PUBLIC COMMENTS TO THE LOS GATOS TOWN COUNCIL
RE 11 PERAL TA PROJECT
My wife Donna and I have two major "substantive" concerns (described below)
with the 11 Peralta proposed renovation AND, suddenly, four major "procedural" issues
of the Applicant's making which have now arisen at the conclusion of AND after the
February 13, 2019 Hearing before the Planning Commission.
We believe all four procedural issues, EACH and independently of one another,
now require a remand to the Planning Commission for it to be allowed to consider these
new facts and new Applicant conditions the Planning Commission has never had a
chance to review or pass upon.
PROCEDURAL ISSUE #1: Mr. Jeans, representing the 11 Peralta Applicant at the
Planning Commission ("PC"), introduced a surprise Exhibit at the PC Hearing without
forewarning to either me or the PC. Because the Commission Chair was immediately
wary and suspicious of the Exhibit, the Chair and another Commissioner closely
questioned Mr. Jeans about the Exhibit.
The Exhibit Mr. Jeans introduced sought to dispel concern for the privacy issues
Donna and I had raised to the Planning Commission. It was a graphic drawing-not
showing scale-which purported to be a replica of a smaller drawing on a comer of the
Plans for 11 Peralta (but was not in fact) showing sight-lines from 11 Peralta into the
back yard of 9 Peralta. Under questioning, Mr. Jeans then falsely informed the PC about
the basic facts of his hand drawn graphic, especially as to the height of certain privacy
trees he had drawn into the new surprise Exhibit the center of the privacy debate. This
false graphic proved to be so compelling, one could feel the tidal shift of opinion in the
Hearing room. Indeed, the Chair asked that the Exhibit be marked for the record (it was
not in the record because it was a surprise last-minute Exhibit) because the
Commission wanted to rely upon it.
Post-Hearing on-site research at 9 Peralta and a careful review of the surprise
drawing show Mr. Jeans' statement of the facts pertaining to his surprise Exhibit
drawing to be fabricated and not in fact representative of the true facts as Mr. Jeans
confidently related those purported "facts" about his drawing to The Planning
