Ord 1396 - AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 21 FROM R- 1:8,000 AND C -1 TO R- 1:8,000 -PDORDINANCE NO. 1396 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 21 FROM R- 1:8,000 AND C -1 TO R- 1:8,000 -PD The Town Council of the Town of Los Gatos does ordain: SECTION 1. The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the zoning of the property shown on the map which is attached hereto marked Exhibit A and is a part of this ordinance, from R- 1:8,000 (Single Family Residential, 8,000 square foot minimum lot size) and C -1 (Neighborhood Commercial) to R- 1:8,000 -PD (Single Family Residential, 8,000 square foot minimum lot size - Planned Development). SECTION 2. Uses and Improvements Authorized The PD (Planned Development Overlay) Zone established by this ordinance authorizes the following construction and use of improvements: 1. Restaurant a. Including the sale of alcoholic beverages without limitation. b. With floor area not exceeding 13,700 square feet. c. With seating capacity not to exceed 552 persons. 2. Two storage and maintenance buildings floor area not to exceed 4,800 square feet. 3. Conference building floor area not to exceed 1,300 square feet and a capacity of 66 persons. 4. A 31 -unit motel with separate manager's unit and administrative area with room service from restaurant. 5. Remodel existing garage into a five space carport and add five carport spaces along north property line. 6. Fifteen, two -story single family dwellings for eventual sale as planned development units (as defined in Government Code Section 11003). 7. Existing two- family, one -story dwelling. 8. Landscaping, parking, swimming pool, new front entry to restaurant, and other improvements shown and required on the Official Development Plan. 9. Signs a. Restaurant and motel: Wall signs on buildings, and a freestanding sign at Winchester Boulevard entrance or wall signs erected on freestanding entrance walls. b. Townhouses: Neighborhood identification sign. 10. For that area within the boundary of the townhouse complex as shown on the Official Development Plan the uses are those specified in the R -M Multiple Family Residential Zone by Sections 4.32.020 (Permitted Uses) and 4.32.030 (Conditional Uses) of the Zoning Ordinance (as those sections exist at the time of the adoption of this ordinance or as they may be amended in the future). However, no use listed in Section 4.32.030 is allowed unless specifically authorized by this ordinance or by conditional use permit. SECTION 3. Compliance With Other Development Standards For that area within the boundary of the townhouse complex as shown on the Official Development Plan the development standards of the Zoning Ordinance Sections 4.32.080 and 4.32.090 shall apply. All general provisions in Article 3 of the Zoning Ordinance apply, and the provision of Chapters 4.10 and 4.40 of the Zoning Ordinance apply to the.residential and nonresidential portion of the Planned Development respectively except when the Official Development Plan specifically shows otherwise. SECTION 4. Permits No construction permits shall issue in a manner complying with the require- meets of Section 4.82.120 of the Zoning Ordinance. -2- SECTION 5. Official Development Plan The Official Development Plan for this Planned Development Overlay Zone consists of this ordinance and Exhibits B, C, D, E and F which are a part of this ordinance. SECTION 6. Performance Standards In addition to the foregoing exhibits, the following performance standards are part of the Official Development Plan and must be complied with before issuance of any grading or construction permits except for Numbers 9 and 10 which must be complied with before authorization of any occupancy. 1. The applicant shall dedicate right -of -way for the widening of Winchester Boulevard in conformance with the Official Plan Line across the entire property frontage including 15390 Winchester Boulevard. 2. The applicant shall guarantee by contract and bond the installation of the following improvements to the satisfaction of the Town Engineer: a. Winchester Boulevard (Entire frontage including 15390 Winchester Boulevard). Curb and gutter (curb line 42 feet from the centerline), sidewalks, tie -in paving, street lights, storm and sanitary sewers, and interim traffic channelization improvements. b. Interior Private Residential Street Curb and gutter (24 feet curb -to- curb), sidewalks, street lights, paving, storm and sanitary sewers. c. Storm and sanitary sewer system, as required. 3. The applicant shall pay an in -lieu fee equal to one -half the estimated cost of constructing a landscaped irrigated median island across the Winchester Boulevard frontage of the property as determined by the Town Engineer. 4. A precise grading plan shall be submitted to and approved by the Town Engineer. 5. A soils report with grading, foundation and pavement design criteria shall be submitted to and approved by the Town Engineer. The report shall establish the stability of the existing bank and recommend protection measures. -3- 6. A final traffic circulation plan (with 24 -foot minimum entrance driveway) shall be submitted to and approved by the Town Engineer. 7. The existing overhead utility service line across the property be removed and the lines placed underground. 8. On -site parking shall be provided at the following ratios: a. Restaurant, including conference building - 1 space /3 seats. b. Motel - 1 space /each guest room plus 1 space /employee, plus 1% space /apartment or manager's unit. c. Townhouses - 3.3 spaces /living unit. 9. Signs a. Restaurant and motel: Cl) Wall signs shall not exceed an area of 1 square foot for each lineal foot of primary business frontage. (2) The freestanding sign shall not exceed an area of 50 square feet per face on a total area of 100 square feet and height of 15 feet. 0) The wall signs erected on the freestanding entrance walls shall not exceed an area of 1 square foot for each lineal foot of wall. b. Townhouses: The neighborhood identification sign shall not exceed an area of 24 square feet and height of 7 feet. 10. Existing nonconforming freestanding sign at driveway entrance shall be removed before erection of any new freestanding signor any sign on freestanding entrance walls and in any event on or before February 28, 1981. 11. The rear wall of the carport shall be of solid continuous concrete block construction to the plate line along the existing and new carport for permanence, sound control and minimum impact to the trees. 12. The 6- foot -high fence shall be extended behind the carport to connect with the masonry wall at the easterly end of the carport. 13. The elevation of the 6-foot-high masonry wall shall be measured from the elevations of properties on the north side of the wall. 14. Design of the motel units shall reflect residential character. 15. All motel lighting shall be suitably screened from residential areas. -4- SECTION 7. This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. This ordinance was introduced at a regular meeting of the Town Council of the Town of Los Gatos on May 1, 1 . 978 , and adopted by the continued following vote as an ordinance of the Town of Los Gatos at a fegular meeting of the Town Council on May 16, 1978 AYES: COUNCIL MEMBERS Ruth Cannon, John B.
