Ord 1394 - AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 19 1 FROM R- 1:20,000 TO R- 1:20,000 -PDORDINANCE NO. 1394 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 19 1 FROM R- 1:20,000 TO R- 1:20,000 -PD The Town Council of the Town of Los Gatos does ordain: SECTION 1. The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the zoning of the property shown on the map which is attached hereto marked Exhibit A and is a part of this ordinance, from R- 1:20,000 (Single Family Residential: 20,000 square foot minimum lot size) to R- 1:20,000 -PD (Single Family Residential: 20,000 square foot minimum lot size - Planned Development). SECTION 2. Uses and Improvements Authorized The PD (Planned Development Overlay) Zone established by this ordinance authorizes development on the above described real property of 15 single Family residences and other improvements shown and required on the "Official Development Plan" which is attached hereto and marked Exhibit B. The uses for this property are those specified for the R -1 (Single Family Residential) zone by Sections 4.26.020 (Permitted Uses) and 4.26.030 (Conditional Uses) of the Town of Los Gatos Zoning Ordinance as these sections exist at the time of the adoption of this ordinance or as they may be amended in the future. However, no use listed in Section 4.32.030 is allowed unless specifically authorized by this ordinance or by conditional use permit. SECTION 3. Compliance With Other Development Standards The development standards of Zoning Ordinance Sections 4.26,070 and 4.26.080 shall apply to this planned development. The yard requirements shall be 25 feet front, 20 feet rear, 15 feet side, 20 feet side abutting street. All general provisions in Article 3 of the Zoning Ordinance apply, and the provisions of Chapters 4.10 of the Zoning Ordinance apply to the planned development except where the Official Development Plan specifically shows otherwise. SECTION 4. Permits Architecture and site approval is required before any grading or construction work is performed, whether or not a permit is required for the work, and before any permit for grading or construction is issued. No construction permits shall issue in a manner complying with the requirements of Section 4,82.120 of the Zoning Ordinance. SECTION 5. Official Development Plan The Official Development Plan for this Planned Development Overlay Zone consists of this ordinance and Exhibit B which is a part of this ordinance. SECTION 6, Performance Standards In addition to the foregoing exhibits, the following performance standards are part of the Official Development Plan and must be complied with before issuance of any grading or construction permits: 1. The applicant (property owner) shall dedicate or obtain the dedication of the following right -of -way, to the satisfaction of the Town Engineer: A. Granada Way. A 56 -foot right -of -way from the existing terminus of Granada Way to the applicant's south property line.. -2- B. "B" Street. A 45 -foot right -of -way, plus appropriate additional width for slope and drainage facilities along the south property line between Granada Way and Capistrano Place. C. Cul -de -sac. A standard 56 -foot right -of -way with a 40 -foot radius bulb. D. Sanitary and storm easements as required. E. Smith Creek access and drainage easement as required. F. Trail easement along the northeast corner of the applicant's property as required. 2. The applicant shall guarantee, by contract and bond, the following improvements, to the satisfaction of the Town Engineer: A. Granada Way (existing terminus to south property line) and cut -de -sac. A 36 -foot curb -to -curb street including curb and gutters, paving, street lights, sidewalks (cul -de -sac and west side of Granada Way), storm and sanitary sewers. B. "B" Street (along south property line to Capistrano Place). A 32 -foot curb -to -curb street with curbs and gutters, side- walks (north side only), paving, street lights, storm and sanitary sewers, fence along the north property line between applicant's property and Capistrano Place be worked out on tentative map. C. Storm and sanitary sewers. D. Water District Requirements: (1) A concrete swale installed at the top of any cut slope. (2) A 6 -foot chain link fence installed at the top of the cut slope. (3) The cut slope and swale should be on Town property, (4) The cut slope planted with erosion resistant grass or shrubs and irrigated until established. (5) All grading adjacent to District property done in the dry season. (6) A retaining wall in place of the cut slope would be satisfactory. -3- 3. The applicant shall submit a soils engineering report specifying grading, foundation, and pavement design criteria, to the satis- facton of the Town Engineer. 4, The applicant shall submit a final grading and drainage plan, to the satisfaction of the Town Engineer. 5. The developer shall install three (3) hydrants that meet Central Fire Protection District's specifications and deposit $535.00 for hydrant rental for period of five (5) years. Hydrants shall be installed and accepted prior to construction of any bui'ldings.. 6. A final landscape and irrigation plan for the common area shall be submitted to and approved by the Superintendent of Parks and Forestry and the Planning Director, 7. A uniform style of fencing shall be used throughout the project and shall be evaluated as part of the overall project design at the time of architecture and site approval. 8. Dui:lding location and configuration for lots 14 and 15 w11 be given special attention at the time of architecture and site approval, especially in terms of conforming to natural grade and minimizing tree removals. 9. landscape plans shall be submitted for the front yards of lot 1 and lots 7 -11 (within the Water District easement) at the time of architecture and site approval. 10. lot lines of all lots are subject to further specification during the review of the tentative map, 11, Tree islands within Granada Way will be. given special review during hearing on the tentative map, Ideally, the minimum size of islands will correspond to the driplines, 12. Dots. 16 and 17 are not authorized residential building sites and this shall be noted upon any final subdivision map for the project. SECTION 7, This ordinance takes effect 30 days after the date it is adopted.. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town, 10 This ordinance was introduced at a regular meeting of the Town Council of the Town of Los Gatos on April 17, 1978 _, and adopted by the following vote as an ordinance of the Town of Los Gatos at a regular meeting of the Town Council on May 1, 1978 AYES: COUNCIL MEMBERS Ruth Cannon, Thomas J.
