Staff ReportDRAFT Town Council Meeting 06/07/16 Item #1 MINUTES OF THE TOWN COUNCIL/PARKING AUTHORITY MEETING MAY 17, 2016 (The Town Council of the Town of Los Gatos conducted a Special Meeting on Tuesday, May 17, 2016, to hold a Closed Session at 6:00 and a Regular Meeting at 7:00 p.m. CLOSED SESSION – 6:00 P.M. CS - 1 CONFERENCE WITH LABOR NEGOTIATOR (Government Code Section 54957.6) To meet with Town Negotiators listed below in closed session pursuant to Government Code §54957.6 regarding negotiations with the Employee Organizations listed below: Town Negotiators (Lead): Allyson Hauck, Renne, Sloan, Holtzman, Sakai LLP and Laurel Prevetti, Town Manager Employee Organizations: Town Employees’ Association (TEA), American Federation of State, County and Municipal Employees Local No. 101 (AFSCME), and Police Officers’ Association (POA) MEETING CALLED TO ORDER AT 7:00 P.M. ROLL CALL Present: Mayor Barbara Spector, Vice Mayor Marico Sayoc, Council Member Marcia Jensen, Council Member Steve Leonardis, Council Member Rob Rennie. Absent: None PLEDGE OF ALLEGIANCE Vivek Sarkar led the Pledge of Allegiance. The audience was invited to participate. PRESENTATIONS Mayor Spector presented the Small Business, Big Applause commendation to Lisa Hauck-Alvarez, owner of the Wine Cellar Restaurant. Mayor Spector presented the Government Finance Officers Association: Distinguished Budget Presentation Award to Stephen Conway, Finance Director. CLOSED SESSION REPORT Robert Schultz, Town Attorney, stated Council met in Closed Session as duly noted on the agenda and there is no report. COUNCIL/TOWN MANAGER REPORTS Council Matters - Council Member Marcia Jensen stated she attended the Council Policy Committee meeting with Vice Mayor Marico Sayoc. 2 Town Council/Parking Authority May 17, 2016 Council Matters – continued - Council Member Rob Rennie stated he and Vice Mayor Marico Sayoc attended the swearing in ceremony for a new Police Officer, the Silicon Valley Community Energy Agency meeting where he was elected Vice Chair, the Cities Association General Membership meeting, the VTA Policy Advisory Committee meeting, the LAFCO Commissioner training, and the Silicon Valley at Home Policy breakfast meeting. - Mayor Barbara Spector stated she and Council Member Steve Leonardis attended the Student Commissioner interviews, and the West Valley Mayors/Managers’ meeting. - Vice Mayor Marico Sayoc had nothing additional to report. - Council Member Steve Leonardis stated he attended and chaired the West Valley Solid Waste Management Authority meeting in addition to the Student Commissioner interviews. Manager Matters - Introduced the new Library Director, Dolly Goyal. - Reminded the Council and public that it was National Public Works Week and invited the public to attend the open house on Wednesday morning, May 18 and invited the Council to join staff at the barbecue lunch after the open house. CONSENT ITEMS (TO BE ACTED UPON BY A SINGLE MOTION) 1. Approve Council Minutes of May 3, 2016. 2. Adopt an Ordinance of the Town Council of the Town of Los Gatos amending Section 18.60.10 to include restrictions on smoking in commercial zoned areas and in multi-unit residences and other miscellaneous edits. ORDINANCE 2254 3. Metropolitan Transportation Commission (MTC) Transportation Development Act Article 3 Funds a. Adopt a resolution authorizing the Town Manager to file an application for 2016/17 Metropolitan Transportation Commission (MTC) Transportation Development Act Article 3 Funds in the amount of $79,848 to fund a portion of the Bicycle and Pedestrian Master Plan. RESOLUTION 2016- 027 b. Upon Approval of TDA Funding, Authorize a budget adjustment of $7,348 (new total project funding of $127,348) replacing traffic mitigation fees funding source of $72,500 with new TDA funding source of $79,848. MOTION: Motion by Vice Mayor Marico Sayoc to approve the Consent Items. Seconded by Mayor Barbara Spector. VOTE: Motion passed unanimously. 3 Town Council/Parking Authority May 17, 2016 VERBAL COMMUNICATIONS Stanford Stickney - Inquired about a possible lane expansion near the North 40 development. Crystal Huang, Anne Zepecki, and other Youth Commission Representatives - Presented the sub-committee recommendations for green bike lanes near the high school. OTHER BUSINESS 4. Accept and approve recommendations from the Town Council Finance Committee to reduce unfunded pension liabilities, including: a. Establish a General Fund California Public Employees Retirement System (CalPERS) Reserve Account. b. Approve a budget adjustment to the Proposed FY 2016/17 Annual Operating Budget in the amount not to exceed of $2.5 million payable to the new CalPERS Reserve Account. c. Revise the Town Council Reserve Policy to provide for a maximum of $300,000 in General Fund Year End Savings upon fiscal year close to be deposited in the CalPERS Reserve Account or used for lump sum pay down as authorized by Town Council. d. Direct staff to return to the Town Council in early 2017 for consideration of a CalPERS 20-year “Fresh Start” alternative amortization period for the miscellaneous and safety plans based upon an upcoming CalPERS 2016 valuation report. Steve Conway, Finance Director, presented the staff report. Opened and closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Marcia Jensen to accept the recommendation from the Finance Committee on page 1 of the staff report. Seconded by Mayor Barbara Spector. VOTE: Motion passed unanimously. PUBLIC HEARINGS 5. Operating and Capital Budgets a. Consider the Town of Los Gatos Proposed Operating and Capital Budget for FY 16/17. b. Consider the Town of Los Gatos Proposed Capital Improvement Program for FY 16/17 – 20/21. 4 Town Council/Parking Authority May 17, 2016 Public Hearings Item #5 – continued Steve Conway, Finance Director, Gitta Ungvari, Administrative Analyst, and Matt Morley, Director of Parks and Public Works, presented the staff report. Opened Public Comment. Mary Goulart, Executive Director of Live Oak Senior Nutrition Center - Thanked Council for their continued support over the years. Kelly Mitchell, Live Oak Adult Day Services, - Thanked Council for their continued support over the years. Tom Picraux, Chair, Community and Senior Services Commission - Spoke in favor of the grants program and thanked Council for their continued support of the organizations that receive grants. Sujatha Venkatraman, West Valley Community Services - Thanked Council for their support of the program. Bernadette White, Next Door Solutions to Domestic Violence - Thanked Council for their continued support. Closed Public Comment. Council discussed the matter. MOTION: Motion by Council Member Marcia Jensen to accept the recommended Operating Budget with the following change: to continue as a pilot program for one year the Community Services Officer (CSO) that is currently working the night time for complaints. Seconded by Mayor Barbara Spector. VOTE: Motion passed unanimously. 5 Town Council/Parking Authority May 17, 2016 Public Hearing Item #5 – continued MOTION: Motion by Council Member Marcia Jensen to accept the recommended Capital Improvement Projects budget (CIP) with the following changes: 1) add a Green Bike Lane project as a place holder; 2) return with suggestions on how to implement the completion of the Forbes Mill Footbridge art panels, and if possible, add lighting, 3) include funding to at least maintain, if not improve, the Pavement Condition Index (PCI), 4) consider the addition of $33,000 for painting of light poles, and 5) determine safety versus non-safety projects as a source of funding for the additions mentioned in this motion;.
