Ord 1714 - AMENDING ORDINANCE 1656 WHICH AMENDED THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 66 FROM R -1D -LHP TO R -1D- LHP -PDORDINANCE NO. AN ORDINANCE OF THE TOWN OF LOS GATOS AMENDING ORDINANCE 1656 WHICH AMENDED THE ZONING ORDINANCE EFFECTING ZONE CHANGE NO. 66 FROM R -1D -LHP TO R -1D- LHP -PD THE TOWN COUNCIL OF THE TOWN OF LOS GATOS ORDAINS: SECTION I. The Zoning Ordinance of the Town of Los Gatos is hereby amended to change the zoning of the property located northwesterly of the intersection of Bachman and Massol Avenues shown on the map which is attached hereto, marked Exhibit A and is a part of this ordinance, from R -1D -LHP (Single Family Residential Downtown, Landmark and Historic District) to R -1D- LHP -PD (Single Family Residential Downtown, Landmark and Historic District, Planned Development. SECTION II. The PD (Planned Development Overlay) zone established by this ordinance authorizes the following construction and use of improvements: 1. Construction of eight new single family residences and use of one existing single family residence on the property. 2. Parking, landscaping and other improvements shown and required on the Official Development Plan. 3. Uses permitted are those specified in the R -ID (Single Family Residential Downtown) zone by Sections 4.34.030 (Permitted Uses) and 4.34.040 (Conditional Uses) of the Zoning Ordinance, as those sections exist at the time of the adoption of this ordinance, or as they may be amended in the future. However, no use listed in Section 4.26.030 is allowed unless specifically authorized by this ordinance, or by conditional use permit. SECTION III COMPLIANCE WITH OTHER DEVELOPMENT STANDARDS All general provisions in Article 3 of the Zoning Ordinance apply, and the provisions of Chapter 4.10 of the Zoning Ordinance apply except when the Official Development Plan specifically shows otherwise. SECTION IV Architecture and Site Approval is required before any grading or construction work is performed, whether or not a permit is required for - the work, and before any permit for grading or construction is issued. Grading or construction permits shall only be used in a manner complying with Section 4.82.120 of the Zoning Ordinance. SECTION V OFFICIAL DEVELOPMENT PLAN In addition to Exhibit A (Zone Change Vicinity Map), the attached Exhibits B (Preliminary Landscape Plan), C (Tree Tabulations and Fence Details), D (Plot Plan), E (Unit A Floor Plans and Elevations), F (Unit 8 Floor Plans and Elevations), G (Unit C Floor Plans and Elevations), H (Block Elevation), I (Preliminary Utility and Grading and Drainage Plan) are part of the Official Development Plan. The following performance standards are part of the Official Development Plan and must be complied with before issuance of any grading or construction permits: 1. A subdivision map shall be filed to the satisfaction of the Town Engineer. 2. The following improvements shall be guaranteed by contract and bond, to the satisfaction of the Town Engineer. a. Bachman Avenue frontage. Repair of cracked and broken sections of curb, gutter and sidewalk between Glenridge Avenue and Massol Avenue. - 2 - b. Bachman Avenue westerly of Glenridge. Permeable material meandering sidewalk, concrete curb and gutter and pavement repair designed to save the existing Oak trees. c. Interior private driveway. Asphaltic concrete paving with a 14 -20 foot wide curb -to -curb section and interior lighting sidewalk on one side. d. Storm drainage system including manholes, piping, outfall structures, stream bank protection, to the satisfaction of the Santa Clara Water District. e. Sanitary sewer system, including manholes, mains, laterals, and sanitary sewer clean -outs. 3. Grading, drainage (including drainage basin study), interim and final erosion control, circulation and lighting plans shall be provided, to the satisfaction of the Town Engineer. 4. Public utility, storm drain, and sanitary sewer easements as required shall be provided, to the satisfaction of the Town Engineer. 5. An application shall be submitted to the Town Engineer for a revocable permit to allow the following: a. The construction of a driveway over public right -of -way (Lots 1 and 2). b. Ingress, egress and parking (Lots 1 and 2). 6. Verification of access rights shall be submitted for Parcel "A" (Echols), to the satisfaction of the Town Engineer. 7. A two -year tree maintenance contract shall be established for the protection of existing and newly planted trees, to the satisfaction of the Town Engineer. 8. Prior to any building permits being issued, the applicant shall meet with the Director of Parks, Forestry and Maintenance Services concerning the need for protective fencing around the existing trees. A plan for such protective fencing demonstrating type and location shall be submitted to the Planning Director after being approved by the Director of Parks, Forestry and Maintenance Services. Such fencing is to be installed prior to, and be maintained during construction. 9. A fee in lieu of building a BMP unit shall be paid at the time of receiving the first building permit in an amount to be determined by the method as established by Town Council resolution. 10. Massol Creek shall be left in its natural state, except - For brush clearing and erosion control. - 3 - SECTION VI This ordinance takes effect 30 days after the date it is adopted. Within 15 days after this ordinance is adopted the Town Clerk shall cause it to be published once in a newspaper of general circulation published and circulated in the Town. This ordinance was introduced at a regular meeting of the Town Council of the Town of Los Gatos on March 16th , 1987 and adopted by the following vote as an ordinance of the Town of Los Gatos at a regular meeting of the Town Council on April 6th '1987.
