RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
REMANDING TO THE PLANNING COMMISSION FOR FURTHER REVIEW
THE APPEAL OF A PLANNING COMMISSION DECISION
APPROVING PLANS FOR THE CONSTRUCTION OF
A NEW SINGLE - FAMILY RESIDENCE ON PROPERTY IN THE HR -1 ZONE.
ARCHITECTURE AND SITE APPLICATION 5- 90 -49.
PROPERTY LOCATED AT: 101 TERESITA WAY
PROPERTY OWNER: GREG McCANDLESS
APPELLANTS: JAMES and PAULA McHUGH
WHEREAS:
A. James and Paula McHugh, appellants, appealed a decision of the Planning
Commission approving the construction of a new single - family residence on property in the
HR -1 Zone. Architecture and Site Application S- 90 -49. Property located at 101 Teresita
Way.
B. The Planning Commission first considered the matter on July 11, 1990 and
directed applicant to make changes to the plans and returned the application to the
Development Review Committee.
C. The Planning Commission considered revised plans on September 12, 1990
and approved the application. The approval was appealed.
D. The Town Council conducted a public hearing on October 15, 1990 and
remanded the application to the Planning Commission to reduce the size and mass of the
residence and to address the privacy concerns of the neighbors.
E. The Planning Commission considered the revised plans on March 13, 1991

and directed the applicant to make changes to the plans and return the application to the
Development Review Committee.
F. The Planning Commission considered the revised plans on December 11, 1991
and approved the application. The approval was appealed.
G. On January 21, 1992 the Town Council opened and continued a public
hearing. On February 3, 1992 the public hearing was concluded.
BE IT RESOLVED:
The Town Council hereby finds that the application should be remanded to the
Planning Commission for further consideration of the scale and mass of the residence with
particular attention to the height of the left elevation.
Pursuant to Los Gatos Town Code section 1.10.085, the time for seeking judicial
review for the Town Council decision is governed by California Code of Civil Procedure
section 1094.6.

of Los Gatos, California, held on the 18th day of February, 1992, by the following vote.
