AUTHORIZE THE TOWN MANAGER TO EXECUTE A CONSTRUCTION CONTRACT WITH JOS. J. ALBANESE INC. IN- AN AMOUNT NOT TO EXCEED $138,836. B. AUTHORIZE STAFF TO EXECUTE FUTURE CHANGE ORDERS TO THE CONSTRUCTION CONTRACT AS NECESSARY IN AN AMOUNT NOT TO EXCEED $15,000. C. AUTHORIZE A BUDGET ADJUSTMENT IN THE AMOUNT OF $14,000 FROM THE STREET REPAIR AND RESURFACING PROGRAM 411 -811- 9901 TO THE LIVE OAK MANOR PARK ADA UPGRADES PROJECT. RECOMMENDATION: 1. Authorize the Town Manager to execute a construction contract with Jos. J. Albanese Inc. in an amount not to exceed $138,836. 2. Authorize staff to execute future change orders to the construction contract as necessary in an amount not to exceed $15,000. 3. Authorize a budget adjustment in the amount of $14,000 from the Street Repair and Resurfacing Program 411 -811 -9901 to the Live Oak Manor Park ADA Upgrades Project. BACKGROUND: The adopted FY 2012/13 — 2016/17 Capital Improvement Program (CIP) Budget designates funds for improving the condition of Town parks and facilities and is consistent with the Town's goals to improve the quality of public infrastructure in Los Gatos. The Town has undertaken a wide range of projects over the past few years to improve the condition and quality of Town parks. This park has frontage roads on Lester Lane and Carlton Avenue with a gravel pathway between the streets. This pathway is not currently ADA accessible which creates a hardship for disabled individuals wishing to use it. In addition to the pathway, the lighting system at this park is in need of repair and replacement, due to its age and past deferred maintenance. The proposed project will improve Live Oak Manor Park by grading and paving this pathway with asphalt, replacing park lights and electrical conduits, and reconstructing and paving the basketball -court. At the regular Town Council meeting held June 18, 2012, the Council approved plans and specifications for this project and authorized staff to advertise the project for bids. On July 18, 2012, one bid was received for this project (Attachment 1). Staff reviewed the bid and determined that Jos. J. Albanese Inc. is a responsible entity and is the most responsive to the Town's formal bid process. CONCLUSION: Staff recommends that the Town Council authorize the Town Manager to execute a construction contract in an amount not to exceed $138,836. Additionally, due to the variables associated with this particular type of construction and to address unforeseen circumstances that may occur during the project, staff recommends that the Town Council authorize staff to execute future change orders to the construction contract as necessary for work not in the original base bid, in an amount not to exceed $15,000. Further, staff recommends a budget adjustment is made in the amount of $14,000 from the Street Repair and Resurfacing Program 411 -811 -9901 to the Live Oak Manor Park ADA Upgrades Project. ENVIRONMENTAL ASSESSMENT: This is a project as defined under CEQA but is Categorically Exempt (Section 15301c). A Notice of Exemption will not be filed.
