RESOLUTION OF THE TOWN OF LOS GATOS GRANTING AN APPEAL OF
A DECISION OF THE EARTHQUAKE RESTORATION COMMITTEE
DENYING THE FRONT PORCH RECONFIGURATION OF AN
EARTHQUAKE DAMAGED SINGLE- FAMILY RESIDENCE AND THE SHAPE
OF A WINDOW IN THE PROPOSED DETACHED TWO CAR GARAGE
LOCATED IN THE R -1D LHP ZONE. ARCHITECTURE AND SITE
APPLICATION ES -91 -49

WHEREAS:
A. Mike and Dave Hernandez, owners, has appealed a decision of the
Earthquake Restoration Committee denying the front porch reconfiguration of an
earthquake damaged single - family residence and the shape of a window in the proposed
detached two car garage located in the R -113 LHP zone (Architecture and Site Application
ES- 91 -49);
B. The Earthquake Restoration Committee recommended that the applicant's
rehabilitation plans be approved subject to modification. Owners are appealing the decision
to the Town Council; and
C. A Town Council public hearing was held on December 16, 1991.
RESOLVED:
A. The Town Council hereby finds that the Earthquake Restoration Committee
erred in its decision.
B. Based on the foregoing findings, the appeal is granted and the project is
approved subject to the following conditions:
1. The roof line of the residence may be raised. The maximum height of the
residence will increase approximately 23 feet to 26 feet.
2. The footprint of the residence may be slightly modified at the rear.
3. The L- shaped front porch may be replaced with a circular porch.
4. The roof over the front bay window may be changed from a flat roof to a
sloping roof.
5. The proposed arched window in the detached garage shall be replaced with
a window shape compatible to the windows in the existing residence.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 6th day of January, 1992 by the following vote.
