Ord 1305 - AMENDING CHAPTER 33 OF THE TOWN CODE CONCERNING PRIVATE PATROLSr�� ORDINANCE NO 1305 ORDINANCE OF THE TOWN OF LOS GATOS AMENDING CHAPTER 33 OF THE TOWN CODE CONCERNING PRIVATE PATROLS THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES ORDAIN AS FOLLOWS: SECTION 1. Section 33 -1 of the Town Code of the Town of Los Gatos is amended to read: SEC. 33 -1. DEFINED "Private Patrol" shall mean the business of providing a night watch service, private security officer, or any other occupation, the purpose of which is to afford additional police protection for hire or consideration. This article shall not apply to any business primarily operating an armored car service for transporting money or other valuable personal property under guard, or to any individual working for a single employer in a line of business other than defined herein. SECTION 2. Section 33 -2 of the Town Code of the Town of Los Gatos is amended to read: S EC. 33 -2 NOTICE OF INTENT TO CONDUCT BUSINESS No person, firm or corporation shall engage in the business of maintaining or operating a Private Patrol within the Town of Los Gatos without first filing a notice of intent to conduct business with the Chief of Police. -1- SECTION 3. Section 33 -3 of the Town Code of - the Town of Los Gatos is amended to read: SEC. 33 -3. CONTENTS OF NOTICE Notice shall be filed with the Chief of Police (on a form approved and provided by the Chief of Police) and shall include the following: 1. The name, residence and business address including telephone numbers of the applicant. 2. The name under which the business is to be operated. 3. A complete description of the services to be provided. 4. A photocopy of a current and valid license issued by the State of California Department of Consumer Affairs to the applicant. SECTION 4. Section 33 -4 of the Town Code of the Town of Los Gatos is amended to read: SEC. 33 -4. PRIVATE PATROL UNIFORM, INSIGNIA AND VEHICLES The Chief of Police may prescribe reasonable rules and regulations concerning the uniforms and insignia worn by uniformed employees of a private patrol operator and vehicles used by a private patrol operator to ensure the uniforms and vehicles are clearly distinguishable from the uniforms worn by and the vehicles used by local regular law enforcement officers. -2- SECTION 5. Section 33 -5 of the Town Code of the Town of Los Gatos is amended to read: SEC. 33 -5 UNIFORM, INSIGNIA AND VEHICLE RULES, MANDATORY It shall be unlawful for any private patrol operator or any employee of a private patrol operator, while engaged in private patrol activities in the Town of Los Gatos, to wear a uniform or insignia or use a vehicle except in compliance with those rules and regulations promulgated by the Chief of Police, a copy of which shall be filed for use and examination by the public in the Office of the Town Clerk. SECTION 6. Sections 33 -6, 33 -7, 33 -8, 33 -9, 33 -10, 33 -11, 33 -12, 33 -13, 33 -14 and 33 -15 of the Town Code of the Town of Los Gatos are repealed. This ordinance shall take effect and shall be in force 30 days after the date of its adoption. The Town Clerk of the Town of Los Gatos shall cause this ordinance to be published once within 15 days after its adoption, in the Los Gatos Times - Saratoga Observer, a newspaper of general circulation, published and circulated in the Town of Los Gatos. JOHNSON CHIEF OF POLICE Subject: UNIFORM AND VEHICLE REGULATIONS: PRIVATE PATROL OPERATORS March 31, 1978 Pursuant to Section 33 -4 of the Town Code, the following regulations govern uniforms, insignia and vehicles of private patrol operators: I. UNIFORMS A. Color Any uniform worn shall be sage gray or dark brown in color. This department will recognize exceptions approved by the Sheriff of Santa Clara County which are not likely to be confused with the uniform of any law enforcement agency in Santa Clara County, upon filing with the Chief of Police of the exception made by the Sheriff, in writing, describing the uniform variance approved by him. B. Insignia No insignia shall be worn which may likely be confused with peace officers' insignias. (Cf. 583d P.C.) C. Shoulder Patches. In addition to any firm name, any shoulder patch worn shall have thereon the words "PRIVATE PATROL" or "SECURITY SERVICE" in letters not less than one -half inch (1/2 ") in height. D. Badges and Cap Pieces. Any badge or cap insignia worn shall bear on its face a distinctive word indicating the name of the operator and an employee number by which the wearer may be identified by the operator. (Source: 7538.5 B &P). They shall not contain the word "POLICE ". If the word "OFFICER" is used, it shall be in conjunction with the word "SECURITY." They shall not be in the shape of a star. ,II. VEHICLES A. Color No automobile used shall be entirely white; white, except for black front door panels; black, except for white front door panels; green or dark blue, except for white front door panels and white roofs; or any other color or combination of colors which may likely be confused with any law enforcement agency in Santa Clara County. Vehicles (continued) (A) used shall be entirely white; black, except for white tank, or except for white tank and white fenders; white, except for white tank or except for white tank and white fenders; or any other _ color or combination of colors which may likely be confused with any law enforcement agency in Santa Clara County. Markings Any automobile used shall bear the words "PRIVATE PATROL" on both sides and rear in letters not less than four inches (4 ") in height. ANTS' EQUIPNaIT SPECIFICATIONS - PRrlkTE PATROL The following uniform and equipment specifications are adopted by the Santa Clara County Law Enforcement Executive Council and the Sheriff's Department, A. UNIFORMS All private patrol organizations are to be outfitted in sage- gray,or dark brown uniforms. B. PAT CEM , The patch must be oval in shape with 1/2 -inch lettering giving the. name of the company and include the words "Private Patrol ". C. BADGES AM r.A P PTR'nr. q The private patrolmen may not wear badges resembling a star, or in cluding a seal or emblem. This must be a plain badge with the name of the company and the words "Private Patrol" placed on each. D. RANK AND TITLE The members of the patrol shall not hold rank or title, nor wear insignia (stripes, bars, etc.) similar to the police services. E. VEHICLES The color of private patrol vehicles is not to be black, black and white, blue, blue and white; no vehicle is to have white door panels. No seals'or decals are to be placed on the vehicle, but the name of the company and the words "Private Patrol" must be placed on the sides. (Suggest lettering be the same size as prescribed by the Vehicle Code for tow companies.)
