RESOLUTION OF THE TOWN COUNCIL
OF THE TOWN OF LOS GATOS
ORDERING THE VACATION OF EXCESS PUBLIC STREET RIGHT -OF -WAY
ON WEDGEWOOD AVENUE
BETWEEN THE SOUTHERN PACIFIC TRANSPORTATION COMPANY
RIGHT -OF -WAY AND THE ROUTE 85 RIGHT -OF -WAY
WHEREAS, the Town Council of the Town of Los Gatos has proceeded under the
provisions of Division 9, Chapter 4, Section 8334, et seq., of the Streets and Highways Code,
concerning the vacation of portions of excess public street right -of -way located in the Town
of Los Gatos, County of Santa Clara, State of California, consisting of an area of
approximately 0.41 acres, and located on Wedgewood Avenue between the Southern Pacific
Transportation Company right -of -way and the Route 85 right -of -way, more particularly
described on Exhibit "A" (Abandonment of a portion of the right -of -way for Wedgewood
Avenue), attached hereto, and depicted on Exhibit 'B ", attached hereto; and
WHEREAS, pursuant to the provisions of the Streets and Highways Code, Section
8334(a), the Town Council of the Town of Los Gatos declares that the right -of -way is excess
and is not needed for public street purposes.
RESOLVED, the Town Council of the Town of Los Gatos finds from all of the
evidence submitted that the right -of -way is unnecessary for present or prospective public
roadway purposes, and hereby vacates the right -of -way for street purposes on the condition
that a Public Service Easement (P.S.E.) shall be and hereby is retained over the area.

FURTHER RESOLVED, the Town Clerk shall cause a certified copy of this Order,
attested by her under the Seal of the Town, to be recorded in the Office of the County
Recorder of the County of Santa Clara. From and after the date this resolution is recorded,
the right -of -way shall no longer constitute a public street right -of -way.

of Los Gatos, California, held on the 4th day of January, 1993, by the following vote:

Abandonment of a portion of the right -of -way for Wedgewood Avenue.
BEING a portion of the right -of -way for Wedgewood Avenue; also being a portion of
Rancho Rinconada de Los Gatos in the Town of Los Gatos, County of Santa Clara, State
of California, more particularly described as follows:
BEGINNING at a 3/4 in. iron pipe marking the point of intersection of the
southerly line of Wedgewood Avenue and the easterly line of the lands of the
Southern Pacific Transportation Company, said point also being the most
westerly corner of Parcel "A" as shown on the map of the Amended Tract No.
6878, a map which was filed for record in Book 488 of Maps at pages 21
through 37, Santa Clara County Records; thence from said POINT OF
BEGINNING, along the southerly line of Wedgewood Avenue S 84° 33' 56"
E 395.07 feet, more or less, to the point of intersection of said southerly line
of Wedgewood Avenue with the southerly line of State Route 85, said point
also being on the northwesterly line of said Parcel "A'; thence leaving said
northwesterly line of Parcel "A" along the southerly line of said Route 85 N
660 10' 00" W 158.41 feet, more or less, to an angle point, said angle point
also being a point on the northerly line of Wedgewood Avenue; thence along
the common line of said Route 85 and of Wedgewood Avenue N 84° 33' 56"
W 282.00 feet, more or less, to an angle point; thence leaving the southerly
line of said Route 85 along the northerly line of Wedgewood Avenue N 84°
33' 56" W 35.60 feet, more or less, to the point of intersection of said
northerly line of Wedgewood Avenue with the easterly line of said lands of
the Southern Pacific Transportation Company, said point being a point of
tangency on a circular curve concave to the southwest, the radial line from
said point bears S 38° 39' 14" W; thence along the easterly line of said
Southern Pacific Transportation Company along a tangent curve to the right
with a radius of 1,949.91 feet, through a central angle of 2° 35' 34" for an
arc length of 88.24 feet to the POINT OF BEGINNING.
