Ord 1675 - AMENDING SECTION 2. OF ORDINANCE 1278 RELATING TO THE MACABEE GOPHER TRAP MANUFACTURING COMPANYORDINANCE NO. 1675 AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING SECTION 2. OF ORDINANCE 1278 RELATING TO THE MACABEE GOPHER TRAP MANUFACTURING COMPANY THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDAINS: SECTION I. SECTION 2. of Ordinance 1278 is amended to read: The following structure is hereby designated historically and culturally significant: HD -75 -2 Macabee Gopher Trap Manufacturing Company 110 Loma Alta Avenue A detailed description of the designated structure, the characteristics which justify designation, and a map showing the location and delineation of the historic structure, are part of this ordinance. SECTION II. The property listed is designated to be of historic, architectural, or aesthetic significance for the reasons listed below. A. Property: Macabee Gopher Trap Manufacturing Company building - 110 Loma Alta Avenue B. Historic Designation No. HD -75 -2 C. Description of Designation: Structure D. Description of Particular Features that Should be Preserved in Addition - to Those Covered under Section 4.86.120: None. E. Purpose of Designation: The Macabee Gopher Trap Manufacturing Company has been the primary use of said property since 1900. The purpose of granting a historical designation to the property is to acknowledge the ongoing use of the property as well as to designate the structure which was constructed in 1894. F. Description of the characteristics which justify the designation: This Eastlake -style wood frame one -story home containing five rooms and a basement is an historic home which has been converted to commercial use. The house, built in 1894 as a first residence for Zephyr and Elizabeth Macabee, served later as a workshop where the Macabee Gopher Trap was invented and patented in 1900. The home has remained in the Macabee family and is owned by the Macabee heirs: Mr. Raymond Macabee (62 Broadway), Mrs. Lanty B. Evans (81 Reservoir Road) and Mrs. Don Hobbie (of Oroville). The gopher traps have been manufactured on the property since 1900 with a wide distributorship in the Western States and occasional orders sent to the East Coast and foreign markets. G. Use of the Property: The use of the property as a manufacturing activity for gopher traps is allowed to continue subject to the provisions of Section 4.86.050(4) of the Zoning Ordinance. The manufacturing activity is hereby permitted to continue based on the following findings: (a) The use has been legal and continues to operate in a manner that is not detrimental to the general vicinity in that the use has not created negative impacts with regard to noise, traffic, parking, dust, light or litter. - 2 - (b) There is no history of complaints about the use. A review of the Town records did not reveal any complaints for 110 Loma Alta Avenue. (c) Removal of the use to another location would effectively end the significance of the historical designation on the property in that the property has been operating in basically the same way and in the same location since 1900. The use has become an integral part of the structure therefore, it is not possible to remove the equipment and machinery to another location. (d) The use has been legally and continuously operating for over 80 years. SECTION III. This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. This ordinance was introduced at a reqular meeting of the Town Council of the Town of Los Gatos on February 3rd 1986 and adopted by the following vote as an ordinance of the Town of Los Gatos at a regular meeting of the Town Council on February 18th , 1986.
