A RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN MANAGER TO SET FORTH PROCEDURE
FOR EXPENDITURE BY THE POLICE DEPARTMENT
OF ASSET FORFEITURE MONIES
WHEREAS, The Town wishes to establish a procedure for the expenditure by the
Police Department of asset forfeiture monies; and
WHEREAS, This procedure will apply to the maintenance and expenditure by the
Police Department of asset forfeiture monies and the interest generated from asset
forfeiture monies; and
WHEREAS, Section 11489(d) of the California Health and Safety Code states:
All funds distributed [to the state and local law enforcement agencies] shall
not supplant any state or local funds that would, in the absence of this
subdivision, be available to support the law enforcement and prosecutorial
efforts of these agencies. Funds so distributed shall be used by the law
enforcement and prosecutorial agencies exclusively to support law enforcement
and prosecutorial efforts of those agencies; and
WHEREAS, All monies seized by the Police Department as asset forfeiture shall be
kept in an account separate from any and all other accounts maintained by the Town of Los
Gatos;
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Los
Gatos that expenditure of asset forfeiture monies will be made in accordance with the
following procedure:
1. The Chief of Police will receive and review all requests for expenditure of
asset money, in consideration of the needs of the Police Department and the
provisions of state and federal law.
2. The Chief of Police will recommend for approval by the Town Manager and
Town Council any expenditure of asset forfeiture money.
Upon approval by the Town Manager and Town Council, the Chief of Police
will cause the expenditure of the asset forfeiture money in the manner
approved.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 6th day of January, 1992, by the following vote:
