INDEBTEDNESSES OF SAID TOWN FOR THE ACQUISITION, CON- STRUCTION AND COMPLETION OF CERTAIN MUNICIPAL IMPROVE- MENTS CONSTITUTING A CITY PLAN,.AND THE ACQUISITION, CONSTRUCTION AND COMPLETION OF CERTAIN OTHER MUNICIPAL IMPROVEMENTS; DECLARING THE ESTIMATED COSTS OF EACH OF 6i SAID IMPROVEMENTS, THE AMOUNTS OF THE PRINCIPAL OF EACH OF SAID INDEBTEDNESSES TO BE INCURRED TF=1. FOR., : AND THE MAXIMUM RATE OF INTEREST TO BE PAID THEREON; FIXING THE DATE OF SAID ELECTION, THE MANNER OF HOLDING THE SAME AND PROVIDING FOR NOTICE THEREOF. i! The Council of the Town of Los Gatos does ordain as k follows: WHEREAS, the Planning. Commission of the Town of Los Gatos ,I by Resolution duly adopted at a meeting of said Commission held on March 7,`1962, approved a group of municipal improvements as constituting a city plan; WHEREAS, a copy of said Resolution of the Planning Com- mission of the Town of Los Gatos, duly certified by the Secre- tary thereof, has been transmitted to and received by the Council: of the Town of Los Gatos and is now on file and of record in the ' office of the Clerk of said Town; WHEREAS, the Council of the Town of Los Gatos at a regular's ap- meeting thereof duly held on the 5th day of March, 1962, proved said group of municipal improvements as constituting a 1i city plan; WHEREAS, the Council of the Town of Los Gatos by Reso- lution No. 1962-3,7 passed and adopted at a meeting of said Council on March 12, 1962, by the affirmative vote of more than s, two thirds of all of its members, did determine that the public interest and necessity demanded the acquisition, construction s, , and completion of the municipal improvements as constituting a city plan and the other municipal improvements hereinafter men- tioned, that all of said municipal improvements are necessary and convenient.to carry out the objects, purposes and powers of the Town, that the costs of said proposed municipal improvements will be too great to be paid out of the ordinary annual income and revenues of said Town and that said indebtednesses, and each of them, will require an expenditure of funds greater than the amount allowed for it by the annual tax levy of said Town; 'NOW, THEREFORE, IT IS ORDERED, as follows: 1. A special municipal election is hereby called and ordered and will be held in the Town of Los Gatos on Tuesday, the 29th day of May, 1962, at which election shall be submitted to the qualified electors of said Town the question of incurring bonded indebtednesses by said Town for the objects and purposes set forth in the following propositions, to wit: PROPOSITION NO. 1 Shall the Town of Los Gatos incur City Plan a bonded indebtedness in the principal amount of Eight Hundred Eighty-Eight Thousand Dollars, ($888,000) in accordance with the provisions of the ordinance calling the election at which this proposition is submitted for the acquisition, construction and completion of the following municipal improvements constituting a city plan, to wit: the ac- quisition, construction and completion of a Civic Center on the existing Town Hall site and on additional property to be acquired adjacent thereto, including a Town Hall and Library, and the acquisition of real property and all acquisitions and incidental work necessary therefor? PROPOSITION NO..2 Shall the Town of Los Gatos incur Fire Protection a bonded indebtedness in the principal amount of Two Hundred Seven Thousand Dollars ($207,000) in accordance with the provisions of the ordinance calling the election at which this proposition is submitted for the object and purpose .of the acquisition, construction and completion of a Headquarters Fire Station in the vicinity of Saratoga Avenue and University Avenue, including a fire house and equipment, furnishings, furniture and apparatus therefor; and the acquisition, construction and completion of Fire Station No. 3 in the vicinity of Santa Clara-Los Gatos Road and the proposed westerly extension of Lark Avenue, including a fire house and equipment, furniture, furnish- ings and apparatus therefor; and the acquisition of lands and easements and all acquisitions and incidental work necessary to complete both the Headquarters Fire Station and Fire Station No. 3? 2 PROPOSITION NO. 3 Shall the Town of Los Gatos incur Town Center Plaza) a bonded indebtedness in the. principal amount of One Hundred ,Twenty-Five Thousand Dollars ($125,000) in accordance with the provisions of the Ordinance calling the election at which this proposition is submitted for the object and purpose of the acquisition, construction and completion of a Town Center Plaza by acquiring real property bounded northerly by West Main Street, easterly by Montebellow Way, southerly by the easterly extension of Broadway, and wester- ly by Santa Cruz Avenue, and the improving thereof as a Town Center Plaza, including grading, removing existing structures and vegetation, planting, construction of buildings, and all acquisitions and incidental work neces- sary therefor? 2. The estimated cost of the municipal improvements set forth in each proposition and the amount of the indebtedness to be incurred therefor, incidental to or.connected with the authori- zation, issuance and sale'of,the bonds, including legal and other fees, costs of printing the bonds and other costs and expenses incidental to or connected with the issuance and sale of the bonds therefor is as follows: Proposition No. 1 $888,000 Proposition No.,.2 $207,000 Proposition No. 3 $125,000 3. Said Council does hereby submit to the qualified elec- tors of said Town of Los Gatos at said special municipal election, this Ordinance and the propositions set forth in Section l here- of'. The said Council proposes to issue and sell bonds of said Town in the amount and for the objects and purposes specified in said propositions, or any of them, if two thirds of the qualified electors voting'on each of. such propositions, at said special municipal election, shall vote in favor thereof. 4. If two thirds of the qualified electors voting on any of said propositions shall vote in favor thereof, said proposition shall be deemed adopted. Said bonds shall be negotiable in form and of the character known as serial, and shall bear interest at a rate not.exceeding six per cent (6/) per annum, payable semi- annually except the first year after the date of the bonds which: 3 S may be made payable at the end of said year. e " r 5. Said special municipal election shall be held and conducted and the votes thereof canvassed, and the returns there- of made, and the results thereof ascertained and determined as herein provided; and in all particulars not prescribed by this Ordinance, said election shall be held as provided by law for the holding of municipal elections in said Town. 6. For the purpose of holding and conducting said special municipal election there shall be six (6) precincts consisting of consolidations of Santa Clara County election precincts as last established by the Board of Supervisors of the County of Santa Clara for the conduct of State and County elections. Their descriptions, the polling places designated therefor and the election officers to conduct said election are as follows: Consolidated Precinct "A", comprising State and County precincts designated as Precinct Numbers 3754 through 3758, in- elusive, as established by the Santa. All persons qualified to vote at municipal elections, in said Town.upon the date of the election herein provided for shall be qualified to vote upon the propositions submitted at said special municipal election. 8. Ballots for said election shall be provided of the form and to the number provided by law. on said ballots, in addition to any other printed matter which may be required by law, two voting squares shall be set off to the right of each of said propositions` submitted at said election, in the manner provided by law, one having the word "Yes" printed before it and the other having the word "No" printed before it. 9. Each voter may vote on each of the propositions here- by-submitted. Each voter, to vote for a proposition, and for 6 incurring the bonded indebtedness thereof, shall stamp a cross in the blank space opposite the word "Yes" on the ballot to the right of said proposition, and to vote against a proposition and against incurring.the indebtedness thereof shall stamp a cross in the blank space opposite the word "No" on the ballot to the right of said proposition. 10. The polls shall be opened at 7:00 o'clock A.M. of said day and shall be kept open until 7:00 o'clock P.M. of said day when the polls shall be closed, except as to voters in line as provided in Section 14486 of.the Elections Code. 11. The Town Clerk is hereby authorized and directed to procure supplies necessary for the proper conduct of said election. 12. This ordinance shall be published once a week for two.successive weeks in the Los Gatos Times-Saratoga observer, .a newspaper of general circulation, printed,,and published less than six (6) days a week.in said Town, and such publication shall constitute notice of said election. No other notice of the election hereby called need be given. 13. This Ordinance, being an ordinance calling and order- ing an election, shall take effect.immediately upon its adoption.
