2016-014 - Rescind Resolution 1984-021: Establishing a Town Policy for handling abandoned applicationsRESOLUTION 2016 -014 RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS TO RESCIND RESOLUTION 1984 -21: RESOLUTION ESTABLISHING A TOWN POLICY FOR HANDLING ABANDONED APPLICATIONS WHEREAS, the Town Council is responsible for establishing municipal policies that provide clear direction for process and procedures by which the Council and staff shall conduct business and activities; and WHEREAS, examples of these policies include the Town Code, Town Council Policies, General Plan, Design Guidelines, and Area Plans; and WHEREAS, the many benefits of having established policies includes greater consistency as well as more government transparency and accessibility by the public, the Council and staff; and WHEREAS, the Policy Committee reviewed Resolution 1984 -21 (Resolution Establishing a Town Policy for Hacfdling Abandoned Applications) and recommended the rescission of it at its January 27, 2016 meeting; and WHEREAS, this Resolution is outdated. NOW, THEREFORE, BE IT RESOLVED THAT, the Town Council of the Town of Los Gatos does hereby rescind Resolution 1984 -21 (Resolution Establishing a Town Policy for Handling Abandoned Applications) attached hereto as Exhibit A. PASSED AND ADOPTED at a regular meeting of the Town Council of the Town of Los Gatos, California on the 5a' day of April, 2016 by the following vote: COUNCIL MEMBERS: AYES: Marcia Jensen, Rob Rennie, Marico Sayoc, Mayor Barbara Spector NAYS: ABSENT: Steve Leonardis ABSTAIN: MAYOR OF THE TOWN OF LOS GATOS LOS GATOS, CA IF NIA DATE: ATTEST: CLERK ADMINISTRATOR OF THE TOWN OF LOS GATOS LOS GATOS, CALIFORNIA DATE: L4,[111to 2 of 2 Resolution 2016 -014 April 5, 2016 '9 RESOLUTION NO. 1984 -21 RESOLUTION ESTABLISHING A TOWN POLICY FOR HANDLING ABANDONED APPLICATIONS RESOLVED, by the Town Council of the Town of Los Gatos, that the following procedures be adopted as Town policy: 1. Where there has been no activity for at least three (3) months, the appli- cants shall be notified in writing that the matter.is being set for public hearing before the Planning Commission with a recommendation for denial. 2. If no additional response is received within 15 days of the date the letter is sent, or if the applicant advises staff that he decides not to pursue it, the application will be set for public hearing for denial /withdrawal as appropriate. No mailed notice will be made unless required by State law, the legal advertisement and the agenda shall note the recommended action and rea- son for such action. 3. For projects deemed complete, the Planning Commission action shall be com- pleted within six (6) months after the project is deemed complete, unless the applicant requests and the Planning Commission grants a further extension. For projects not yet deemed complete, such action shall be completed within six (6) months of the last Development Review Committee meeting on the matter. 4. A request to extend the processing time can be granted by the Planning Direc- tor at any time before the matter is set for public hearing. If after such an extension is granted, and there is still no satisfactory action to com- plete the application, the matter will automatically be set for public hear- ing as described under 2. above. 5. There shall be no fee refunds or off -sets on future applications.
