 ORDINANCE AMENDING THE ZONING ORDINANCE OF THE TOWN OF LOS GATOS CONCERNING FLOOR AREA RATIO The Town Council of Los Gatos hereby ORDAINS: SECTION 1. Section 2.00.212 is added to the Zoning Ordinance of the Town of Los Gatos to read: SEC. 2.00.212 FLOOR AREA RATIO (FAR The gross floor area of a building or buildings on a zoning plot divided by the area of such zoning plot. SECTION 2. Section 3.50.060 of the Town Code is amended to read: SEC. 3.50.060: DURATION OF NONCONFORMING BUILDING STATUS A nonconforming office, commercial or industrial building located in a residential zone must, by demol- ition, removal or alteration, be made to conform with the rules of the zone when the building is older than shown on the following schedule: (1) U.B.C. Type 4 or 5 buildings: 25 years (2) U.B.C. Type 2 or 3 buildings: 40 years (3) U.B.C. Type 1 buildings: 50 years When any of the foregoing time periods have elapsed, the building in question no longer has status as a non- conforming building. However, when a nonconforming building houses a nonconforming use, the building need not be made to conform until the nonconforming use ceases as provided in section 3.50.040, or expires as provided in section 3.50.050, whichever happens first. Buildings that become nonconforming only as a result of the adoption of floor area ratio shall be exempt from the provisions of this section. SECTION 3. Section 4.56.080 of the Town Code is amended to read: SEC. 4.56.080 MAXIMUM FLOOR AREA RATIO The floor area ratio for all new buildings or expansion of gross floor area of an existing building shall not exceed .60. In the event a building or buildings which exceed a FAR of .60 within the C -2 zone are destroyed involuntarily, recon- struction to the amount of the prior floor area shall be allowed, subject to all other provisions of this ordinance. SECTION 4. This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted, the Town Clerk shall cause it to be published once in a newspaper of general circulation publish and circulated in the Town. This ordinance was introduced at a regulat meeting of the Town Council of the Town of Los Gatos on January 17, 1984, and adopted by the following vote as an ordinance of the Town of Los Gatos at a regular meeting of the Town Council on February 6, 1984.
