WHEREAS, the Planning Commission considered the applications on February 26, <br />2014, and voted to approve the Conditional Use Permit and Architecture and Site applications, <br />making required findings and subject to conditions of approval (Exhibit A) and development <br />plans (Exhibit B); and <br />WHEREAS, the appellant appealed the decision of the Planning Commission based on <br />his belief that the Planning Commission erred in its decision because the Council should consider <br />applicable standards and guidelines relative to the applications and the context of the <br />neighborhood; and <br />WHEREAS, the Council has determined that the Planning Commission did not err in its <br />decision in that the proposed office building is appropriately located on the site with the <br />increased front setback, is consistent with the Commercial Design Guidelines, and will enhance <br />the Los Gatos Boulevard streetscape. <br />NOW THEREFORE, BE IT RESOLVED, that the appeal of the decision of the <br />Planning Commission on Conditional Use Permit application U -13 -020 and Architecture and <br />Site application S -13 -050 is hereby denied and the approval stands. <br />BE IT FURTHER RESOLVED, the decision constitutes a final administrative <br />decision pursuant to Code of Civil Procedure section 1094.6 as adopted by section 1.10.085 of <br />the Town Code of the Town of Los Gatos. Any application for judicial relief from this decision <br />must be sought within the time limits and pursuant to the procedures established by Code of <br />Civil Procedure section 1094.6, or such shorter time as required by State and Federal Law. <br />
