URGENCY ORDINANCE OF THE TOWN OF LOS GATOS
ESTABLISHING A FILING FEE TO BE PAID BY CANDIDATES
FOR THE ELECTED OFFICES OF THE TOWN OF LOS GATOS
THE TOWN COUNCIL OF THE TOWN OF LOS GATOS DOES HEREBY
ORDAIN:
SECTION I
Pursuant to the authority contained in Section 22843 of the Elections Code of
California, a fee in the amount of twenty -five dollars ($25.00) is hereby established as the
filing fee which each candidate for the elected offices of the Town of Los Gatos, namely
Town Council Member, Treasurer and Town Clerk, shall pay to the Town of Los Gatos
when the candidate for office files the required nomination papers with the Town Clerk.
SECTION II
The Town Council hereby finds and determines that a filing fee of twenty -five dollars
($25.00) is proportionate to the actual cost to the Town of Los Gatos of processing the
nomination papers of each candidate including but not limited to the time required to be
spent by the Town Clerk and other Town employees who may assist in:
a. Receiving the nomination papers when tendered for filing, and verifying the
signatures of those voters proposing a candidate;
b. Determining whether the candidate and each voter proposing the candidate
is, in fact, a registered voter of the Town;
C. Determining whether or not each voter proposing a candidate has signed
another nomination paper for that office Section 22836 of the Elections Code;

d. Determining whether or not the designation of the place of residence of each
signer of a nomination paper is correct as required by Section 22837 of the
Elections Code;
e. Examining the nomination paper to determine whether or not the candidate
has completed the verified statement required by Section 22839 of the
Elections Code; and
f. Determining whether or not the designation which the candidate desires to
have appear under the candidate's name on the ballot is one of the
designations permitted by law.
SECTION III
This Ordinance is an urgency ordinance and is for the immediate preservation of the
public peace, health and welfare. The facts constituting the urgency are as follows:
1. The Town of Los Gatos is required to call a municipal election to be held on
November 6, 1990 to fill the offices of three (3) members of the Town
Council.
2. The first date on which a candidate may take out and file nomination papers
for each office with the Town Clerk is July 16, 1990, and the last date on
which nomination papers may be filed is August 10, 1990.
3. The Town Council has determined and found that by reasons of the reduction
in the number and sources of revenue available to it to fund the cost of
performing the general governmental functions mandated upon this Town by
the State Legislature, including but not limited to those performed by the
Town Clerk relating to municipal elections, it is necessary to exercise the
power granted to it to establish a candidate's filing fee pursuant to Section
22843 of the Elections Code and to be in effect prior to the time for filing
nomination papers for the 1990 Municipal Election.

4. Because sufficient time does not remain before the first and last dates upon
which nomination papers may be taken out and filed to permit establishment
of a filing fee in time to generate the needed revenue for the 1990 Municipal
Election by the usual process of introduction and subsequent adoption of an
ordinance which would not become effective for thirty (30) days thereafter,
the adoption of this Ordinance as an Urgency Ordinance is necessary.
SECTION IV
This Ordinance takes effect immediately upon its adoption. Within fifteen (15) days
after this Ordinance is adopted, the Town Clerk shall cause it to be published once in a
newspaper of general circulation published and circulated in the Town.
PASSED AND ENACTED as an Urgency Ordinance at a regular meeting of the
Town Council of the Town of Los Gatos this 18th day of June, 1990, by the following vote:
