AN ORDINANCE OF THE TOWN OF LOS GATOS
REPEALING ORDINANCES DUPLICATING STATE
LAW, AND AUTHORIZING THE TOWN COUNCIL
TO PROHIBIT OR RESTRICT SMOKING AT
TOWN MEETINGS.
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS FINDS:
Sections 17°6 and 17 -7 of the Los Gatos Town Code duplicate
Sections 415 and 417 of the Penal Code of the State of California,
and the subject matter of such Town Code sections is preempted.

THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN:
SECTION 1.
Sections 17 -6 and 17 -7 of the Los Gatos Town Code are hereby
repe ale d..
SECTION 2.
Section 17 -6 is added to the Los Gatos Town Code to read:
Sec. 17 -6. The Town Council may by resolution prohibit
or restrict smoking at any public meeting held at the
Town Civic Center. Such resolution or resolutions
shall describe the specific nature of the prohibition
or restriction, which shall be effective when clearly
legible notices stating the prohibition or restriction
have been posted at the location or locations to which
each resolution applies. Smoking in violation of such
posted notice is a violation of this Code, and refusal,
after request, to discontinue such violation is grounds
for requiring the smoker to leave any location where
smoking is then prohibited.
SECTION 38
of Los Gatos shall cause this Ordinance to be published once within
fifteen days after its adoption, in the Los Gatos Times-Saratoga
Observer, a newspaper of general circulation, published and
circulated in the Town of Los Gatos.
