ORDINANCE OF THE TOWN OF LOS GATOS
CONCERNING EMPLOYMENT OF PERSONS
WITH CRIMINAL RECORDS
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN:
SECTION 1.
Sections 21 -12.5 and 21-12.6 are added to the Town Code, to
read:
SEC. 21 -12.5 CRIMINAL CONDUCT
Criminal histories shall be considered in determining
whether prospective employees are likely to perform suitably
in Town employment. A history of violent acts or crime
involving moral turpitude may disqualify an applicant for
Town employment or an employee from continuing employment.
However, in each instance the appointing officer shall
consider (1) whether the nature of the offense or offenses
is such as to indicate that the prospective employee would
not perform his job properly, or would reflect discredit on
the Town, (2) mitigating facts, (3) the passage of time since
the misconduct and (4) any other evidence of rehabilitation.
SEC_ 21 -12.6. CRIMINAL RECORD
The Town Manager, Attorney and Chief of Police are
authorized to obtain criminal records for use by the Town
Manager in making pre - employment and termination decisions.
SECTION 2.
This ordinance takes effect 30 days after the date it is adopted.
Within 15 days after this ordinance is adopted the Town Clerk shall

cause it to be published once in a, newspaper of general circulation
published and circulated in the Town.
This ordinance was introduced at a regular meeting of the Town
Council of the Town of Los Gatos on April 3rd , 1978,
and adopted by the following vote as an ordinance of the Town of
Los Gatos at a regular meeting of the Town Council on April 17th ,
1978.
