Ord 1570 - AMENDING ARTICLE I OF CHAPTER 14 OF THE TOWN CODE TO UPDATE THE REQUIREMENTS ON GARBAGE DISPOSALORDINANCE NO. 1570 ORDINANCE AMENDING ARTICLE I OF CHAPTER 14 OF THE TOWN CODE TO UPDATE THE REQUIREMENTS ON GARBAGE DISPOSAL The Town Council of the Town of Los Gatos hereby ORDAINS: SECTION 1. Section 14 -2 of the Town Code is repealed, and the following substituted its place: " Sec. 14 -2 . Determinations. Pursuant to Government Code §66757, the Town hereby makes the following determinations: (a) The following aspects of solid waste handling are of local concern: frequency of collection, means of collection and transportation, level of services, charges and fees, and nature, location, and extent of providing solid waste handling services. (b) The public health, safety and well -being require that solid waste handling services be provided by a wholly exclusive franchise, without competitive bidding. The terms of said franchise shall be set forth in a franchise agreement approved by resolution of the Town Council." SECTION 2. Section 14 -4 of the Town Code is amended to read as follows: " Sec. 14 -4 Disposal by town - with Solid Waste Management Plan required (a) Except as otherwise expressly provided in this chapter, it shall be unlawful for any person to dispose of his garbage and rubbish, except through the services provided by the town, its agents, servants, or employees, or by persons who shall contract with the town to gather and collect and to dispose of such garb I e and rubbish. "(b) Any person who collects and disposes of garbage and rubbish in the town shall do. so in compliance with the Solid Waste Management Plan approved by resolution of the Town Council." SECTION 3. Section 14 -7 of the Town Code is amended to read as follows: " Sec. 14-7 Same - Size, material, etc. (a) The receptacle required by the preceding section shall be water- tight, equipped with a close fitting cover, provided with handles and of a capacity not le$5 than five nor more than thirty -two gallons, and made of either galvanized iron or sturdy plastic material. (b) Larger receptacles, such as drop -off boxes, may be utilized under terms and conditions prescribed in regulations approved by resolution of the Town Council." SECTION 4. This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted, the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. - 2 This ordinance was introduced at a regular meeting of the Town Council of the Town of Los Gatos on February 22,1983, and adopted by the following vote as an ordinance of the Town of Los Gatos at a regular meeting of the Town Council on March 7, 1983• AYES: COUNCILwMEMBERS Terrence J.
