RESOLUTION OF THE TOWN OF LOS GATOS DENYING AN APPEAL
OF A DECISION OF THE PLANNING COMMISSION APPROVING A
REQUEST FOR APPROVAL OF PLANS TO CONSTRUCT A 58,515 SQ.
FT. MEDICAL OFFICE FACILITY IN THE "O" ZONE, ARCHITECTURE
AND SITE APPLICATION S -90 -9A AND NEGATIVE DECLARATION
ND -90 -9
(PROPERTY LOCATED AT 555 KNOWLES DRIVE /OWNER,
NATIONAL MEDICAL ENTERPRISES, INC. /APPLICANT, ROBERT
ELMORE/ APPELLANT, CHESTER MALLORY)
WHEREAS:
A. Property owner, National Medical Enterprises, Inc. (NME), proposes to
construct a two story, 56,591 square foot medical office building on a 3.48 acre vacant
parcel near the intersection of Knowles Drive and Dardanelh Lane zoned office with a
General Plan Designation of Office Professional (Architecture and Site Application S -90-
9A and Negative Declaration ND- 90 -9);
B. The Development Review Committee recommended approval subject to
conditions and traffic mitigation measures;
E. On July 7, 1992 and November 18, 1992 the Planning Commission reviewed
the application. On November 18, 1992, the Planning Commission approved the office
building subject to 19 conditions; and
F. The appellant Chester Mallory, a resident of Campbell representing the W.
Parr Neighborhood Association, has appealed the Planning Commission decision on the
basis that the Commission erred by not requiring the applicant to construct a cul -de -sac on
Dardanelli Lane to reduce traffic impacts on W. Parr Avenue; and
G. The Town Council held a public hearing on January 4, 1993.
RESOLVED:
A. The Town Council hereby finds that the Planning Commission did not err in
its approval of Architecture and Site Application S -90 -9A and Negative Declaration
ND -90 -9 and further finds that the traffic impacts on West Parr Avenue caused by this
project are not significant because:

(1) The medical office building fronts on Knowles Drive, a collector street
which, like West Parr Avenue, also serves as a collector between the two arterial streets of
Winchester Blvd. and Pollard Road. As such, traffic will be more likely to use Knowles
Drive to get to these arterial streets.
(2) The traffic mitigation fees imposed on this project to provide, in part,
for the signalization of Dardanelli Lane and Knowles Drive, together with the existing
signalization on Knowles Drive to the east makes it more likely that traffic to and from the
project area will use Knowles Drive rather than the unsignalized collector West Parr
Avenue.
(3) The imposition, Condition No. 7 of the Master Plan and the on -site
circulation plan reduce the impact of the project on West Parr Avenue.
(4) West Parr Avenue is designated a collector street in the Town's
General Plan and in fact, it functions as a collector street between the two arterial streets
of Winchester Blvd. and Pollard Road.
The traffic on West Parr Avenue is well within collector street volumes
both before and after this project.
B. The application is approved subject to the following conditions:
TO THE SATISFACTION OF THE PLANNING DIRECTOR:
(Planning Section)
1. Construction hours shall be limited to between 8 a.m. and 8 p.m., Monday through
Friday.
2. Construction equipment shall use state of the art mufflers to reduce noise levels.
3. All utility boxes including electrical, irrigation and cable television shall be
screened from the street.
(Engineering Section)
4. Final grading, drainage, driveway, utility and frontage improvement plans shall be
submitted to the Engineering Department.

5. A soils and geologic report shall be prepared which provides specific criteria and
standards governing site grading, drainage, pavement design, retaining wall design,
and erosion control. A registered civil engineer, specializing in soil mechanics,
should be included in the group that prepares this report.
6. Any sections of curb, gutter and sidewalk along the frontage of this property that
are currently broken or raised, or any sections damaged during construction, shall
be replaced.
7. A well information questionnaire (available through the Counter Technician) shall
be completed.
8. The following shall be dedicated:
a. Knowles Drive: Sufficient street right -of -way and /or sidewalk easement to
accommodate a bus turn -out along the project frontage to install a bus
turnout and shelter.
b. Ingress /egress, storm drain, sanitary sewer, and public service easements
as required.
c. Dardanelli Lane /Knowles Drive intersection - Sufficient right -of -way to
accommodate widening of intersection including tie -in paving, curb, gutter and
sidewalk.
9. A traffic impact mitigation fee shall be paid based on the adopted fee schedule
in effect at the time building permits are issued.
10. An agreement shall be entered into guaranteeing payment of a proportionate
share of the cost to install a traffic signal and appurtenances at:
a. Pollard Road at Burrows Road (four percent)
b. Lark Avenue at University Avenue (two percent).
c. Dardanelli Lane at Knowles Drive (53 percent).
11. Horizontal and vertical controls shall be set and certified by a licensed surveyor
or registered civil engineer for the following items:
a. Pad elevation
b. Finish floor elevation

c. Foundation corner locations
12. A five -year tree maintenance agreement shall be entered into for the protection
of existing and newly planted trees.
13. A Transportation Demand Management (TDM) Program will be provided to
reduce traffic volumes on roadways by promoting use of mass transit, carpools, and
vanpools. At present, there are two bus lines serving the project area. The
following measures will be implemented as part of the Master Plan's TDM program
to include existing employees within the Master Plan area:
a. A traffic management coordinator within the hospital staff will be
appointed to effectively manage employee trips in accordance with applicable
laws and ordinances.
b. Bus, carpool, and vanpool schedules will be distributed to all employees
C. Campus maps will be prominently displayed adjacent to parking areas and
pedestrian paths to encourage use of the Master Plan's pedestrian pathway
system between buildings and parking areas.
d. Provision of shuttle cars (golf carts) and shuttle car pathways will be
considered for use by invalid patients.
e. Bicycle shall be placed at major entrances to buildings
14. The applicant shall construct the transit bus turnout and shelter prior to
occupancy.
15. The applicant shall enter into an agreement with the Town to complete the
improvements at Dardanelli Lane and Knowles Drive including signalization. The
improvements shall be completed by the applicant prior to occupancy. The signal
shall include an audible device to assist the hearing impaired pedestrian.
Improvements shall include:
a. Pedestrian crosswalks will be provided across the north, west, and south
legs of the Dardanelli Lane /Knowles Drive intersection. No crosswalk is
recommended across the east leg due to the relatively high number of vehicles
turning left from southbound Dardanelli Lane to eastbound Knowles Drive.
b. Pedestrian - activated crossing buttons will also be provided and programmed
to allow a minimum of 26 seconds crossing time for the Knowles Drive
crossing and 23 seconds for both Dardanelli Lane crossings.

TO THE SATISFACTION OF THE DIRECTOR OF PARKS, FORESTRY &
MAINTENANCE SERVICES:
16. All tree care activities shall be accomplished by a licensed, competent tree care
firm as approved by and under the supervision of the Director of Parks, Forestry &
Maintenance Services.
17. Newly planted trees shall be double - staked, using rubber tree ties and shall be
planted prior to occupancy.
18. A final landscape plan shall be submitted and approved.
TO THE SATISFACTION OF THE DIRECTOR OF BUILDING SERVICES:
19. Provide a physicists report including the manufacturer's specifications and
requirements for construction of the linear accelerator.
Pursuant to Los Gatos Town Code Section 1.10.085, the time for seeking judicial
review for the Town Council decision is governed by California Code of Civil Procedure
Section 1094.6.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 19th day of January, 1993 by the following vote.
