Ord 1355 - INTERIM URGENCY ORDINANCE OF THE TOWN OF LOS GATOS PROHIBITING ISSUANCE OF PERMITS AND LICENSES FOR SPECIFIED BUSINESSES PENDING STUDY OF ZONING ORDINANCES RELATING THERETOORDINANCE NO. 1 355 INTERIM URGENCY ORDINANCE OF THE TOWN OF LOS GATOS PROHIBITING ISSUANCE OF PERMITS AND LICENSES FOR SPECIFIED BUSINESSES PENDING STUDY OF ZONING ORDINANCES RELATING THERETO THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDAINS AS FOLLOWS: SECTION 1 No person shall commence or enlarge the operation of a restaurant or establishment selling alcoholic beverages for consumption on the premises in the C-2 or CC zones without first obtaining a conditional use permit in the manner and according to the standards provided in sections 5.20.200, 5.20.210, 5.20.220 and 5.20.230 of the Zoning Ordinance. SECTION 2 This ordinance is inapplicable in those instances where the Zoning Ordinance requires a use permit, and this ordinance does not authorize the commencement of any land use forbidden by the Zoning Ordinance. SECTION 3 This ordinance is adopted to protect the public safety, health and welfare, as an urgency measure pursuant to the provisions of Section 65858 of the Government Code and takes effect immediately. The urgency derives from the fact that severe parking and traffic congestion and problems involving public drinking exist in the portions of the Town affected by this ordinance, and that each of these problems _1® has a sufficient effect on the general public to warrant adoption of an interim urgency ordinance to be effective until appropriate zoning measures can be considered, adopted and become effective. One of the main, if not the main, cause of these problems now is the existence of numerous restaurants and drinking establishments in the Town of Los Gatos. New ones are proposed. The Planning Commission is investigating the matters described in this section to determine what, if any, zoning ordinance amendments to recommend to the Town Council for adoption. The purpose of this ordinance is to provide during the remainder of the period of study by the Planning Commission that each proposed activity described in Section 1 of this ordinance be examined by the Architecture and Site Committee or other body in the manner regularly provided by the Zoning Ordinance to determine if the activity will be appropriate at the proposed location, and what conditions, effective permanently at the discretion of the approving body, should be imposed, including extra parking requirements, so that the use, if allowed, will not be detrimental to the neighborhood, the Town or its inhabitants. SECTION 4 This ordinance is effective from May 2, 1977 to and including September 1, 1977.
