AN ORDINANCE OF THE TOWN OF LOS GATOS
AMENDING THE ZONING ORDINANCE EFFECTING
ZONE CHANGE NO. 71 FROM LM -PD TO LM -PD
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDAINS:
SECTION I.
The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the
zoning of the property at 718 University Avenue shown on the map which is attached
hereto, marked Exhibit A and is a part of this ordinance, from LM -PD
(Commercial - Industrial Planned Development) to LM -PD (Commercial - Industrial Planned
Development).
SECTION II.
The PD (Planned Development Overlay) zone established by this ordinance
authorizes the following construction and use of improvements:
1. Construction of a multi -use facility (research and development, light
industrial and office) with a maximum gross flour area of 27,600 square
feet..
2. Parking, landscaping and other improvements shown and required on the
Official Development Plan.
3. Uses permitted are those specified in the LM (Commercial - Industrial) zone
by Sections 4.72.020 (Permitted Uses) and 4.72.030 (Conditional Uses) of
the Zoning Ordinance, as those sections exist at the time of the adoption
of this ordinance, or as they may be amended in the future, and
professional /administrative office uses.
SECTION III
COMPLIANCE WITH OTHER DEVELOPMENT STANDARDS
All general provisions in Article 3 of the Zoning Ordinance apply, and the
provisions of Chapter 4.40 of the Zoning Ordinance apply except when the Official
Development Plan specifically shows otherwise.
SECTION IV
Architecture and Site Approval is required before any grading or construction
work is performed, whether or not a permit is required for the work, and before any
permit for grading or construction is issued. Grading or construction permits shall
only be used in a manner complying with Section 4.82.120 of the Zoning Ordinance.
SECTION V
OFFICIAL DEVELOPMENT PLAN
In addition to Exhibit A (Zone Change Vicinity Map), the attached Exhibit B
(Site Plan), Exhibit C (Grading & Drainage Plan), Exhibit D (Landscape Plan),
Exhibit E (Elevations), and Exhibit F (Section through Site) are part of the
Official Development Plan. The following performance standards are part of the
Official Development Plan and must be complied with before issuance of any grading
or construction permits:
1. Final grading, drainage, masonry retaining wall, driveway, parking lot
lighting and striping, utility including sanitary sewer, storm drainage and
interim erosion control plans shall be provided, to the satisfaction of the
Town Engineer.
2. A well information questionnaire (available through the Town Engineer) shall
be completed to the satisfaction of the Town Engineer.
3. Payment of an in -lieu fee equal to one -half of the cost of a landscaped median
island across the University Avenue frontage of the property.

4. A soils and geologic report shall be prepared which provides specific criteria
and standards governing site grading, drainage, foundation design and erosion
control, to the satisfaction of the Town Engineer. A registered civil
engineer, specializing in soil mechanics, should be included in the group that
prepares this report.
5. The following shall be dedicated, to the satisfaction of the Town Engineer:
a. University Avenue. A 40-foot half - street right -of -way.
b. Storm drainage facilities off -site.
C. Sanitary sewer facilities off -site.
6. All documents, contracts, bonds, insurance, as applicable, shall be provided
prior to recordation of any final map or issuance of any permits to the
satisfaction of the Town Engineer.
7. An agreement shall be entered into, satisfactory to the Town Engineer and Town
Council to pay 1% of the cost of a traffic signal at the intersection of
University Avenue and Lark Avenue.
8. An agreement shall be entered into, satisfactory to the Town Engineer and Town
Council, to pay 1% of the cost of intersection improvements at the
intersection of Los Gatos Boulevard /Blossom Hill Road.
9. A two -year tree maintenance contract shall be established for the protection
of existing and newly planted trees to the satisfaction of the Town Engineer.
10. Prior to building permits being issued, the applicant shall meet with the
Director of Parks, Forestry and Maintenance Services concerning the need for
protective fencing around the existing trees. A plan for such protective
fencing demonstrating type and location shall be submitted to the Planning
Director after being approved by the Director of Parks, Forestry and
Maintenance Services. Such fencing is to be installed prior to, and be
maintained during construction.
11. Six precast concrete picnic tables with benches shall be provided by the
applicant in the dedicated area, to the satisfaction of the Director of Parks,
Forestry and Maintenance Services.
12. A six foot high fence will be located between the subject parcel and the
park. The type of wall and construction shall be to the satisfaction of the
Director of Parks, Forestry and Maintenance Services and the Planning
Director.
13. The proposed gate from the subject parcel to the park shall be designed to be
locked by the applicant and shall be the applicant's total responsibility.
14. The developer shall extend the existing water system.

15. The developer shall install four hydrants to meet Central Fire Protection
District's specifications.
16. A key lock box shall be provided at the main entrance to the building or as
otherwise directed by the Fire Chief. The lock box shall contain keys to
locked points of ingress, mechanical equipment rooms, etc.
17. The developer shall provide a fire alarm system to the satisfaction of the
Fire Chief.
18. The maximum height of the structure(s) shall not exceed 35.
15. The developer shall dedicate that strip of land (approximately 1/4 acre)
located along the southerly border of the property as shown on the Site Plan
attached as part of Exhibit B of this Ordinance.
20. The developer shall investigate an alternate treatment of the stair- towers so
that they look more like vertical circulation and less like outsized
fireplaces.
21. The developer shall investigate an alternate design for the main entrance to
delete the full height glass wall (West elevation).
22. The developer shall consider extending the use of brick, allowing the glass
areas to play a secondary role.
23. The developer shall consider an alternate design for the gable ends that may
reduce the apparent height and enhance the building's continuity From
elevation to elevation.
24. An agreement between the developer and the Town shall be entered into
satisfactory to the Superintendent of Parks, Forestry and Maintenance Services
for the maintenance of the landscaping at the southwest corner of the property
to keep this area adjacent to the park in as natural a state as determined
possible.
SECTION VI
Adoption of this ordinance will repeal existing Ordinance No. 1275 which amended
the Zoning Ordinance affecting Zone Change No. 145.
SECTION VII
This ordinance takes effect 30 days after the date it is adopted. Within 15
days after this ordinance is adopted the Town Clerk shall cause it to be published
once in a newspaper of general circulation published and circulated in the Town.

of the Town Council of the Town of Los Gatos on NOVEMBER 3rd 1986 and adopted
by the following vote as an ordinance of the Town of Los Gatos at a regular meeting
of the Town Council on NOVEMBER 17th , 1986.
