MEMORANDUM TO LOS GATOS MAYOR MARCIA JENSEN AND THE
TOWN COUNCIL REGARDING THE PROPOSED EXPLANSION OF THE
HIIIBROOK CUP FROM 315 STUDENTS TO 414 STUDENTS
I. QUESTION PRESENTED
Should the Town of Los Gatos allow Hillbrook School to expand from 315
students under its present CUP to 414 students?
II. SUMMARY ARGUMENT
Hillbrook has not earned the right to an increase in its CUP Student
Maximum Limit. Hillbrook appears to have repeatedly violated for over a decade
the CUP the maximum student enrollment limit. Hillbrook offers no justification or
apology for these violations. Hillbrook does provide a significant community
educational benefit. Neighbors near Hillbrook have been adversely impacted
and justified distrust has developed. Traffic in Town is increasing rapidly, and will
continue. Balancing these issues, capping the student increase at no more than
36 students allows some expansion, better enables Hillbrook to meet the hard
880 traffic trip cap, and sends a message that CUP violations are serious
matters, and that entitles will be held accountable for them.
III. KEY FACTS
One, Hillbrook School is a private, independent school, and appears to
provide a high quality education for its students. The cost per student I'm
informed is about $26,000 /year. There are students that apparently receive up to
90% in scholarship monies. Hilllbrook has represented that approximately 50%
of its students come from Los Gatos.
Two, Hillbrook was granted a Conditional Use Permit ( "CUP ") that allowed
it up to 315 students. Hillbrook now has a vested right to have up to 315
students.
Three, according to a citizens group opposed to the expansion, Hillbrook
violated the 315 maximum student enrollment cap as follows (See Citizens
Appeal for the supporting documentation):

The primary source for this information was apparently affidavits signed by
the School's representatives, and presented to the State of California.
Four, apparently Basketball Tournaments occurred which were not
allowed.
Five, apparently Hillbrook has claimed that it has never been found in
violation of the CUP because either it was not caught at the time, or if caught,
promptly conformed its activities to the requirements of the CUP.
Six, expansion of the number of students will naturally increase the
number of cars trips, absent alternative ways for students and their parents to
arrive at and leave the campus.
Seven, Hillbrook claims that 18 -20 student class sizes are optimal for its
operations.
Eight, many citizens in the area are opposed to the Hillbrook expansion
because of concerns about increased traffic and noise. A perceived lack of
systemic compliance to the CUP by Hillbrook has fostered distrust of future
compliance.
Nine, traffic is increasing in Los Gatos to unprecedented levels, and will
continue with the development of the Albright site, PAMF, other projects in Town,
and the increased use of Highways 17 and 85, which causes cut - through traffic.
Twelve, Hillbrook may have been seeking 99 students on the premise that
they had to ask for double of what they wanted, to get what they really wanted,
half as much.
IV. RECOMMENDATIONS
One, Los Gatos citizens do value education, and Hillbrook provides an
excellent one for many families of Los Gatos. This community benefit must be
carefully balanced with the rules violations, and the legitimate concerns of
neighbors.
Two, there appears to be a troubling pattern of material noncompliance
with the student cap of 315 students. Hillbrook built out beyond its needs for 315
students. It appears that it then made a conscious decision to repeatedly violate
the CUP by expanding student use into its excess space without Town approval.
The best predictor of future conduct is past conduct. Thus, absent significant
changes in how the Town monitor's Hillbrook's activities and /or how Hillbrook
monitors itself, I would anticipate more violations in the future.
Three, Hillbrook's papers reference denial of their request as bad
precedent and unfair. It claims that penalties for excessive car trips should fit the
crime. However, isn't is also bad precedent to reward a repeat and intentional
violator of the CUP cap of 315 students? Isn't is unfair to other entities in Town
that do comply with their CUPs? Isn't is unfair to St. Mary's School (which I have
no reason to believe does not comply with its CUP, and does an amazing job of
traffic management) 315 student limit to allow Hillbrook a vested right to an
increase to 414 students?
Four, Hillbrook should not be allowed more than 36 additional students,
and perhaps none at all. Thirty -six students allows two additional sections of 18
students, which is within the optimum range Hillbrook seeks. A reduction in the
number of additional students will allow it to comply with the hard cap of 880 car
trips. While we are in this era of exploding traffic it makes sense to take a
conservative approach to expansions that would further increase already traffic
levels. Ongoing electronic monitoring seems critical to avoid confusion and,
misperception about the number of car trips generated by school operations.
Electronic monitoring serves a purpose akin to cameras in Police Officer's
vests — clarity about what actually occurred.
Five, an alternative is an no additional students, and requiring a period of
time of say three years for Hillbrook to demonstrate compliance with the existing
CUP and rebuild community trust.

I am a Los Gatos resident and I am writing to express my strong support for Hillbrook School. I ask that you approve
Hillbrook's request to increase enrollment by 99 students and approve daily traffic of 880 cars. Hillbrook has done an
exceptional job of decreasing traffic on local roadways with its shuttle, carpool, and walking /biking program. The traffic
congestion to /from Hillbrook is far less than any of the public schools. My family has carpooled, shuttled and biked to
Hillbrook the past 11 years- traffic reduction is a central part of the Hillbrook culture.
I straddle both sides of the school system in Los Gatos as I have a daughter at Los Gatos High School and a son at
Hillbrook. The public school system's enrollment has exploded the past 25 years, whereas Hillbrook has not increased at
all. We are fortunate to live in a community where there is educational choice and options and Hillbrook is an asset to
this community.
The neighbors in the Marchmont neighborhood chose to purchase their homes on the streets leading to Hillbrook
School, a school which long preceded their homes. Their demands and requests are unreasonable, and their goal is to
choke the very life out of Hillbrook School until it can no longer be a school ... so it will eventually go away. I try to
understand how this group of neighbors can be so mean spirited to a school, a place that is educating the hearts and
minds of our future children.
All of you council members are parents and have children. You know that our schools are the heart of our community.
Schools are a place where there are after - school activities and evening events: theatre performances, back to school
nights, awards ceremonies, family fun nights, choral concerts, band concerts, sports practices, games and competitions,
grade level ceremonies and traditions, graduations, community events (guest speakers, National Junior Basketball & Los
Gatos United tournaments & practices on weekdays and weekends, night football games and band practices, all comers
track meets - the list goes on). And, all of the public schools are used extensively over the summer by third party
organizations running sports, theatre, academic, music and arts camps. Why can't Hillbrook do the same?
I ask that you be fair and treat Hillbrook School the same as you would the public schools. To further limit the number
of cars, after - school enrichment activities, evening events and summer usage at Hillbrook, when the neighbors living
near public schools have no say whatsoever as to the usage at public schools, seems wrong. That a small group of
outspoken neighbors have made it their life mission to make Hillbrook less than a school, when it has been here 80
years, is truly upsetting.
I hope you will make the right decision to support Hillbrook School and approve an increase of 99 students and daily
traffic of 880 cars - both far less than go to our public schools.

Allow Hillbrook School to be it's best.
Mayor Jensen and Members of the Town Council,
My family has been part of the Hillbrook Community for twelve years. In that time, my three children have had the
wonderful opportunity to attend Hillbrook School. My husband and I were born and raised in Los Gatos and Saratoga.
We live in Saratoga, approximately three and a half miles away from Hiilbrook. We live in a neighborhood where the kids
attend many different schools such as Harker, Saint Andrews, Saratoga Elementary, Bellarmine and Presentation. All
these schools are situated in neighborhoods across the valley. The only way to get to them, like Hillbrook, is by driving
our public streets. We are blessed to live in area with so many great choices to educate our children. We have fantastic
public, private and religious schools. We should not limit the opportunities for any child to go to any one of these
schools because of where they are located.
Hillbrook is working hard to be a good neighbor. The neighbors of Hillbrook are in return, not being good neighbors.
This has been made clear over and over again by their actions, letters and words at the planning commission meetings.
Neighbor after neighbor continue to stretch the truth and refuse to acknowledge any improvements the school has
made. During our years at Hillbrook we have seen a huge reduction in traffic. We have always carpooled and now our
kids get up early in order to ride the bus to school ... a drive that would take us only 7 minutes, now has us leaving the
house 45 minutes earlier. We are committed to Hillbrook so we do what we can to help the school.
It is time for the city council to look closely and see the true facts. The truth is that the students at Hillbrook walk, ride,
carpool or bus to school. The car counts have dropped significantly. There is an EIR that shows no negative impact with
an increase in students. Staff has recommended and supported Hillbrook's plan. A Los Gatos Police Officer confirmed
that Marchmont is not an unsafe street. Please allow Hillbrook to grow and evolve. Don't allow the neighbors to bully
the school and choke it so that it can't survive. Hillbrook is full of tradition and history and part of the Los Gatos
Community.
The Hillbrook motto is to be kind, to be curious, to take risks and be your best. Allow Hillbrook to live out it's motto and
be it's best.

Hillbrook school
I am writing as a parent of two Hillbrook alumni. Our children were at the school for 11 straight years. I can,
without hesitation, say that Hillbrook was significant in creating the successful, productive high school students
that they are today. And in the future, they will be the successful, productive members of a community like Los
Gatos. The more students that have an opportunity for this type of education benefits everyone. The school has
followed the procedures, have reduced traffic and been respectful of the neighborhood surrounding it.
Please consider all the benefits that a school like Hillbrook brings to the children its educating, the surrounding
businesses their parents are supporting and the fact that they have been upfront and diligent with their desires to
increase enrollment. To penalize the school, penalizes the whole community. Thank you for your

Hello,
My name is Tom Belshe', parent of former Hillbrook graduates Will Belshe (2010) and Jack Belshe (2013). As an active
parent within the local Los Gatos /San Jose community I have had the good fortune of witnessing the wonderful
environment Hillbrook offers both its students and community.
Regarding the proposed expansion of enrollment I am fully supportive of the transition. While I can obviously
appreciate the local neighborhood concerns regarding the potential for increased traffic I am confident that the
opposite would to be true. While at Hillbrook from 2002 thru 2013 1 have personally witnessed fewer cars transporting
kids thru the neighborhood. The key addition in my opinion was the addition of extensive use of busing. My son went
from a carpool to bussing along with many other kids and this definitely reduced traffic considerably. Further, I
understand steps are being put in place to ensure the traffic is monitored thru the use of technology in order to track
this issue.
In the end, from my vantage point, I have seen a school like Hillbrook produce very impressive young men and women
and prepares them extremely well to be contributing members of society. Perhaps more meaningfully, the experience
Hillbrook offers fosters a sense of home such that most of these kids want to settle down in the area. I am all for
bolstering this academic institution as it will pay benefits to our overall community for years /generations to come.

Dear Los Gatos Council Members:
We are the parents of three children, all of whom benefited from a Hillbrook education. As
much as we like to congratulate ourselves for the strong, confident and productive adults that
our kids have become, we really look to Hillbrook for providing the encouraging and
supportive educational environment that allowed our children to thrive. While we're
fortunate to have outstanding schools in the Los Gatos - Saratoga district, private schools like
Hillbrook add to the quality and diversity of our local educational system. We'd like future
families to benefit from Hillbrook just as well.
As you're aware, even though Hillbrook predated its surrounding neighbors, it has
demonstrated admirable respect for the community by significantly reducing traffic (almost
40 %) over the past decade. The requested enrollment increase would come without any
further increase in school traffic. Even the Environmental Impact Report conducted by the
Town of Los Gatos itself suggested no negative impact due to the proposed enrollment
increase. Moreover, this increase in the student body would be the first in over a quarter of a
century.
We strongly urge you to vote in favor of the proposed increase in enrollment at the Hillbrook
School.

To the honorable town council of Los Gatos:
I lived on Hilow Road for 15 years and for the last 10 years I have lived off Shannon
Road in Los Gatos. Hillbrook is a valuable asset to our community. Over the years they
have been an excellent citizen and have made a huge effort to decrease their impact on
their neighbors. My son, Chris, attended Hillbrook and it was wonderful to have such a
great school as a "local" school.
Hillbrook has a challenge in how they deliver learning. In order to deliver remedial or
advanced classes at grade level, the school enrollment must be increased. Hillbrook has
the capacity, but needs the help of this Council.
Please help to Hillbrook to deliver the best education that it can by considering their
Conditional Use Permit at your January 13th meeting.

Mayor Jensen and Members of the Town Council,
Thank you for taking the time to serve the community of Los Gatos. I am writing to express my
support regarding the petition to modify the conditional use permit that Hillbrook has proposed to add
99 students. My 2 children have been attending Hillbrook since my 8th grade daughter began in
kindergarten. I can honestly say that the school has been an amazing school for my children to
attend and I truly feel that the school should be allowed to increase the count from 315 to 414 and
keep functioning as a school without limitations to the number of sports events and limitations to the
car count that are prohibitive and punishing. I believe that the approved growth of 33 students per
year for each of the next three years is a fair compromise that was approved by the planning
commission but what puzzles me greatly is why the planning commission is restricting our car count
so heavily. Please let me explain.
Since kindergarten (9 years ago) we have been carpooling every day to school with the rarest of
exceptions. Starting the very first day of school we were part of a 3 family 3 child carpool for two
years. Then we added another child from a 4th family. Then we were part of a 4 family 6 child
carpool for 1 year. About 6 years ago, a new family joined when my son started kindergarten that
happened to live 2 minutes away from my home. We then had a 2 family 3 child carpool until the
second child started kindergarten 2 years later. We are now a 2 family 4 child carpool and will
continue to be a 2 family 3 child carpool starting next year until we leave the school in 3 years. In
addition to all this carpooling, we regularly would reach out to 3 or 4 other fami lies and would
occasionally car pool with their children as well when we had the rare day that a child was out sick or
on vacation - or if our sports or after school schedules coordinated. When we had sports activities
either related to the school or not, we would coordinate carpools to minimize cars going in and out the
school. My point here is that we have always carpooled and made enormous efforts to minimize the
number of cars traveling to and from Hillbrook... both to help the car count, to help the environment,
save gas and time. Since the school started offering shuttles we have taken it even further so we can
minimize cars... our children ride the shuttle after school to be picked up at one of three other stops
away from the school as often as we are able (2 -4 times a week). We coordinate rides for our children
with other families again to save cars. Carpool is a way of life and the culture of the community at
Hillbrook. We always carpool and so do all of our friends. It is not a recent phenomenon and we
have taken farther then probably any other school in the area. We go out of our way to carpool and
to use shuttle so we can minimize a car. Every car counts.
It is part of the culture to be mindful of all the neighbors in the neighborhood. In fact, anytime I see a
resident trying to leave their driveway I make sure I stop to let them out immediately. I grew up on
Meridian Ave in San Jose and I know what it is like to have to wait for cars to pass by to be able to
exit your driveway. I have seen other drivers do the same numerous times. We are also mindful of
pedestrians as are other families.
I feel that it is equally important to be able to drive to school on occasion to drive for our service
learning field trips, or to read to our children when they were younger or to pick them up if they have
an orthodontist or doctors appointment.. or if we want to watch their sports game at school. These
and other events like our winter concert or spring concert are all equally important events that we
should have the ability to attend at our beloved school. In fact I remember that the head of the
planning commission commented that she goes to her grandchilds local public school once in a while
to read to the class or participate in some other way. Please allow us the same opportunity.
This brings me to the fact that our school's community has made tremendous efforts to minimize
traffic to and from the school whenever possible and 1 think that we should be rewarded not penalized
with an average car count of 880 not a limit of 880. This allows us to remain a fully functional school
while still protecting the neighborhood.
I would like to respectfully request that the town council reconsider the limitation on sports activities -
it is a normal school function for our children to be able to play on a sports team and to be able to
compete. Please do not limit the number of sports events or the after school enrichment classes
offered to our students. If the local public school was offering classes or sports activites, I doubt you
would require them to limit the number of sports activites or other school activites as restrictively as
you have required our school. In addition, I would also doubt that you would limit their car count to a
total car count but you would use a more fair "average car count ".
Please consider allowing our school to grow by a reasonable and fair amount of 99 students while
allowing us to continue to function as a thriving school and allow us to have an average car count that
is also reasonable - 880. We have been at our present location for about 80 years -longer than any
resident in that area and we deserve to continue for many more years to come. Our request has so
been reasonable and fair... please allow our amazing school to thrive! The families that attend
Hillbrook shop at Los Gatos stores bringing in revenue to your merchants and we are kind and
respectful people who care about our children, our school and the community of Los Gatos.
In conclusion I appreciate you taking the time to read this letter and hope that you will consider our
fair request. Thank you for all that you do for the Town of Los Gatos.

Dear Mayor Jensen and Town Council Members:
I am writing today to urge you to support Hillbrook School in its
application to expand its middle school program in accordance with
its Conditional Use Permit (CUP) application. Please permit me to
do so by sharing a bit about our personal experience with the
school, which our sons joined as 5th and 6th graders just this
year. I hope my letter will help convince you that Hillbrook is a
valuable part of the Los Gatos community, and an institution to be
protected and encouraged as part of our Town.
We moved to Los Gatos from the Peninsula in 2006. Many factors
attracted to move here. An important factor was the excellent
public school system. Our older son started Kindergarten at
Blossom Hill School.
Shortly after moving here, we accepted an overseas assignment in
Singapore. Our family moved to Singapore, for what was to be a
one to two year period. We ended up staying in Singapore for
almost five years. When our overseas assignment concluded, we
were thrilled to move back to Los Gatos. We enrolled our sons,
then 4th and 5th graders, at Daves Avenue Elementary.
On our return from Singapore, we quickly learned that our overseas
experience had changed all of us. The sort of needs we had for our
sons were different than we had before we left, and while Fisher
Middle School is excellent in its own right, it was simply not set up
to meet some of the unique requirements we now had. For
example, we were keen for our sons to continue studying Mandarin
Chinese, which they had studied for five years in Singapore. We
started searching for a different school for our sons. We
considered schools as far away as Menlo Park.
When we discovered Hillbrook, it seemed a perfect fit for
us. During the application process, the Head of School and the
Principal of the Middle School talked to us about our educational
priorities. Among other things, they helped design a language
program that fit our boys' needs and was an academic priority of
ours. The entire atmosphere of the school, including the blue and
white uniforms, was reminiscent of our sons' experience at the
Singapore American School. We found Hillbrook to be not
necessarily "better" or "superior" to the public school alternatives,
but just "different" and a better fit for our family.
At first, we were met with disappointment in the application
process, as our sons were not admitted. The school could not
accommodate us because of the cap on the number of students
under the existing CUP. But later on in the summer, we were
delighted to learn that space had opened due to some student
departures, and our sons were admitted.
Our sons quickly integrated into Hillbrook's middle school
program. Among the first things were learned was that they would
take a shuttle bus to and from school every morning, and that
administrators policed the number of cars and carpools driving up
Marchmont. Using the shuttle bus has been terrific -- we feel we
are helping Los Gatos' crowded morning traffic problems by
avoiding the choked drop off lines near Fisher Middle School and
Daves Avenue.
We have been delighted that the type of educational experience we
sought was available in Los Gatos. Our boys play in the Los Gatos
Little League and are a part of this community as any other 5th and
6th Grader. Los Gatos is their home, and Hillbrook is their
school. Our only disappointment is that other Los Gatos families,

who for various reasons would seek a different middle school
experience for their children, are unlikely to consider Hillbrook, due
to the enrollment limits under the existing CUP.
As one of the most sought after communities in the region, and the
home to numerous executives in technology companies — many of
them with overseas experiences — Los Gatos is a town where one
would expect to find an excellent independent school to serve its
residents, along with its wonderful public schools.
We were not the only Los Gatos family to seek out Hillbrook in this
way. Earlier this year, at a new parent reception, we were
delighted to run into an old neighbor of ours from Singapore. This
other family had also moved to Los Gatos from Singapore, and
after a similar "educational false start " quickly found Hillbrook as a
great solution for their children.
We encourage the Council to support Hillbrook in its bid to expand
its middle school so that other Los Gatos families can have the
educational opportunities that we have been so fortunate to have.

To Mayor Jensen and Members of the Town Council,
I am writing in the hope that you will support Hillbrook School in its efforts to increase enrollment. Hillbrook is
committed to protecting the neighborhood and community, and has taken very effective steps to limit traffic. As
parents of a Hillbrook student, we have been using the shuttle service they introduced for the last four years. In
addition to it being a great convenience for us and many other families, we believe it has reduced traffic in the
surrounding streets significantly.
I am confident that Hillbrook will be able to increase enrollment without negatively impacting the surrounding
neighborhood. The benefits for the students will be significant because, among other things, a larger middle
school will allow for a more diverse curriculum. This is important for us, as our son has great interests in
computer programming, and a larger middle school might increase demand for this subject (and others) to the
point that the school will be able to offer programming to everyone who wants it.
I believe the current proposed changes to the CUP will significantly harm Hillbrook's ability to offer a quality
educational experience to its expanded student body, as Hillbrook would not be able to function as a school in
the same way as other schools do. This is especially true when it comes to after school activities or really any
activity to which parents are invited. I think it goes without saying that these kinds of events build community
and create lasting memories for families.
The unintended consequences from the conditions for increasing enrollment may entirely negate the benefit that
the school and its families receive from the Town Council's decision to allow enrollment to increase in the first
place. Fortunately, the Town Council has the opportunity to correct this oversight and do what it intended to do
in the first place, which is to improve Los Gatos' already excellent educational offerings.

Dear Mayor, Vice -Mayor and Council members:
My name is Gretchen Moore. I live at 16465 Hilow Road with my husband and three elementary school -aged children. I currently
co -chair the Safe Routes to School (SRTS) program at Blossom Hill School. I have been involved in this program since 2010. As a
parent and as a member of the SRTS program, I am concerned about increased traffic in and around our neighborhood and school that
would result from an enrollment increase at Hillbrook School. If you are to uphold the Planning Commission's approval of the
Hillbrook enrollment increase I ask that the following conditions be adopted:
- Hillbrook's TDM plan must require full mandatory participation and must be in place for one whole academic year before
any consideration is given to an increase in enrollment;
o this ensures that Hillbrook can effectively manage its traffic when a pending CUP is not on the table
o the neighborhood has put forth several calculations showing Hillbrook how they can effectively meet the 880 traffic
limit set forth by the PC with plenty of room for extra trips during the day or evening; in fact, the TJKM study showed
that Hillbrook's daily traffic can be in the low 800s even without a TDM plan that did not require mandatory
participation; imagine how much lower this daily traffic number could be with a program that required all students to
participate in the TDM plan
o Hillbrook promised at the PC meeting to immediately change their TDM program from a voluntary program to a
mandatory program and still has not done so
- Daily traffic limit, not an average;
o Bay Area private schools such as the Menlo School and Harker have defined daily traffic limits in their CUPS, not
averages; averaging leads to unpredictable traffic patterns in the neighborhood during the times when dozens upon
dozens of elementary and middle school children are walking, biking and scooting to and from school;
o it is unrealistic to expect every neighborhood family to check Hillbrook's school calendar each day to see what
activities may be going on; additionally, there could be more than usual traffic for reasons not posted on Hillbrook's
website;
o a predictable level of traffic is needed to maintain safety in the neighborhood
Prohibit Hillbrook from parking /dropping off/picking up on neighboring streets, including but not limited to: Marchmont
Drive; Hilow Road; Topping Way; Cardinal Way; Robin Way; Kennedy Road, Englewood Avenue and Shannon Road
o if this provision is not included in the final CUP the traffic counts at the gate become meaningless; the Town may not
be able to enforce this but it surely should be a part of the conditions
- Shuttle bus stops shall not be put in place by Hillbrook until they are fully vetted by Town Staff, the LGMS Police
Department and affected neighbors;
o bus stops should be not allowed on the street unless it is at a designated VTA bus stop;
• several Bay Area companies provide a bussing service in Los Gatos for their employees; these busses pick up
employees at established VTA bus stops in Town (on Los Gatos Blvd at the Moore Buick dealership and on
Knowles at El Camino Hospital, for example);
• Hillbrook continues to stop its 60 foot long bus on the street, in a no parking zone at Blossom Hill
Park/Shannon Road (which is a designated SRTS drop point for Blossom Hill and Fisher Schools), Hillbrook
continues to refuse to move this bus stop 1 block away into the parking lot at the Presbyterian Church of Los
Gatos ( Google had been stopping their employee bus on the street in the same area but when local parents and
neighbors complained about the unsafe conditions it created, Google immediately moved the bus off the street
and into the church parking lot)
The neighborhood affected by Hillbrook is within a quarter to half mile of three local schools, Fisher Middle School and Van Meter
and Blossom Hill Elementary Schools. Prior to 2011, few children in the neighborhood walked, biked or scootered to school, or if
they did it was with vigilant parents watching out for their safety. Then Hillbrook put forth a request to amend their CUP, Hillbrook
traffic decreased, and walking, biking and scooting to school became safe and enjoyable. It would be a shame for parents in this
neighborhood to revert back to the days of driving to neighborhood schools because of unmitigated Hillbrook traffic making streets
unsafe. The Town prides itself on its robust SRTS program. Do not jeopardize this successful program at these local schools by
allowing an increase in unmitigated Hillbrook traffic to flow through our neighborhoods.

Dear Mayor Jensen and Council Members:
My wife Shannon and I are new residents of Los Gatos. We recently relocated here because we strongly
believe that Los Gatos is the best place for us to educate and raise our children. My daughter, aged six, is
currently a Kindergarten student at Hillbrook. My son, aged four, attends pre - school at Mulberry, and will be
attending Junior Kindergarten at Hillbrook in the Fall.
I attended the Planning Commission meetings where Hillbrook's application to modify our existing conditional
use permit was heard, and had the opportunity to listen to remarks from Hillbrook's neighbors at the
hearings. I've also read the neighbor's appeal of the Planning Commission hearing's decision.
Given that I'm a Hillbrook parent, it should come as no surprise to you that I'm writing in support of
Hillbrook's appeal of the Planning Commission's decision. I believe that the plan that Hillbrook presented to
the Planning Commission, and that was supported and recommended by Town Staff, represented a very
reasonable way to extend Hillbrook's enrollment by a modest 99 students at no incremental cost to Hillbrook's
neighbors in terms of additional traffic or environmental impacts. The restrictions that the Planning
Commission imposed on the modification of Hillbrook's CUP are unworkable for Hillbrook, and unfortunately
do not seem to have satisfied Hillbrook's neighbors either.
In particular, given that Hillbrook is already at an 880 trip per day average - -a reduction in traffic over
historical maxima which we were able to achieve through busing, carpooling, and undertaking a very significant
traffic impact awareness campaign across all of our families -- imposing an 880 trip per day maximum would
impair Hillbrook's ability to serve it's current students, much less an additional 99.
I can say without hesitation and in all sincerity that Hillbrook has been very sensitive to the concerns of the
Marchmont neighbors, and that the whole school, from the administration to the families, have spent a huge
amount of time and energy trying to respect and address the desire of the neighbors to have safe, uncongested
roads and a quiet, peaceful neighborhood. I believe that we have achieved that to a large extent, and I can tell
you from personal experience that Marchmont is far quieter, less congested, and transited by many more
conscientious and careful drivers, even at peak hours, than a great many residential neighborhoods in our
growing community.
You have a hard task before you. It is relatively obvious that members of the Marchmont community who
filed their appeal to the Planning Commission decision would rather that Hillbrook didn't exist. In their appeal
and their comments during the Planning Commission hearings it is equally clear that many of our neighbors see
Hillbrook and the Hillbrook Community as a duplicitous, almost villainous presence. We are not. We want the
same things that our neighbors want: to give our children a good education; to live in a quiet, peaceful
community; and for Los Gatos to continue to be a great place for families to live. In my humble opinion,
Hillbrook is a tremendous asset to Los Gatos, and we should collectively be trying to support it rather than
crippling it.
Please help us bring this to a close and support Hillbrook's balanced plan to expand its positive impact on Los
Gatos without incremental impact to its neighbors. Please help us avoid further escalation. We very much need
your help.

1. On page two in the last paragraph of my previously submitted Memorandum it-should read "Ten" and not "Twelve ".
2. The Hillbrook tuition is not $26,000. I've been informed it is actually $28,600.
3. Hillbrook's website indicates 2/3 of its students are from outside Los Gatos. Apparently the School now claims
46% of the students come from the Los Gatos area, which apparently includes Monte Sereno and Saratoga.
How many are from the Town itself is unclear.
4. My suggested preferred alternative of the two previously offered is no additional students allowed. The attachment
is supporting documentation for Hillbrook's exceeding the student maximum. I wanted to dig up, and actually review myself, the
School's submittals to the State. it is undisputed the School violated the Town's CUP maximum of 315 students.

Re: Hillbrook School Conditional Use Permit Violations- Over Enrollment
Gentlemen,
1 submit this letter as a Code Violation Complaint concerning the Hillbrook School's
violation of its current CUP Condition # 4, which states, "ENROLLMENT. The enrollment
shall be limited to 315 students."
Neighbors have long suspected that Hillbrook was in violation of its Enrollment Cap, but had
no way to police that. Neighbors recently discovered that California law (California
Education Code Section 33190) require s private schools offering or conducting a full -time
elementary or secondary level day school for students between the ages of 6 and 18 to file
a "Private School Affidavit" with the California Department of Education. A Private
School Directory website lists private schools that filed the animal Private School
Affidavit at: htto: / /www.cde.ca. ova /ds/si /s/
Above the electronic signature on the Private School Affidavit is the following statement,
"By submitting this form and the electronic signature attached hereto, I declare under the
penalty of perjury and the laws of the State of California that I am the owner or other head
of the school, and the inforntation contained herein is true, accurate, and complete."
For each school year since at least 2001 -02, Hillbrook School reported its enrollment numbers
for grades K to 8 to the State along with the total number of students enrolled in those grades.
Junior Kindergarten (JK) enrollment is not reported in the Private School Affidavit, but
there is a column in the Affidavit for "Ungraded" that appears, in some years, to contain
Hillbrook's JK counts.

Exhibit 1 is a table of the number students enrolled per year in Hillbrook's grades K
though 8, as reported by Hillbrook in its Private School Affidavits filed with the State
of California for school years 2001 -02 through 2013 -14. The Affidavits Hillbrook
submitted to the State from 2001 through 2013 are attached as Exhibits 2 - 14.
It appears that Hillbrook reported the number of its JK students for the years 2008 -09 and
2013 -14 in the "Total Ungraded" column of the Affidavit. Hillbrook's JK students are
otherwise not included in the totals.
According to Hillbrook's website describing the JK class, "Class size is limited to no more
than ten or I I students." However, in Hillbrook's 2013 Private School Affidavit, Hillbrook
reported that were 12 in the "Ungraded" column. In Hillbrook's report to the Town dated
January 10, 2014, there were 13 students in the JK class. In its 2008 Affidavit, Hillbrook listed
13 in the "Ungraded" column.
As reflected in Exhibit 1, Hillbrook exceeded its CUP Enrollment Cap for the 2006 -2007
and 2007 -2008 school years, even without its JK class included.
The 2008 -2009 count of 325 also exceeded the 315 limit, but it contained what looks to be
the JK count for that year in the Total Ungraded column.
If one presumes a JK count of 12 for each year Hillbrook did not include any students in
the "Ungraded" column, Hillbrook exceeded its 315 Enrollment Cap for the 2012 -2013
school Year and every other ear since 2001 except 2002 -2003.
Over ten years, Hillbrook enrolled 125 students more than its CUP maximum. At tuition of
more than $20,000 per child per year, Hillbrook garnered more than 2.5 million dollars due
to its violations.
All of this assumes that the numbers in Hillbrook's Private School Affidavits are reliable.
Unfortunately, there is evidence that even those numbers are unreliable and likely
understate Hillbrook's actual enrollment numbers, even though Hillbrook submitted its
Affidavits "under the penalty of perjury."
For example, in its 2010 -2011 Affidavit, Hillbrook stated that there were 20 students in its
80' grade class. However, in Mark Silver's letter to neighbors in the Spring of 2011, he
included a photograph of the 8th grade graduates reflecting that there were actually 31
students in Hillbrook's 8s' grade class in 2010 -2011. Exhibit 15.
Given that there is clear evidence that Hillbrook has routinely violated its CUP mandated
Enrollment Cap, the Town should immediately begin an enforcement action and require

that Hillbrook provide the Town with its actual enrollment records to document Hillbrook's
true enrollment numbers from 2001 - the present.'
Hillbrook has demonstrated that it cannot be relied on to comply with its CUP mandated
Enrollment Cap. The Town must take action to enforce Milbrook's CUP, as it would any
other ordinance of the Town. The routine nature of these violations indicates that they were
knowing and wilful.
Once the full extent of Hillbrook's over enrollment violations is known, given Hillbrook's
blatant and repetitive violations of its Enrollment Cap, the Town should impose a
substantial fine on Hillbrook to penalize Hillbrook for its past violations and to discouragc
future over enrollment violations. Given that Hillbrook has garnered at least 2.5 million
dollars of ill- gotten gain from these violations, the Town should impose a fine on Hillbrook
of a like amount'
In light of Hillbrook's blatant refusal to abide by its CUP mandated Enrollment Cap, the
Town should also deny outright Hillbrook's request for additional enrollment in its current
CUP application. In addition, in its new CUP, the Town should require that Mllbrook
supply the Town with its list of enrollees, by grade each year before the start of the
academic year, and include substantial penalties for non - compliance.
While I have heard that the Town is short on resources to enforce CUP's, the fines that
should be levied in this matter would more than cover the expense of enforcement.
Please contact me at your earliest convenience to advise me of the Town's plan to remedy
these violations.

I According to Town Planner Jessica Savage, the Town has not required Hillbrook to submit documentation or
proof to the Town of its enrollment figures since August 30, 2001. Neighbors requested that Ms. Savage require
Hillbrook to provide its enrollment figures from August 30, 2001 to the present, but the Planner declined to
require Hillbrook to do so. As a result of neighbors inquiries, the Town did request that Hillbrook supply the
Town figures regarding its current enrollment, which Hillbrook provided to the Town on January 10, 2014.

Thank you to those of you who attended the recent neighborhood meeting at Hillbrook. We
appreciated the opportunity to share with you our plans to build a better middle school. As
we discussed, the next step in the process is a traffic study, which will be completed by the
end of May. Our plan is to convene another neighborhood meeting once we get those
results, so that we can share with you details of the application we will be submitting to the
Town of Los Gatos to modify our conditional use permit. If you were unable to attend the
last meeting, or would like to learn more about our plans, visit our website at

It is hard to believe another school year is winding down! We wanted to let you know about
some upcoming events on campus and invite you to attend, if you would like:
Our annual Family Fun Night will take place this Friday, May 20, from
5:30- 8:30pm. All neighbors are invited to join us, free of charge, for this exciting
celebration of spring - which includes good food, carnival games, a hula hoop
contest and more! As in previous years, we will be running a shuttle from Faith
Lutheran Church in order to minimize the impact of traffic in the neighborhood.
You're also invited to join us for the annual Hillbrook Art Show. Opening night Is
Tuesday, May 31, from 5.7pm. Come view the collected works of our JK -8 students
from the past year. We know you'll be impressed! There is no charge for admission.
8th grade graduation takes place on Tuesday, January 7, from 9:30am -11am.
As with other events that involve significant parking on campus, we will have traffic
attendants available to ensure that people do not park in the neighborhood. If you've
never attended a Hillbrook graduation, they are a joyful and moving celebration of
our 8th grade class, filled with songs and heartfelt tributes.
Additionally, we are proud to be continuing our partnership with Breakthrough Silicon
Valley (BSV), an organization that works with motivated, high - performing, and yet
under- resourced middle schoolers from san Jose by providing them with a highly
academic summer program. We will be hosting BSV on our campus this summer, as
we did last year. The BSV students will be shuttled to campus to minimize traffic.
We will also be hosting our Hillbrook summer camps once again, beginning in June
and running through August. Rest assured, we will inform every camper of the traffic
rules on Marchmont and the need to be respectful of our neighbors when traveling to
and from camp. You can also expect to see traffic attendants standing along
Marchmont in the morning as a visual reminder to slow down and drive carefully. If
you have any concerns during the summer, please don't hesitate to contact our

As we've shared in previous newsletters, we hope to use them as a means of keeping you
informed about things that are happening at the school and ensuring that we keep the lines

I am writing in support of the Town of Los Gatos for thoughtfully thinking through the impacts of
Hillbrook's request to modify their conditional use permit. In reading through the DEIR, the Town's
independent study is comprehensive and concludes that there are no impacts associated with the CUP
modification. This DEIR is legally sound and thorough in its evaluation of impacts under CEQA. I
SUPPORT the findings of the DEIR that there are no significant environmental impacts associated with
Hillbrook's request.
In looking at the facts, it is easy to see that they have humbly approached the request with the town
and have followed all procedures. They have worked with the town, the neighbors and the school
community in a truly sincere way. With that said, the towns study clearly shows what we (the Hillbrook
community and neighborhood) have known all along - there are no impacts created by Hillbrook's
request to modify their CUP.
As a parent, with two young children that lives on Topping Way in the neighborhood, I can say that I
see the DEIR to be true. Only a few of the neighbors had concerns, which have been addressed by the
DEIR. Every aspect of traffic has been evaluated and comprehensively studied. None of the neighbors'
claims or allegations have been validated with actual data. In fact, it's just the opposite. The DEIR is a
fact based document that shows there are no impacts on the neighbors.
Please approve Hillbrook's request and allow it to be the full service school it has always been. With
your approval, Hillbrook will continue to be a model school for traffic in Los Gatos.

In light of the Town Council meeting on January 13, 2015, we are writing to urge you to thoughtfully consider
Hillbrook School's appeal of the Planning Commission's decision rendered on October 6, 2014. While we are
grateful our request to increase student count was approved, it was also clear their decision to impose strict
penalties and traffic restrictions rendered the approval disingenuous.
As fairly new Los Gatos residents and parents at Hillbrook, we are struggling to understand the message behind
the Planning Commission's decision. Initially, it took us some time to understand a neighborhood's reaction
against this school we love, and why we felt hesitant to visit the campus for normal school activities, something
we had never experienced at our old school when we lived in the Peninsula. Traffic was orderly there, but
much worse because no one carpooled or had use of a bus. We currently live near a school again and the usual
morning and events traffic occur just with any other school. So from our own experience alone we find it
interesting how Hillbrook is the only school of these three that we've seen who coordinates carpools and offers
bus service, but are treated as if no effort has been made to address neighbors' traffic concerns. We happily
carpool and have our child safely ride the bus than drive or walk through ANY queue for a school or any kind
of "attraction" that would normally draw a large amount of people for that matter. Hillbrook has worked
extraordinarily hard to mitigate traffic and yet it is astounding how it does not appear to be recognized. ALL
schools should be doing this! Instead, Hillbrook parents will be fined penalties for car count violations? We
can only imagine how that might be received elsewhere whether it be a school or business. An education
already does not come with a small price tag and we are not keen on any funds going toward traffic penalties
especially imposed by a high standard no other community member is subject to. Hillbrook's efforts should be
commended for reducing congestion, improving the environment and having safer transportation options for the
children. It is rather disturbing to think of a community not being supportive of an educational institution or
business making such efforts and achieving a standard few can all the while being beneficial to the community
as a whole.
Hillbrook recognizes the need for change just as many of us do in order to adapt to our ever - changing
environment. The CUP amendment seeks just that so as to ensure a thriving school that will educate the coming
generations to have a shot at a successful future in whatever shape or form our world will take. Not allowing
what contributes to making a community attractive and desirable to live in will slowly chip away at what makes
that town special and appealing. If this is how a highly recognized school is being treated in its own community
we are now concerned with what that means for all other businesses and institutions that may wish to come to
Los Gatos. What will our town become in the next few decades when change, which is imminent, and
infrastructure to support it is not encouraged? We are all familiar with the concerns of parts of the Hillbrook
neighborhood, traffic studies and the EIR, but please consider what is really at the heart of the matter. We see
the town folk among its own community struggling over conflicting interests. The decision you make will send
a very important message about how you see future change and growth. Consider that people will tend to move
residences more than an educational institution ever will and the influences between the two. The likes of great
California schools such as Stanford, UC Berkeley, Santa Clara University, UCLA, etc. have long histories and
have contributed to our state in ways that may have otherwise been quite different if they had not been
there. Education needs to be more highly valued in our culture and I hope you are able to recognize the high
standards Hillbrook has set, and to allow this school that has grown through the Great Depression and Second
World War to continue to flourish as part of Los Gatos' legacy and rich history.

As residents of Hilow Road and a neighbor who walks her children to school on Hilow, we are very concerned
over the proposed expansion of Hillbrook School. We have noticed that our street is a different street when
Hillbrook is not in session. For a glorious 1.5 week period before they start and the local elementary schools
are already in session, our street is much more enjoyable and neighborly. Once Hillbrook starts, we have to
deal with increased traffic and other safety issues. It can be like an obstacle course walking or biking with our
children to Van Meter down Hilow or up to Blossom Hill. It becomes particularly problematic when Hillbrook
parents drop their children off on our street and then U -turn. This creates a safety hazard for pedestrians,
bikers, and other cars. The one lane access at the end of our road it makes these practices even more
egregious. We have reached out to the Hillbrook traffic coordinator several times and nothing has changed.
We support the LGCATS appeal to limit Hillbrook expansion and in particular the clause about no pick up or
drop off on neighborhood streets. This has become an increasing problem ever since they filed for a different
CUP and negatively impacts our quality of life and the safety of all the children and people in our
neighborhood.

I am writing in SUPPORT of Hillbrook School's request to increase enrollment by 99 students.
My two children graduated from Hillbrook School in 2008. They began in middle school, which you know can be some
very difficult years in a child's life. I can honestly say that the unique environment at Hillbrook made those middle school
years a positive growth experience for them both, especially heading into high school. The school's nurturing and
enriching curriculum wasn't just in the classroom either.
My kids had the wonderful opportunity of numerous after - school activities and sports, many of which they were able to
try and enjoy for the first time. It would be a shame to see any of those programs cut.
I know that traffic was an issue during our years there but it is my understanding that a study by the Town of Los Gatos
has shown that the school has successfully reduced their traffic numbers. Unlike other schools in the area who disregard
their Conditional Use Permits, Hillbrook has respectfully followed the rules and worked very hard to protect the
Marchmont neighborhood. They are an asset to Los Gatos and the local community.

My name is Jennifer Hall. I am a current resident of Saratoga and a proud parent of a recent
Hillbrook grad and a current 6`h grader. 1 wanted to begin by thanking you for approving
Hillbrook's request to add an additional 99 students to our community. This will be highly
beneficial to Hillbrook's community. Unfortunately, the 880 maximum all day car count is
unreasonable. if we had an all day average of 880 instead of a cap, Hillbrook could comfortably
add these students without impacting the way our school functions without adding any new
traffic to the neighborhood. An 880 cap doesn't allow Hillbrook to function as a normal school
where parents can watch their child play football or basketball, or come to hear their children
sing or perform in a play. An 880 average accounts for heavier days and lighter days that are
part of any normal school month. I am writing to request that you change the cap to an average
daily car count.
My family and 1 moved to the area 6 years ago from Massachusetts. We spent our first year
living near downtown Los Gatos. It was a magical year for us. We are avid walkers and we
thrived on walking to town for dinners and shopping. Although we eventually bought our house
in Saratoga, we still feel that Los Gatos is our first home. We continue to love participating in
all of the "crazy" Los Gatos events that make this town so special. Halloween on Tate Street and
the Holiday parade are two such events that we wouldn't miss.
It was difficult for my kids to leave their school and friends in Massachusetts, but they fell in
love with Hillbrook the minute they stepped on campus. Our whole family loves the school. The
community is warm and welcoming. We feel so lucky to be a part of that community; that
smaller community within the larger community of Los Gatos. We feel so lucky to have found
both of these wonderful little pieces of utopia.
Of course, we have always carpooled at the request of our school. We follow the rules, and are
courteous to the neighbors. We recognize that we, Hillbrook and the neighboring homeowners,
are all so lucky to be part of the larger community of Los Gatos. Hillbrook feels this sense of
community with our neighbors and is trying to accommodate the neighbors and the town.
Unfortunately, it seems that Hillbrook has been faced with the car cap which is one of the
strictest requirements by our town; far stricter than required of any other school in Los Gatos.

My name is Vlado Herman. I currently am a member of Hillbrook's Board of Trustees, a
Hillbrook parent and a long -term resident of Los Gatos. My family moved to Los Gatos ten years
ago; we were attracted to the open- minded community that took pride in its downtown and place
in Silicon Valley history. We chose to live in the Almond Grove district for its downtown proximity
and park access. However, with this location we need to tolerate increased traffic from annual
events such as the Cat's Hill race and Halloween, in addition to daily traffic to St. Mary's School
and general Downtown activity. This balance is simply part of living in Los Gatos. We love the
vibrancy of downtown and the diversity of our shops, services and restaurants; we need the
inflow of non - residents to support our businesses and the daily ways of life in Los Gatos.
Our family recently completed a full restoration project that will serve as our home for many
decades to come. We have many Hillbrook families who reside in our neighborhood and utilize
the school bus to get our children to school every day, families who were attracted to Los Gatos
because of the wonderful public and private school options for their children.
It is unfortunate that of late fellow Los Gatos families are creating an us- versus -them campaign.
Hillbrook is one of many institutions that have made our town so special and what brings new
families to our town every year. I didn't move to Los Gatos to create an imaginary wall where
certain residents would not be welcome. Hillbrook was founded in 1935 as a boarding school for
wards of the state, and continues to foster an inclusive community.
We should ensure that Los Gatos remains a vibrant, open community that attracts wonderful
families of all backgrounds for generations to come. I hope we remain open- minded to positive
change at Hillbrook and elsewhere in Los Gatos.

The traffic generated by Hillbrook School is a contentious issue that has plagued the Marchmont Road
neighborhood for the past 15 years or more. It is time for a compromise that makes the traffic
measurable and predictable for the homeowners in this area. It also needs to allow Hillbrook to
maintain the character of the school which includes significant parent involvement in their children's
education. I'd like to outline a potential compromise based on the changes that the two parties have
requested to the existing CUP. I'll start with a list of the key points in the compromise and then follow
with detail on how each of these contribute to the compromise.
• Full daily car trip counts rather than peak hour exit counts
• Car trip limitations based on average counts
• Increase in the number of students to 414 with no increase in traffic
• Control and decrease of the traffic during the summer
• Outside auditing of traffic counts which are conducted every day
• No restrictions on who may be in a vehicle (e.g. outside educators, students from other schools)
• Limit of 880 cars trips on average per day, calculated 4 times during the school year
• Daily maximum limit of 1150 car trips
• Only days when the school is conducting full classes included in the average
• Summer limit of 440 average and 575 maximum car trips per day
• Financial penalty of $1000 per car for each violation of the average or maximum limits
The neighbors want a full day limitation on car trips rather than a peak hour limitation since they are
potentially impacted by traffic for the entire day. Hillbrook would like any limitation to be for an
average number of cars, not a maximum, since the amount of car traffic to the school is variable. There
are fewer cars on sunny days when some students walk and ride their bikes and more cars when it is
raining. Some days have parents coming to the campus to see their student playing an after school
sport. Other days there are no sports. Both the requests for an average count and a full day count are
reasonable and should be adopted.
Hillbrook has requested an increase in the number of students in order to provide a better education
and social experience for the students in grades 6 -8. While Hillbrook initially requested an
approximately 10% increase in traffic, they have agreed to no increase in traffic if this request is
granted. The neighbors want a limitation in traffic for the summer and for that limitation to be less
than during the school year. Both of these requests are reasonable and do not add any additional
traffic to the neighborhood, and in fact will control and lessen the traffic during the summer.
The neighbors want outside auditing of the car trip counts every day, not just two designated periods
during the school year. They also want severe financial penalties if the car counts are exceeded.
Hillbrook wants to be able to conduct its business of educating students without undue restrictions on
what it can do, other than keeping the count of car trips below the agreed upon average value. With
outside auditing and financial penalties, the neighbors will enjoy predictable levels of traffic and there
is no need for restrictions on who might be in those cars (students, teachers, outside educators,
parents, students from other schools, etc.)
The neighbors would like the traffic to and from Hillbrook to be decreased from current levels. The
proposed levels from some of the neighbors are so low they would result in parent access to the
campus being limited to carpooling their children to school. There is no room in these proposals for
driving to the campus to volunteer in the classroom mid -day or see a basketball game in the afternoon.
Hillbrook would like no limitations on car trips so it could go about its business without having to worry
about how many car trips each activity at the school might generate. Neither of these extremes are
realistic given the situation. My proposed compromise is that the car trips be limited to the current
level — no increase and no decrease.
So how do we establish that level? We need to first understand the restrictions of the current CUP that
Hillbrook has been operating under for the past 13 years. Hillbrook is restricted to a maximum of 165
car exits from the campus during each of two designated approximately one hour periods — one during
the morning and one during the afternoon. There are no other restrictions. We need to translate that
number into the number of car trips in and out of the campus for the new measurement system. 165
exits in the morning translates into 330 car trips, and the same is true for the afternoon. Thus the
current CUP allows for 660 car trips during those two periods. Teachers and staff need to arrive before
the students and leave after them. With approximately 70 teachers and staff, that is another 140 car
trips, for a total thus far of 800. But allowances also need to be made for parents volunteering in
classrooms, parents attending their child's after school sporting event, the postman, UPS driver, food
delivery trucks for the school cafeteria, etc. We can easily see that the 880 car trip maximum proposed
by the Planning Commission is not feasible for the current level of enrollment at Hillbrook since it only
allows for 40 additional cars (80 car trips) to access the campus the entire rest of the day.
So what should the number be? A compromise would be to limit the number of car trips to the daily
average of 880 that was measured by the town around the time this revised CUP process began several
years ago. The neighbors will not be subjected to any increase in traffic and Hillbrook can continue to
operate the school without imposing limitations on parent involvement that would significantly change
the character of the school. However Hillbrook will have to accommodate the additional restrictions of
all day counts, financial penalties and reduced summer traffic imposed by the revised CUP.
If there is the desire to also impose a daily maximum car count, it needs to be high enough to allow for
parents to attend school events. I propose 1150 as the maximum, which is 30% above the average.
Keep in mind that if Hillbrook experiences a day with 1150 car trips, they will need to have a day with
610 car trips or 27 days with 870 car trips in order to maintain the daily average at 880 or below.
How should the average of the daily total car trip counts be calculated? First, it needs to be averaged
over a long enough period that if there is a week of rainy days that result in 100 more daily car trips
from 25 families who normally walk or bike to school that Hillbrook doesn't incur financial penalties.
And it needs to exclude abnormally low car count days such as "teacher in service' days when most of
the students are not on campus. Fortunately these days are predictable and can be found on the
annual school calendar. I propose that the average be calculated 4 times during the school year, and
that each period contain at least 30 "normal" school days in the count.
During the summer the car trip allowances would be halved: 440 average and 575 maximum. Only days
when Hillbrook was conducting a summer program would be included in the count and the average
would be for the entire summer period.
The financial penalties need to be high enough to ensure that Hillbrook is managing its car count on an
ongoing basis. The proposed number of $1000 per car certainly seems high enough, if not excessive.
This penalty would be imposed for both single day violations of the 1150 maximum and average car
count violations during any of the 4 periods used to calculate the average daily count. For example, if
there were 1200 car trips on a particular day Hillbrook would be fined $50,000. And if the average daily
count for one period was 900 car trips they would be fined $20,000.
The nature of compromise is that no party gets everything they want. But by including the most
important requests from each party in the final agreement, there is the chance to satisfy the majority
of the people involved. Hopefully making the traffic around Hillbrook more predictable and subject to
outside audits and fines will over time lessen the contentiousness that has plagued this neighborhood
for too long.

While I currently reside in Saratoga, I own a rental home in Los Gatos, and my family moved to Los Gatos in 2000, so our
children could be closer to Hillbrook. We have 2 children who are Hillbrook alumni who are both in college: one
studying at the Boston Conservatory and one studying at the University of the Arts in Philadelphia. Hillbrook provided
our children with a strong, well- rounded education that prepared them for success at both Bellarmine and Mitty high
schools and in college. My son discovered his love for performing in the 8th grade play, which eventually led him to
BoCo.
While there, my kids religiously carpooled with at least one other family, so our car always had at least 3 children in it, to
respect the neighborhood. I have never seen a school go to such great lengths to respect its neighbors.
The environmental impact report shows no negative impact from the proposed school expansion, so the town council
should approve it.
Hillbrook is an asset to the town of Los Gatos. Let it thrive.

I am not a Los Gatos Resident, nor parent of a child at Hillbrook.
I grew up and reside in Saratoga, making me a cousin of Los Gatos.
I am passionate about this area as I am native to it.
I am a former business owner in Los Gatos, which moved to Campbell.
Hillbrook is an institution that sets Los Gatos apart from Saratoga and other cities.
It has a long and exemplary reputation and history in this area. I am still jealous of my Los Gatos friends who had the
opportunity to attend Hillbrook.
Growth for any business, Town, school or University is important.
Hillbrook has clearly displayed a strong and unyielding ability to work with neighbors, which is predates by decades, the
town and parents of students to address community concerns.
I strongly urge the Town to work with Hillbrook and provide them with their request on the expansion of their conditional
use permit.
Denial, to me, would be viewed as the City's alignment with the few that have vocalized selfish demands. This alignment
is neither beneficial for the City's goals nor mutually beneficial for anyone but neighbors who bought a home near a school
that was already there.
The reverse would be like Hillbrook asking the neighbors to NOT have more children as that would cause more traffic to
the neighborhood and Hillbrook.

The FACTS...
Hillbrook is bringing way too many can and trucks into our neighborhood.
They come via Los Gatos Boulevard. Los Gatos Blvd. is getting more and more traffic due to overdevelopment.
The parents get fmstmted and cut through on any street to avoid the congestion on LG Blvd. Many take Fillmer Ave. to avoid the stoplight at Kennedy
Rd. They take Stoneybrook, Hilow, etc.
They all end up on a dead -end street that was not designed for this many vehicles.
OR, they drop their kids part way into the school so that they board a bus in an unsafe manner causing congestion in a different location.
Or, they drive part way and let their kids walk up Marchmont on a poorly designed unsafe curving road with no sidewalks.
This, all to reduce the number of trips counted on Marchmont.
SOLUTION:
Distribute half of the traffic to the only safe and sane entrance.... Ann Arbor Way.
Ann Arbor is straight, wide, and has sidewalks. It comes directly from Shannon Rd. which can be adequately managed.
It is up to the Town of Los Gatos to keep Hillbrook kids and our kids safe. Do the right thing and deny Hillbrook's request to increase enrollment. Ensure
that the school abides by the provisions of the 2001 CUP. Our residents expect all CUP's to be enforced. This is the job of the Town Council and its staff.

Good evening. My name is Barbara Dodson and I live on Marchmont Drive.
Please reject Hillbrook's application for more students. Furthermore, please begin
administrative proceedings to open up the current CUP with the goal of clarifying its intent and
provisions.
However, if you decide to move forward with the Hillbrook application, please stick with the use
of strict traffic limits. Don't agree to averaging. Hillbrook is perfectly capable of keeping its
traffic below 781 daily trips. It just has never tried. If Hillbrook requires full participation in a
mandatory traffic management program and plans for days with large activities, it can easily
meet the 781 normal goal and the special -day goal of no more than 1,000 trips.
Averaging is not an "industry norm." It's a norm for analyzing projects, but in general, schools
use limits. Harker uses limits. Menlo School uses limits. So do the Archer School and Woodland
Hills in southern California. Crystal Springs in Belmont offered to use limits when it applied for
a new facility.
The one school we know of that does use averaging, the Bentley School, has had endless
problems. Neighbors have filed numerous complaints. Instead of focusing on reducing car trips,
the school focuses on "gaming the averages." We want a system that works, not a system that
continues to create problems between the school and neighborhood.
Here are other reasons to reject averaging.
1. Setting a limit encourages ongoing, daily traffic mitigation. Averaging encourages a
school to look for loopholes, exceptions, and work - arounds.
2. Averaging creates uncertainty. Residents would like to know what kind of traffic to
expect from day to day and therefore want absolute daily limits.
3. Averaging subjects residents to an impaired residential zone approximately half the time.
4. Averaging overburdens the Town's resources by creating an overly complicated system.
The simple approach —at 781 you are in compliance, at 782 you are NOT — allows for
much easier enforcement.
5. Averaging will res%lt in extreme levels of traffic that are then balanced by carefully
orchestrated days of low traffic, just to achieve the average.
If you decide to move forward with Hillbrook's application, please also take the time to look at
the Ann Arbor option. It's unfair to ignore this as Planning Commission did. You can't force
Hillbrook to use Ann Arbor as it should be used — for pedestrians and bicyclists and for some
vehicle traffic. But you CAN create a condition stating that the Ann Arbor access is open to
pedestrians, bicyclists, and vehicles IF Hillbrook chooses to use it. If it's necessary to have a
study of the impact of opening this access, please ask for the study. This time, do what is right.
Do what is fair. Do what makes the neighborhood safer as a whole.
If the current administration doesn't want to use this access, so be it. But to keep traffic at a
normal level on the Marchmont side, please limit traffic at the Marchmont gate to 481 daily trips.
This combined with our normal street traffic of 324 keeps our street from becoming a severely
impacted residential environment. I ask that you uphold the General Plan, recognize that
Hillbrook's impacts need to be limited, and that your priority should be to help us retain the low
density residential nature of our neighborhood.
