ORDINANCE OF THE TOWN OF LOS GATOS AMENDING
THE TOWN CODE CONCERNING DRAINAGE AND STREET
TREE FEES
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS
FOLLOWS:
SECTION 1.
Sections 27 -27 and 27 -28 of the Town Code of the Town of
Los Gatos are repealed.

Section 27 -87 of the Code of the Town of Los Gatos is amended
to read as follows:
SECTION 27 -87. FEES FOR CONSTRUCTION OF FACILITIES SERVING
NEW BUILDINGS, IMPEO VEMENTS AND PLANNED
STRUCTURES -- SCHEDULE.
There is hereby established the following schedule of
fees to be used for construction of drainage facilities serving
new buildings, improvements (including but not limited to paving)
or structures to be constructed in Local Drainage Areas No. I.
No. II and No. III, which, as determined by the engineer, sub-
stantially impair the perviousness of the surface of land.
(a) For single- family residences and buildings,
structures and improvements appurtenant thereto;
(1) In areas which are subdivided pursuant to
the terms of the Subdivision Map Act or local ordinance
supplementary thereto:
a. For single- family residences, buildings,
structures and improvements appurtenant thereto
located within the "Hillside Subdivision. Area"
as described in Exhibit B of Ordinance 715 of the
Town, the fee shall be computed at the rate of one
thousand two hundred fifty dollars per acre.
b. For single- family residences, buildings,
structures and improvements appurtenant thereto
located in all other areas, the fee shall be computed
at the rate of fifteen hundred dollars per acre.
c. The maximum drainage fee charged residential
lots which are in excess of one acre in area shall be

one thousand two hundred fifty dollars per lot in the
"Hillside Subdivision Area" and fifteen hundred dollars
per lot in all other areas until division of such lot
into additional building sites, at which time an
additional drainage fee shall be paid in an amount
equivalent to that prescribed by subparagraph a. or b.
above for each additional building site created.
(2) In areas not subdivided pursuant to the terms
of the Subdivision Map Act or local ordinance supplemental
thereto, the schedule of fees shall be as set forth in
subsection a. above; provided, that the net lot size shall
be computed on the basis of a plot plan approved by the Town
Engineer.
(b) For multiple - dwelling units, whether in the form of
numerous single- living units, duplexes, triplexes, quadruplexes
or apartment houses, and buildings, structures or improvements
appurtenant thereto, included within the gross site development
plan or lot of such dwelling, a fee at the rate of fifteen hundred
dollars per acre for land appurtenant to such buildings, structures
or improvements within the gross site development plan or lot, plus
a fee of fifty dollars for each living unit in excess of two
provided, that the total amount of such fee shall not exceed the
fee for commercial or industrial buildings; and further provided,
that the minimum fee shall be two hundred dollars.
(c) For commercial or industrial buildings, hospitals,
churches, schools and buildings, structures or improvements
appurtenant thereto, included within the gross site development
plan or lot, a fee at the rate of eighteen hundred dollars per
acre for land appurtenant to such buildings, structures or

improvements within the gross site development plan or lot;
provided that the minimum fee shall be two hundred dollars, except
for additions to buildings, structures or improvements used or to
be used for commercial or industrial purposes, for which the fee
shall be computed at the rate of eighteen hundred dollars per
acre to the extent of the addition and the land appurtenant
thereto; and except, that any fee determined under this section
to be less than five dollars may be waived.
(d) For all other types of buildings, structures, or
improvements including all accessory structures or improvements
appurtenant thereto, a fee at the rate of eighteen hundred
dollars per acre for land appurtenant to the buildings, structures
or improvements within the gross site development plan or lot;
provided, that fees determined to be less than five dollars may
be waived.
Upon application for a building permit, or filing of a
tentative subdivision map, record of survey map, or parcel map,
the applicant shall certify to the number of square feet in each
lot.
SECTION 3.
Subsection (c) of Section 31 -10 of the Code of the Town of Los Gatos
is amended to read:
SECTION 31 -10. SAME -- LARGE SCALE PLANTING
(c) The applicant shall be required to deposit an amount of
seventy cents per lineal foot of front roadway (as
designated on tract map) with the Town for the purchase,
planting and maintenance of the specified number of street
trees as determined by using criteria set up in this
section.

THIS ORDINANCE shall take effect and shall be in force thirty
days after the date of its adoption. The Town Clerk of the Town of
Los Gatos shall cause this ordinance to be published once within
fifteen days after its adoption, in the Los Gatos Times- Saratoga
Observer, a newspaper of general circulation, published and circulated
in the Town of Los Gatos.

California, at a r meeting of the Town Council, held on the
5th day of June , 1978, by the following vote:
