RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF LOS GATOS
AUTHORIZING THE TOWN ATTORNEY AND THE ABAG PLAN
CORPORATION TO SETTLE TORT CLAIMS NOT EXCEEDING THE SUM
OF $5,000 AND REPEALING RESOLUTION NO. 1991 -31
WHEREAS, the Town of Los Gatos is a member of the Association of Bay Area
Governments (ABAG) liability pool known as ABAG Plan Corporation;
WHEREAS, ABAG Plan Corporation is the claims administrator for all claims filed
with the Town of Los Gatos;
WHEREAS, the Town Council wishes to delegate settlement authority for tort claims
not exceeding the sum of $5,000 to the Town Attorney and said claims administrator.
NOW THEREFORE, BE IT RESOLVED, that the Los Gatos Town Council hereby
repeals Resolution No. 1991 -31 entitled "Resolution Authorizing Town Attorney and the
ABAG Plan Corporation to Settle Tort Claims not Exceeding the sum of $3,000 and repeal
Resolution No. 1987- 180."
RESOLVED, that the Town Council of the Town of Los Gatos does hereby.delegate
settlement authority for tort claims against the Town of Los Gatos, its officers and
employees not exceeding the sum of $5,000 to the Town Attorney and the ABAG Plan
Corporation as claims administrator.
PASSED AND ADOPTED at a regular meeting of the Town Council of the Town
of Los Gatos, California, held on the 18th day of January, 1994 by the following vote.
