Ord 1261 - ADOPTING BY REFERENCE, WITH CHANGES, DIVISION B4 (ANIMALS AND FOWL) OF THE COUNTY OF SANTA CLARA ORDINANCE CODEORDINANCE NO. 7 - - ORDINANCE OF THE TOWN OF LOS GATOS, ADOPTING BY REFERENCE, WITH CHANGES, DIVISION B4 (ANIMALS AND FOWL) OF THE COUNTY OF SANTA CLARA ORDINANCE CODE THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS: SECTION 1. Sections 5 -1, 5 -2, 5 -2.5, 5 -3 and 5 -7 of the Code of the Town of Los Gatos are repealed. SECTION 2. Section 5 -1 is added to the Code of the Town of Los Gatos to read: SEC. 5 -1 ADOPTION OF DIVISION B4 OF COUNTY ORDINANC Division B4 of the County of Santa Clara Ordinance Code, Animals and Fowl as derived from County Ordinances NS- 600.8, NS -600.9 and NS- 600.91, and as modified by this ordinance, is adopted by reference. SECTION 3. Section 5 -2 is added to the Code of the Town of Los Gatos to read: SEC. 5 -2 MODIFICATIONS For the purpose of adoption by reference as a Town ordinance, Division B4 of the County of Santa Clara. Ordinance Code is modified in the following respects: -1- V e— Sec. B4 -1 subdivision (g) is amended to reads (g) Kennel Any building, structure, enclosure or premises where more than two dogs or more than three cats, except dogs or cats less than four months of age, are kept. Sec. B4m2 is amended to read: SEC. B4 -2 CHAPTER [chapters I-IV3 /4] NOT TO REGULATE USE OF LAND This chapter [chapters I ®IV3 /4] is not intended to regulate the use of land. The Zoning Ordinance of the Town of Los Gatos regulates the number and types of animals which may be maintained in various zoning districts. Nothing in this chapter [chapters I-IV3 /4] is intended to supersede the provisions of the Zoning Ordinance of the Town of Los Gatos. Section B4 ®9 is amended to read: SEC. B4 -9 . ANIMAL IN TOWN BUILDINGS No person having the control or care of any animal or animals, with the exception of persons having defective eyesight who use a, dog for guidance, shall suffer or permit such animal to enter or remain in Town -owned or managed buildings other than a building used for the purpose of _2® care, detention, or treatment of animals or a. building used for training classes, shows or exhibitions. Section 84 -38 is amended to read: SEC. 84 -38 MAXIMUM NUMBER OF DOGS OR CATS No person shall keep or harbor more than two dogs four months of age or older or more than three cats four months of age or older upon any premises without first obtaining a kennel permit from the County Health Officer. Section 84 -105 through section B4 -114 are deleted. SECTION III. Penalty. Any person who violates any provision of Division B4 of the County of Santa Clara Ordinance Code, adopted by reference and modified by this ordinance, is guilty of a misdemeanor punishable by a fine not to exceed $500 or by imprisonment not to exceed six months or both. SECTION IV. This ordinance shall take effect and shall be in force thirty (30) days after the date of its adoption. The Town Clerk of the Town of Los Gatos shall cause this ordinance to be published once within fifteen (15) days after its adoption, in the Los Gatos Times - Saratoga Observer, a newspaper of general -3- circulation, published and circulated in the Town of Los Gatos. The above and foregoing ordinance was duly and regularly introduced at a regular meeting of the Town Council of the Town of Los Gatos held on the 18th day of August 1975.
