ORDINANCE 1817 <br />ORDINANCE OF THE TOWN OF LOS GATOS AMENDING CHAPTER 13 <br />RELATING TO THE FEE FOR LARGE SCALE TREE PLANTING <br />THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY ORDAIN: <br />SECTION I <br />Section 31 -10 of Chapter 31 of the Town Code of the Town of Los Gatos is hereby amended to <br />read as follows: <br />Section 31 -10. Large scale planting. <br />(a) The park superintendent shall require the planting of street trees within the parkway of <br />any new subdivision in conformity with this section. <br />(b) The park superintendent shall plant and maintain such trees at such times and places <br />as the development of the subdivision, its occupancy and other conditions make feasible. <br />(c) The applicant shall be required to pay to the Town a fee in accordance with the Town's <br />fee resolution for the purchase, planting and maintenance of the specified number of street trees <br />as determined by using criteria set up in this section. <br />(d) An applicant shall be required to submit to the park superintendent, upon his tentative <br />subdivision map, a tentative planting plan, in duplicate, which shall accurately show the following: <br />(1) The proposed street, together with its subdivision of pavement, curb, gutter, <br />parking strip and sidewalk areas to a definite indicated scale. <br />(2) The variety of each tree, as specified by the park superintendent, to be planted, <br />and of those already existing within the proposed street lines, either indicated on the plans or <br />referenced with a number to a key list. <br />(3) The proposed location of each and every proposed tree, together with the location <br />of each existing tree within the proposed street line, and the location of all existing trees with <br />a trunk diameter of six inches or more within the balance of the subdivision, in scaled relation <br />to the other features of the plan. <br />(4) The distance between trees shall allow for a minimum of one tree per interior <br />lot with a frontage of seventy -five feet or less, or a minimum of two trees be provided for a <br />corner lot. Selection of a small tree variety may require more trees per lot than the minimum <br />stated above, and this number shall be determined at the discretion of the park superintendent. <br />Street tree plantings in areas other than residential shall be as specified by the park <br />superintendent, but minimum distances between trees shall be forty to fifty feet. <br />
