Ord 1563 - AMENDING VARIOUS SECTIONS OF THE TOWN CODE TO CONVERT MISDEMEANORS TO INFRACTIONSORDINANCE NO. 1563 ORDINANCE AMENDING VARIOUS SECTIONS OF THE TOWN CODE TO CONVERT MISDEMEANORS TO INFRACTIONS The Town Council of Los Gatos hereby ORDAINS: gRf"TTMT 1 Section 1 -7 of the Town Code is amended to .read as follows: "Whenever in this Code, or in any other ordinance of the Town, or in any rule, regulation or order issued or promulgated pursuant thereto, any act is prohibited, or is made or declared to be unlawful, or an offense, or the doing of any act is required, or the failure to do any act is declared to be unlawful, where no specific penalty is provided therefor, the violation of any such provision shall constitute an in- fraction, and the penalties therefor shall be those specified by Govern- ment Code Section 36900(b). Where a violation is specifically declared to be a misdemeanor, it shall be punished by a fine not exceeding five hundred dollars, or the imprisonment.for a term not exceeding six months, or by both such fine and imprisonment. Any violation, whether infraction or misdemeanor, may also be redressed by civil action." SECTION 2. Section 4 -57(b) of the Town Code is amended to read as follows: "(b) Any person who continues to conduct a bingo game after notification of a surnnary suspension of a permit under the provisions of subsection.(a) is guilty of an infraction." _qW.77nm 11 Section 8 -11 of the Town Code is amended to read as follows: "Sec. 8 -11. Violations It shall be unlawful and a misdemeanor for any person, during an emergency, to: "(a) Wilfully obstruct, or hinder or delay any member of the emergency organization in the enforcement of any lawful rule or regula- tion issued pursuant to this chapter, or in the performance of any duty imposed upon him by virtue of this chapter. (b) Do any act forbidden by any lawful rule or regulation issued pursuant to this chapter. (c) Wear, carry or display, without authority, any means of iden- tification specified by the emergency agency of the state." This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted, the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. The foregoing ordinance was duly introduced at a regular meeting of the Town.
