Ord 1273 - AMENDING THE ZONING ORDINANCE OF THE TOWN OF LOS GATOS ADDING CONDITIONALLY PERMITTED USES IN THE CC ZONEy ORDINANCE NO. 1273 ORDINANCE AMENDING THE ZONING ORDINANCE OF THE TOWN OF LOS GATOS ADDING CONDITIONALLY PERMITTED USES IN THE CC ZONE THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDAINS AS FOLLOWS: SECTION 1. Section 12.5 of the Zoning Ordinance of the Town of Los Gatos is amended to read: SEC. 12.5 USES P ERMITTED BY CONDITIONAL USE PERMIT The following uses are permitted, provided that a valid Conditional Use Permit for such use is in full force and effect: a. Automobile service stations. b. Domestic laundry. c. Multiple family dwellings, and residential condominiums subject to the development standards for the RM Zone. A tentative subdivision map of a residential condominium shall not be approved until the residential condominium has been authorized by a conditional use permit and received Architecture and Site approval. d. Apartment hotels, hotels and motels. e. Private schools. f. Nursery schools, provided that each shall be on a site not less than 20,000 square feet in area and in a building not less than 2,000 square feet in floor area. -1- g. Sporting goods shop. h. Dental laboratory. i. Outdoor dining areas, when operated by and as an addition to an on -sale restaurant. j. Quasi - public buildings and uses such as church, fraternal, scouting, Red Cross, Campfire Girls, and the like, except missions or revival halls or tents. k. Public utility stations, transmission lines, storage tanks, drainage ways and the like when found by the Committee to be necessary for the public health, safety and general welfare. 1. The sale at retail of packaged foods or non - alcoholic beverages for consumption off of the site by a restaurant which is designed in accordance with the standards set forth in Section 3.71.2 as an on -sale restaurant. m. Candy store, soda fountain, and ice cream parlor. n. Supermarket. o. Shoe repair shop. p. Retail business establishment. q. Printing and publishing business. r. Personal service establishment entirely within enclosed buildings. s. Tailor shop. t. Retail dry cleaning establishments (provided that the solvents used shall be non - flammable, non - explosive and are in fluid -tight units approved by the State Fire Marshal) . U. Interior decorator's service. V. Limited repair services conducted entirely within enclosed buildings, such as jewelry, domestic appliance, typewriter and business machine repair shops. W. Business services, such as advertising, credit reporting, accounting, telephone services, consulting agencies, stenographic and duplicating services, messenger and telegraph offices, taxi stands. x. Wholesaling without stock where storage of merchandise is limited to samples only. y. Home equipment rental establishments. Z. Club, lodge. aa. Movie theater. bb. Parking lot and storage garage for autos. CC. Park, plaza and playground. dd. Artist studio, such as sculpture, painting, pottery, etc. ee. Medical and dental clinic and laboratory. ff. Research laboratory. gg. Establishments selling alcoholic beverages for consumption on the premises. -3- hh. Vocational and specialized school and parochial school. ii. Commercial recreation establishment, including, but not limited to, bowling, ice and roller skating, auditoriums, and sport arena. jj. Undertaking establishment. kk. Public transportation facility, excluding storage. 11. Outdoor sales areas, such as a market square, for the marketing at retail of various products other than food or beverages. mm. Hall. nn. Limited food processing with retail outlets on the premises. oo. Pet shop and dog wash. pp. Other uses similar to the uses permitted in a CC Zone and compatible with the concept of a Civic Center Zone, except drive -in restaurants. SECTION 2. This ordinance shall take effect and shall be in force thirty (30) days after the date of its adoption. The Town Clerk of the Town of Los Gatos shall cause this ordinance to be published once within fifteen (15) days after its adoption, in the Los Gatos Times- Saratoga Observer, a newspaper of general circulation, published and circulated in the Town of Los Gatos. The above and foregoing ordinance was duly and regularly introduced at a regular meeting of the Town Council of the Town of Los Gatos held on the 20th day of Octo 1975.
