ADOPT A RESOLUTION AUTHORIZING THE TRANSFER OF COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS AND RELATED BUDGET ADJUSTMENTS RECOMMENDATION: Adopt a resolution authorizing the transfer of Community Development Block Grant (CDBG) funds and related budget adjustments (Attachment 1). BACKGROUND: The Town has participated in the Santa Clara Urban County CDBG Program since 1975. Through this program, the Town receives federal CDBG funds for activities which benefit primarily very low and low income households, including Americans with Disabilities Act (ADA) modifications, affordable housing developments, the Housing Conservation Program, and service programs .administered by local nonprofit agencies. DISCUSSION: .Each fiscal year, Council adopts a resolution allocating CDBG funds for that year. 'The total amount of funds available each year is set by the federal Department of Housing and Urban Development (HUD).. If any project which is allocated CDBG funds does not use all of those funds, they must be re-allocated to another project before they maybe used. All of the Town's CDBG allocations are tracked by Santa -Clara County on a document called the Cash Control Record, and each is assigned a "project number." The Town's Cash Control Record currently includes an allocation for ADA-compliant curb cuts (project LG-09.-41). This project has been completed, and the Parks and Public Works PREPARED BY: Regina A. Oak Meadow Park is atwelve-acre parlc located at the intersection of University Avenue and Blossom Hill Road. The park is adjacent to the Los. Gatos Creek Trail. It has a large open turf area ofapproximately five acres. There is currently adirt/gravel pathway that runs along the perimeter of this turf area that serves as primary path of travel to the picnic areas and other amenities located within the park. The surface of this pathway is uneven and is not ADA compliant, making many of the park's amenities difficult to access by those park users with wheelchairs, walkers, strollers, or physical limitations. This project will allow for the construction of a paved, asphalt pathway around the turf area. The pathway, which will range in width from five to twelve feet, will provide for ADA access of several group picnic areas, the bandstand area,. and the park restroom facilities. Additionally, this pathway will provide for full ADA access from the park's parking lot to the Billy Jones Railroad facilities and the Bill Mason Carousel. This pathway project will also provide for an ADA accessible connection'to the Los Gatos Creek Trail and Vasona County Park. Preliminary design has already begun for this project and is expected to be completed over the summer. Bidding and award will occur during August and September. Construction is scheduled to occur during. the month of November 2010. CONCLUSION: Staff recommends that Council adopt a resolution (Attachment 1) authorizing the transfer of CDBG funds remaining from project LG-09-41, "Town of Los Gatos. ADA Compliance -Curb Cuts," to project LG-10-41, "Town of Los Gatos-ADA Compliance -Oak Meadow," and related budget adjustments. Once approved by Council, the transfer request would be forwarded for final approval by the County. ENVIRONMENTAL ASSESSMENT: The recommended action is not a prof ect defined under CEQA, and no further action is required.. FISCAL IMPACT: The total cost of the project is estimated at $139;886. Of this, $107,643 would be funded through the CDBG program, and the remaining $32,243 would be funded through TDA Article 3 FY 10/11 funds. All CDBG allocations are adopted as part of the Operating Budget. Once the transfer was approved, budget adjustments in the appropriate operating revenue and expenditure accounts would be made to reflect the corrected amounts of ADA funding. Budget adjustments in the appropriate CIP revenue and expenditure accounts would be made to reflect the receipt of CDBG funds. The recommended action would have no impact on the General Fund. NOW, THEREFORE, THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY RESOLVE AS FOLLOWS: The Town Council does hereby authorize the transfer of funds on the Town's Cash Control Report as set out in Exhibit A, attached and incorporated herein, and the related budget adjustments.
