Main Street Los Gatos, CA 95030 ● 408-354-6832 www.losgatosca.gov TOWN OF LOS GATOS COUNCIL AGENDA REPORT MEETING DATE: 10/02/2018 ITEM NO: 1 DRAFT MINUTES OF THE TOWN COUNCIL MEETING SEPTEMBER 18, 2018 The Town Council of the Town of Los Gatos conducted a Regular Meeting on Tuesday, September 18, 2018, at 7:00 p.m. MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Rob Rennie, Vice Mayor Steve Leonardis, Council Member Marcia Jensen, Council Member Marico Sayoc, Council Member Barbara Spector. Absent: None PLEDGE OF ALLEGIANCE Toren Hoffman led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Rennie presented a Small Business, Big Applause commendation to Manaz. Manaz Tankamani thanked the Town for their support. COUNCIL/TOWN MANAGER REPORTS Council Matters - Council Member Spector stated she attended the Conceptual Development Advisory Committee (CDAC) meeting. - Council Member Sayoc stated she had several community meetings with individual homeowners. - Mayor Rennie stated he and the Town Manager met with the Chamber of Commerce Executive Director and Town Manager; he attended the Valley Transportation Authority (VTA) Board meeting as an alternate, the VTA Policy Advisory Committee (PAC) meeting, the Silicon Valley Clean Energy Authority (SVCEA) Risk Oversight Committee meeting, the SVCEA Board meeting, the Cities Association Board meeting, the US Mayors Conference Alliance for Sustainable Future, the Holy Cross Lutheran Church 60th Anniversary, the Los Gatos-Monte Sereno Police Foundation fundraiser; he performed a ribbon cuttings for the grand re-opening of Office Depot and a ribbon cutting for Redemption ; and he did an interview with KMOV radio. - Vice Mayor Leonardis stated he attended the West Valley Sanitation District (WVSD) Board of Directors meeting, the West Valley Solid Waste Management Authority meeting, and the West Valley Clean Water Authority Program meeting. - Council Member Jensen stated she attended the CDAC meeting. PAGE 2 OF 5 SUBJECT: DRAFT MINUTES OF THE TOWN COUNCIL MEETING OF SEPTEMBER 18, 2018 SEPTEMBER 19, 2018 Manager Matters - Announced the new art exhibit in the Council Chambers is from the patients at El Camino Hospital (Los Gatos) and the reception is Thursday, September 20, at 6 p.m. - Announced Screen on the Green will show “Hotel Transylvania” on September 28 in Oak Meadow Park at 6:00 p.m. - Announced the Town Council and Planning Commission Joint Study Session on October 1, 2018 to kick off the General Plan update. - Announced the annual recruitment for adult Commissioners has begun, and the deadline to apply is October 26, 2018, 5:00 p.m. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Closed Session minutes of September 4, 2018. 2. Approve Council minutes of September 4, 2018. 3. Adopt a resolution rescinding Resolution 2016-047 and adopting the amended appendices to the Town's Conflict of Interest Code, Chapter 2, Article III, Division 4. RESOLUTION 2018- 045 4. Project 813-0227 Traffic Signal Modernization Project A. Accept a Vehicle Registration Fee (VRF) grant from the Valley Transportation Authority (VTA) to upgrade traffic signals Townwide. B. Authorize the Town Manager to execute all future grant documents and agreements with VTA. 5. Adopt a resolution approving the final map for Tract Number 10441 (North 40 Phase 1), accepting the dedications, and authorizing the Town Manager to negotiate and execute the Subdivision Improvement Agreement, the Landscape Maintenance Agreement, the Grant of Public Storm Drainage Conveyance Easement Agreement, and the Agreement for Private Improvements in the Public Right of Way. RESOLUTION 2018-046 6. Inform the Cities Association Board of Directors that the Town of Los Gatos will not be participating in the proposed Airport Roundtable. 7. Adopt an Ordinance of the Town of Los Gatos amending Chapter 4 of the Los Gatos Town Code entitled Animals and Fowl. Consent Item #7 pulled. MOTION: Motion by Council Member Jensen to approve Consent Items 1 through 6. Seconded by Council Member Sayoc. VOTE: Motion passed unanimously. VERBAL COMMUNICATIONS Carl Guardino - Announced the Applied Materials Silicon Valley Turkey Trot on Thanksgiving morning. PAGE 3 OF 5 SUBJECT: DRAFT MINUTES OF THE TOWN COUNCIL MEETING OF SEPTEMBER 18, 2018 SEPTEMBER 19, 2018 Verbal Communications – continued Catherine Somers, Los Gatos Chamber of Commerce Executive Director - Announced the Eat, Drink, Los Gatos event on September 22 and requested unlimited parking passes for the volunteers and workers for the event. MOTION: Motion by Council Member Sayoc to place the timed parking issue on a future agenda. Seconded by Council Member Jensen. VOTE: Motion passed unanimously. Lee Quintana, representing Democracy Tent - Announced that Democracy Tent is hosting two candidate forums at the Youth Recreation Center, 208 E. Main Street. The first forum is for Town Council Candidates on September 26, 7:00 to 9:15 p.m. and the second for the Los Gatos-Saratoga High School Board Member candidates, on October 11, from 7:00-9:00 p.m. Terry Dureya - Commented on the time it takes to download a Council agenda packet and suggested the packet be provided as one document so the public does not need to download each item separately. Pulled Consent Item #7 7. Adopt an Ordinance of the Town of Los Gatos amending Chapter 4 of the Los Gatos Town Code entitled Animals and Fowl. ORDINANCE 2276 Lynne Lampros, Deputy Town Attorney, presented the staff report. Opened Public Comment. Sylvia Carrillo - Commented in favor of the ordinance. Denise Uriarte - Requested some language changes be incorporated into the ordinance before it is passed. Diana Grubbs - Provided sample language changes to Section 4.10.085(e) 4 and to eliminate the reference to TNR (Trap, Neuter, and Return) groups. Closed Public Comment. MOTION: Motion by Council Member Jensen to adopt the ordinance as introduced at the September 4, 2018 meeting. Seconded by Vice Mayor Leonardis. VOTE: Motion passed unanimously. OTHER BUSINESS 8. School Bus Pilot Program Service Implementation A. Approve the School Bus Pilot Program Implementation Plan (Attachment 1). B. Authorize the Town Manager to negotiate and execute an agreement for student transportation services with Santa Barbara Transportation Corporation doing business as Student Transportation of America (STA), a California Corporation, in an amount not to exceed $328,189 in Fiscal Years 2018/19 and 2019/20 (Attachment 2). C. Authorize expenditure budget adjustments in the FY 2018/19 Pilot School Busing Program (812-0128) to advance funding from Fiscal Years 2019/20 and 2021/22 in the amount of $411,090 and authorize decrease in fare and grant revenue by a three year total of $220,590 ($33,090 in FY 2018/19, $64,500 in FY 2019/20, and $123,000 in FY 2020/21). Ying Smith, Transportation and Mobility Manager, presented the staff report. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Spector to approve the staff recommendation contained in the staff report. Seconded by Council Member Sayoc. VOTE: Motion passed unanimously. 9. Review and discuss the Town’s preliminary total operating cash position as of June 30, 2018. Steve Conway, Finance Director, presented the staff report. Opened and closed Public Comment.
