ADOPT RESOLUTION APPROVING FINAL MAP FOR TRACT NO. 9537 -
CORNERSTONE AT LOS GATOS (300 CALLE MARGUERITA) AND
ACCEPTING THE DEDICATIONS.
RECOMMENDATION:
Adopt resolution approving the Final Map for Tract No. 9537 -Cornerstone at Los Gatos (300 Calle
Marguerita) and accepting the dedications.
BACKGROUND:
In 2002, the original developer of the project at 300 Calle Marguerita, HL & L 99, LLC, requested
approval of an eight (8) lot subdivision. On June, 16, 2002, the Town Council approved the Planned
Development (PD-99-0002) by Ordinance 2099. On May 28, 2003, the Planning Commission
approved the Tentative Map (M -02-0012). The property was then purchased by a new owner,
Cornerstone of Los Gatos, LLC, who submitted the final map and on-site improvement plans for
review December 2, 2004. Section 66452.6(d) of the California Govermnent Code states, "Once a
timely filing is made, subsequent actions of the local agency, including, but not limited to,
processing, approving, and recording, may lawfully occur after the date of expiration of the tentative
map. Delivery to the county surveyor or city engineer shall be deemed a timely filing for purposes
of this section."
The Town Council approved the Final Map for Tract No. 9537 on October 17, 2005. The map was
not recorded by the developer at that time and has been subsequently lost. The current owner of the
property, 300 Calle Marguerita Investments, LLC, has completed the project and the units are now
ready for sale. The Final Map has been updated with the current owner information on the signature
page and has been resubmitted for Council approval and subsequent recording.

DISCUSSION:
Tract No. 9537 will create eight (8) lots for a townhouse subdivision. The developer, 300 Calle
Marguerita Investments, LLC has provided all necessary maps and drawings. The developer has
paid the appropriate fees and done the off-site work necessary to comply with the previously-
imposed development conditions and Town ordinances. The developer has installed all required
improvements and thus no contract and bonds are required.
ENVIRONMENTAL ASSESSMENT:
This activity is a project as defined under the California Environmental Quality Act (CEQA) but is
ministerial, therefore no further action is required under CEQA.
CONCLUSION:
Staff is recommending approval of the Final Map for Tract 9537.
FISCAL IMPACT:
The previous developers, Cornerstone of Los Gatos, LLC ,paid the following fees:
1. Tract Map Checking fee ................................... $4,500.00 (paid 12/1/04)
2. Engineering Permit Tracking fee ...................... 180.00 (paid 12/1/04)
3. Encroachment Permit fee .................................. 292.00 (paid 2/23/05)
The current developers, 300 Calle Marguerita Investments, LLC, also paid the following fees:
1. Tract Map Re-checking fee ................................. $6,750.00 (paid 6/30/09)
Additionally, at the time of occupancy of each home, traffic impact mitigation fees will be due.

RESOLUTION
RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
APPROVING FINAL MAP OF TRACT NO. 9537
AND ACCEPTING THE DEDICATIONS
WHEREAS, on May 28, 2003, the Planning Commission of the Town of Los Gatos
approved the Tentative Map Application M -02-0012, with conditions; and
WHEREAS, the Owner or Subdivider has complied with the conditions of Tentative
Map Application M -02-0012.
NOW, THEREFORE, BE IT RESOLVED that the certain Final Map of Tract No.
9537 in the Town of Los Gatos, dated August 2009, and prepared by Westfall Engineers for
approval by the Town Engineer of the Town of Los Gatos, is hereby approved; and all offers of
land for public use therein made on said Map are hereby accepted.
PASSED AND ADOPTED at a regular meeting of the Town Council held on the 16u'
day of November, 2009 by the following vote:
