ORDINANCE 2109 <br />AN ORDINANCE OF THE TOWN OF LOS GATOS APPROVING <br />THE NEW FLOODPLAIN MANAGEMENT STANDARDS, REPEALING <br />ORDINANCE NO. 1763 AND AMENDING ARTICLE IX OF <br />CHAPTER 29 OF THE TOWN CODE <br />RECITALS <br />A. On October 3, 1988, the Town Council of the Town of Los Gatos adopted Ordinance No. <br />88 -1763 for purposes of setting standards for Floodplain Management to promote the public health, safety <br />and general welfare, and to minimize public and private losses due to flood conditions in specific areas. <br />B. The provisions of Ordinance No. 88 -1763, which had not been amended since their adoption, <br />are codified at Article IX of Chapter 29 of the Los Gatos Town Code. <br />C. New Floodplain Management standards in the form of a model ordinance have been <br />established and are recommended by the State Floodplain Administrator of the Division of Flood <br />Management (latest revision dated December, 2001). <br />D. Local adoption of the recommended new Floodplain Management Standards is necessary <br />in order to comply with requirements of the National Flood Insurance Program ( "NFIP "), which is managed <br />by the State Department of Water Resources ( "DWR ") for the Federal Emergency Management Agency <br />( "FEMA ") <br />E. The Town Council of the Town of Los Gatos desires to amend its applicable Floodplain <br />Management standards in order to promote the public health, safety and general welfare, and to minimize <br />public and private losses due to flood conditions in specific areas. <br />THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDAINS: <br />SECTION I <br />Ordinance No. 88 -1763 is hereby repealed. <br />1 <br />
