Ord 1672 - AN URGENCY INTERIM ZONING ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE TO ADD RESIDENTIAL MOBILE HOME ZONEORDINANCE NO. 1672 AN URGENCY INTERIM ZONING ORDINANCE OF THE TOWN OF LOS GATOS AMENDING THE ZONING ORDINANCE TO ADD RESIDENTIAL MOBILE HOME ZONE THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDAINS: SECTION I. Section 2.00.345 is added to read: SEC. 2.00.345: MOBILE HOME A mobile home is as defined in section 798.3 of the Civil Code. SECTION II. Chapter 4.36 is added to read: RMH or Mobile Home Residential Zone SEC: 4.36.010: INTENT The RMH zone provides high density multiple dwelling areas for mobile homes. SEC. 4.36.020: PERMITTED USES The following uses are permitted: (1) Mobile Home Parks for single-family dwelling uses. (2) Common recreational facilities and structures. (3) Administrative offices for Mobile Home Park use. (4) Residential quarters for use by manager or other Park employees: (5) Accessory uses normally incidental to a Mobile Home Park and accessible only through the internal Park circulation system. SEC 4.36.030: CONDITIONAL USES In addition to the activities authorized by section 4.30.020; the activities listed in the table in section 5.20.205 are allowed if a conditional use permit is listed. SEC. 4.36.040: LOT AREA The minimum lot area is five acres. SEC. 4.36.050: DENSITY The maximum density on a zoning plot shall not exceed 12 dwelling units per net acre. SEC. 4.36.060: YARDS (1) Front: 25 feet minimum (2) Side: 8 feet minimum (3) Rear: 20 feet minimum (4) Side abutting street 15 feet minimum SEC. 4.36.070: HEIGHT The maximum height of any principal building is 30 feet. The height shall be measured as provided in section 4.10.050 and is subject to the exception listed in section 3.15.010. SEC. 4.36.080: LOT AREA COVERAGE Maximum building coverage including mobile homes and any type of accessory building is 40 per cent. SEC. 4.36.090: RECREATIONAL OPEN SPACE FOR MOBILE HOME PARKS There shall be a total open space area of 200 square feet for each dwelling unit, usable for outdoor activities. This area is in addition to required yards, is a minimum requirement and shall be composed of private areas; community areas or both as determined by the deciding body. Any areas intended to serve as private open space shall be screened for privacy of the occupant as required by the deciding body. - 2 - SEC. 4.36.010: ARCHITECTURE AND SITE APPROVAL Architecture and Site approval is required in all cases except for locating a new mobile home on an existing approved mobile home space: SECTION III. The Table of Conditional Uses in Section 5.20.205 is amended as follows: a. Add a column for the RMH zone. b. Add line 4.j as follows: Conversion of a Mobile Home Park to condominium ownership. c. Add x's in the R -M and RMH column for the new line 4.j. SECTION IV. Pursuant to Government Code Section 65858(a); the Town Council hereby finds that there is a current and immediate threat to the public health, safety and welfare as follows: a. The Town has studied the establishment of a residential mobile home zone as part of its implementation of the General Plan and on December 1; 1985 adopted Town Ordinance No. 1667 to establish a Residential Mobile Home Zone (RMH); b. Due to an error Ordinance No. 1667'was not published and will not become effective until February 5; 1986 upon its readoption on January 6; 1986; C. On December 16; 1985 the Town Council adopted Town Ordinance No. 1668 and No. 1669 rezoning two properties to the residential mobile home zone, which will become effective January 15, 1986; and d. Pursuant to Government Code Section 65858(a) in order to implement the rezonings consistent with Town policy set forth in the General Plan, it is necessary that this urgency interim zoning ordinance be adopted which prohibits all uses in the RMH zone except residential mobile home parks. - 3 - SECTION V This ordinance shall take effect immediately and be of no further force and effect after the effective date of Town Ordinance No. 1667. SECTION VI The Town Clerk of the Town of Los Gatos shall cause this ordinance to be published once within fifteen (15) days after its adoption, in a newspaper of general circulation published and circulated in the Town. SECTION VII This urgency ordinance was introduced and adopted at a regular meeting of the Town of Los Gatos on January 6, 1986, by the following vote. AYES: COUNCIL MEMBERS Joanne Benjamin Thomas J.
