ORDINANCE AMENDING SECTION 23.6 OF THE TOWN
CODE TO INCREASE DOLLAR LEVEL FOR FORMAL
BID REQUIREMENTS
The Town Council of the Town of Los Gatos hereby ordains:
Section 1
Section 23.6 of the Town Code is hereby amended to read as follows:
" Section 23.6. Use of bidding procedures required; exceptions.
When the expenditure required for the purchase of equipment,
materials, supplies and services exceeds four thousand ($4,000.00) dollars,
such purchases shall be contracted for and let to the lowest responsible
bidder after notice pursuant to sections 23 -9 and 23 -10. Purchases which
do not exceed the amount above - specified shall be made by the purchasing
agent only after an informal investigation of the sources of supply for the
purpose of ascertaining the lowest price for which the commodities desired
can be acquired.
"The letting of purchases to the lowest responsible bidder pursuant
to sections 23 -9 and .23 -10 may be dispensed with when:
(a) The town council or the purchasing agent finds that an
emergency requires that an order be.placed with the nearest available
source of supply.
(b) The purchasing agent finds that the commodity can be obtained
from only one vendor, or when the purchase is to be made through a county or
other public agency.
(c) The town council finds that because of the uniqueness or
special characteristics of the commodity, it would be more advantageous to
the town to purchase by negotiated bid. (Ord. No. 877, §6; Ord. No. 980, §l.)"
Section 2
This ordinance takes effect 30 days after the date it is adopted. Within
15 days after this ordinance is adopted, the Town Clerk should cause it to be
published once in a newspaper of general circulation published and circulated
in the Town.
This ordinance was introduced at a regular meetinq of the Town Council
of the Town of Los Gatos on August 1 , 1983 , and adopted by the
following vote as an ordinance of the Town of Los Gatos at a regular
meeting of the Town Council on Aug 1 1983
