SECTION i That an amendment to the Contract between the TOWN

The Board of Adminirstration Public Employees' Retirement System hereinafter
referred to as Board and the TOWN 00UNCIL of the TOWN OF LOS GATOS, hereinafter
referred to as Public Agenay having entered into aontract under date of March 1
1972 effective April 1, 1972 and as amended effective August 1p 1972, which
provides for participation of Public Agency in said Systom Board and Public
Agency hereby agree as followst
A. The exclusion in Paragraph 3 of said contract shall be amended to read
a follows
EXCLUDE ALL PERSONS EMPLOYED ON OR PRIOR TO OONTRACT DATE
WHO WERE KWERS OF THE LOCAL SYSTEM EXORPT THOSE IN MIPLOY.
BENT ON CONTRAOT DATE WHO- WAIVED THEIR RIGHTS UNDER THE
LOCAL SYSTEM.
B. This amendment shall be attached to said contract and shall become
